Thota Bengre gang rape - none of Mangaluru advocates ready to defend accused

Mangaluru, Dec 2: All the accused in the recent alleged gang-rape incident of Thota Bengre have been sent to judicial custody as none of the advocates have come forward to defend them.

On Saturday, December 1, all the accused arrested in connection to the case were produced in court.

There were several pleas from students, political leaders and people in general that the lawyer’s association should not fight case in favour of the accused.

It may be