Yeddyurappa Government Wins Trust Vote Amid Chaos


Eyes on Governor, Centre after Yeddy Passes Floor Test

Bangalore, Oct 11: After the brazen act of getting as many as 16 MLAs, including 11 from BJP and five independents, disqualified from the membership of the Karnataka Legislative Assembly by using a 'compliant' speaker K G Bopaiah, the beleaguered chief minister B S Yeddyurappa has managed to pass the floor test.

The entire exercise was over in a matter of a few minutes with the ruling party winning the motion of confidence of the House by voice vote amid unprecedented tight security and deployment of police forces in and outside the Vidhana Soudha and even imposing severe restrictions on the media from carrying out their legitimate duties.

The combined opposition Congress and JD(S) members as well as the anti-BJP legislators were not allowed to raise any discussion in the House. In fact, the 16 MLAs were prevented from entering the precincts of the Assembly.

The enraged Opposition members immediately trooped to Raj Bhavan to take their complaints against the 'brazen, illegal, undemocratic and unconstitutional' manner in which the ruling BJP managed to overcome the crucial trial of strength in the House in less than a few minutes, and submitted a memorandum to governor H R Bhardwaj demanding dismissal of the Yeddyurappa regime for what they termed as the 'lack of majority in the Assembly.'

The governor, who has been taking a pro-active role in needling the Yeddyurappa regime right from the time he assumed office and has been actively monitoritng the situation including issuing directions even to the speaker K G Bopaiah, can be expected to submit a detailed report to the Centre.
         
Meanwhile, the Congress-led UPA regime at the Centre, which has reportedly convened an emergency meeting of the Union Cabinet at 3.30 pm, can be expected to take stock of the changing political situation and take suitable decisions based on the governor’s report.
           

Media allowed but with severe restrictions
          
The Yeddyurappa-led BJP regime, which had clamped severe restrictions and even sought to ban the media from covering the proceedings, especially the visual media, later relented. The print and visual media representatives were allowed to enter the Vidhana Soudha precincts with one of the unprecedented security check-ups and allowing only the media representatives having the official accreditation cards issued by the information department and the passes issued by the Legislature secretariat only in the year 2010. The check-up was so tight that even the minutest discrepancy was not allowed.

The ruling party had imposed prohibitory orders in and around Vidhana Soudha upto a radius of 2 kms and had even declared holidays for the staff of Vidhana Soudha and Vikas Soudha for the entire day. Even the staff of the Multi-Storeyed Building near the Vidhana Soudha were given half a day’s holiday.
           
Several media representatives were pushed around and even allegedly assaulted and arrested. In fact, policemen in mufty were allowed to enter the Assembly precincts. There were altercations between the police, media and representatives of political parties, with breaking of glass panes in the Vidhana Soudha.
           
Along with the restrictions and curbs imposed on the media, it is learnt that the Yeddyurappa regime had even resorted to unscheduled disruption in power supply in Bangalore, Mysore and other prominent cities to prevent the telecast of the proceedings of the political drama from reaching the general public.

Yeddyurappa, who managed to win the trust vote by disqualifying the 16 legislators who had informed the governor in writing about their decision to vote against him, later attacked the Congress and JD(S) leaders. He was particularly harsh on the father-son duo of former prime minister and JD(S) supremo H D Deve Gowda and his son and former chief minister H D Kumaraswamy, who is also the state JD(S) president and a Lok Sabha member, for conspiring to destabilise his democratically elected government.

Speaker is Yeddyurappa’s 'puppet'

The chief minister accused Kumaraswamy of employing the services of Mumbai underworld elements to kidnap the ruling party legislators and independents, who had become associate members of the ruling BJP, and virtually keeping them under house arrest in different places and shifting them from place to place and state to state. He accused the Congress-led Goa government headed by Digambar Kamath of joining in the conspiracy to destabilise his democratically elected government.

Kumaraswamy attacked the chief minister’s passing the floor test in the Assembly as the darkest chapter in the history of democracy and in the annals of Karnataka. "The speaker Bopaiah had proved that he is a puppet of Yeddyurappa and lowered the dignity of  the august office held by him which had seen stalwarts like V Baliga," he said.
           
"Yedyurappa has lost his majority in the House. He has misused the speaker's chair. It shows their inability to prove their majority," Kumaraswamy said mentioning that the strength of the members opposed to Yeddyurappa was more than 118 in the 224-memebr Assembly.
          
KPCC working president D K Shivakumar said, "The House was not conducted, the policemen were inside the House. Within a minute the speaker left. We will go with all the MLAs for the headcount in front of the governor."

Meanwhile, the Union home ministry has expressed serious concern over the Karnataka situation and has taken serious note of it. The tenth schedule of the Constitution has been abused, according to a spokesman of the Union home ministry.


Disqualified MLAs trying to get stay order

Incidentally, all the 16 disqualified MLAs are likely to move the High Court or the Supreme Court and get a stay order against the order of the speaker for their disqualification, which automatically leads to Yeddyurappa regime losing its majority in the House.

The Karnataka High Court has posted hearing on the petition filed by the 16 'disqualified' MLAs before a Division Bench at 3 pm.

It remains to be seen whether the Division Bench of the High Court grants the stay order as sought by the 'disqualified' MLAs.


President’s Rule likely?

It remains to be seen what action the Centre is likely to take in the present situation. Speculation is ripe in political circles that the Centre may decide to dismiss the Yeddyurappa regime for losing its majority in the Assembly and go in for keeping the Assembly in suspended animation.

Thus, it is too early and premature for Yeddyurappa and the ruling BJP to hold celebrations for proving its majority on the floor of the Karnataka Assembly.

    I am surprised with the comments of BJP supporters here. Who has to be blamed for all this mess? After infamous ‘Operation Kamala’ BJP got the clear mandate to rule but their leader is not able to keep the flocks together because of his arrogance.

    After BJP has come to power we have seen such confusion at least 3 times and administration had almost collapsed during the period. If Yedyurappa had leadership qualities then nobody would have dared to rebel against him and no opposition party would have been able to pick his MLAs. It is funny that BJP is celebrating as if they have won the war but sadly this is the shameful day in the history of Karnataka for which BJP is totally responsible.

    Actions of speaker is not worth mentioning as he acted as if he is agent of Yedyurappa. Disqualification of Independent MLAs is laughable and this decision may not stand even in the court. I am not the lawyer but the court may direct the speaker to repeat the floor test to be done in a constitutional way.

    But I do not either support the rebel MLAs or the president’s rule as both are dangerous to the very fabric of the constitution.

Every wrong done by Congress is right for you and every good thing done by other parties is wrong. You were talking about the Speaker has committed a blunder in disqualifying 16 rebel MLAs. I would like to recall the incident happened in 2002 when to save the Vilasrao Government the then Speaker of Congress has disqualified several elected MLAs.     Congratulations to BS Yediyurappa for having won the trust vote. Any party is better than this congress plus JDS combine who are after power and looting the state. They cannot see the other party (BJP) giving a good governance. Added to that , the present governor of Karnataka is also an agent of the congress party who is , instead of upholding the constitution , doing all sorts of partisan activities. His report will surely go against the BJP and , the centre will not like to lose this opportunity of dismissig the BJP Govt. and imposing the president's rule on this pretext.
    The governor should be dismissed or recalled for doing partisan activities and uphold the constitution.

    600 crores investment lost by Congress and JDS. Each MLA cost 30 crores. All the money has gone waste. Now even bigger problem for the rebel MLAs is that the Cong and JDS moneybags are going to swarm to their residence and demand the money back. I feel pity on the Rebels bcos they lost power and also all the money they got for this. They are now with empty pockets with mouth wide open.

    Also all ktka brothers watch out for a surprise release of information by the Lokayukta and the CID regarding two Mammoth scams in LAND AND IRONORE which is going to swallow 27 bigshots in Krntaka. The COngress and JDS was lucky that somehow they smelled the investigation report getting ready and panicked. This entire drama is just to preempt the filling of the report which is "termed as "Mother of all Political Tsunamis" which will swallow a lot of political leaders.

    Actually it feels very bad when a government elected with majority seats is allowed to rule. If the corruption is the reason, it is known fact that all are same. It cannot be a valid reason why a govt should be toppled. If bad administartion is the reason there are people to decide on this. Opposition has to keep raising their voices against bad administartion. Instead of doing that if oppositions keep on trying to topple the elected govt through hook or crook, not allowing them to administer properly naturally people's sympathy goes with the victimized party. When oppostion resorted to hook or crook, ruling party is justified in resorting to the same. If by tomorrow the govt falls because of Govrnr's report to centre through president rule, everybody should know that which way the people's sympathy falls. It will be a blessing in disguise to the ruling party in next election. So my advise to the opposition is please stop the tactics of toopling the govt concentrate on criticising & publishing the govt wrong doing in every fields, if any, and allow people to decide the rest.

    The anguish in our hearts is not reflected on our (common man's) pitiable state but has got a partisan color. All the 80 comments I read, spoke of this party and that party but, Where do Me and You stand in this situation??

    Kick out all these old horses and mules. Bring in educated, trustworthy and God and country loving youngsters to not only rule but to guide and inform us about where our country is heading.

    THIS SO CALLED SPEAKER ACTED LIKE A BJP PUPPET AND MADE A MOCKERY OF TENTH SCHEDULE OF CONSTITUTION. HE HAS VOILATED ALL THE NORMS OF TENTH SCH. UNDER FOLLOWING GROUNDS -
    1) A MINIMUM OF 7 DAYS NOTICE HAS TO SERVED IN EFFECT OF DEQUALIFICATION OF ANY MLA
    2) IT IS APPLIES TO ONLY RULING PARTY MLA'S IF THEY FOUND GONE AGAINST THE WHIP.
    3) YOU CAN'T DISQUALIFY A INDEPENDENT MLA SINCE HE IS NOT BELONG TO ANY PARTY.
    4) THE LETTER FROM REBEL MLA'S TO GUV CLEARLY STATES THAT THEY ARE AGAINST THE CM AND NOT THE PARTY. SO IT CAN'T BE TERMED AS ANTI PARTY ACTIVITIES.
    CONSIDERING ALL THE ABOVE ASPECTS ITS PRETTY CLEAR THAT SPEAKER WAS BIASED AND ACTED AS PER YEDDY'S DIRECTIONS.

    The proceedings of the assembly are illegal. For what reasons the speaker has disqualified 6 indepents? what breach they have committed? They are independent and they can individually support any party they like. Speaker cannot take action nor any party. If they violate any rule of the house in the house the speaker can suspend them for the day or for certain days.Therefore BJP has by illegal way said they have majority. The oppoding 11 MLAs of BJP are managed to be disqualified just before the commencement of the proceedings is illegal. Speaker has acted beyond his powers. He has disgraced the house. The position of strngth should be as on the day of issuing notice.if he has any principle, sense , ethics or belief in God. If not, he is not a man of any reason,a leader. In the circumstances what ex PM H.D. Devegouda once called him is idiot? He knows not what he does for the sake of power and damaging the image of BJP.     Last election BJP won nearly 109 seats far ahead than congress and JDS. This indicates that majority people want BJP to rule Karnataka for next 5 years. If congress or JDS wants to topple the government first they must think of alternate government. Let them make alliance first ask rebel BJP MLA's to resign and win in their symbol. But JDS and Congress acted in unconstitutional manner and now they blame BJP/Speaker. Speaker did right thing by disqualifying rebels. This is the reason why anti defection law implemented in the country. What is the point in disqualifying rebels after the trust vote. The moment these rebels gave press statement holding HDK's hand it is proved that they are deflected. So they deserved to be disqualified. Governers action is cristal clear. We all know why congress/ JDS supporters supporting him. Let anyone argue anything, what BJP did is right. If congress/ JDS want to come power fight election win and take it. who will prevent you?     Goonda rule and tit for tat, One uses police force in Goa and to top it all our CM pulls up a ace by not allowing dissident MLA`s into the Vidhana Soudha as a Soudha has been done by the CM and Katti with their children to sell Vidhana Soudha also. It is ridiculous not to let a elected MLA into the assembly and it should have been a voting by ballot and not by voice vote as we would have known how many more of the BJP MLA`s would have voted against the goverment.God save our state.

    This is another example how the laws can be misused. Speaker in this case has behaved in a partisan manner as an agent of Yedyurappa and brought the shame to the constitutional post. There is lot of debate going on if the anti defection law can be applied on BJP MLAs just on the basis of letter given to the Governor or action should have been taken after they voted against the government. But this speaker took the action not only on them but also on Independent MLAs on whom such law does not apply at all.

    This is the authoritarian show by BJP that it can go to any level to hold on to power. I think now the Governor may act and dismiss the Government on the basis of this foul play.

    But for the people of Karnataka no party seems to be in position to give the good government at the moment. Shame on these politicians!

    The speaker has committed a blunder by disqualifying the MLAs before trust vote. Here Anti-Defection law was abused by the speaker to save Yeddi govt and he acted with partiality. First, he can not disqualify independent MLAs and the second he can not use this law on rebel BJP MLAs before their submission of resignation or before allowing them for trust vote. As such, the action of the speaker is questionable and illegal in the eyes of law. Therefore, the Governor should dismiss this govt and impose president rule.

But Yeddi Along with Reddy's playing good politics. Although these people are not good leaders they are good politicians. Yesterday I saw Janardhan Reddy's statement. From the time I started playing GOLI (marbles) I have not been defeated. I will not do any work which i may think that I will be defeated. Good attitude reddy. TIT for TAT for these despo Congress & JDS. However I am impressed by JDS role in this entire episode & I belive they have better future in Karnataka than the Vote bank Congress. I guess there will be by election soon for the diaqualified seats. Yeddi, if you want BJP to continue strong in the state its time you have to step down and allow Ashok or other popular leaders like Shettar to lead the state. Concequitive winners for BJP should be given place in Cabinet like Haalaadi Shrinivas Shetty, Yogish Bhat etc who have a clean background. Time for some clean up Yeddi, the stains are removed now.
    Anyways at the end of the day, we middle class or poor class have to go to office everyday to earn our bread no matter which corrupt govt comes and sits in our state or country.
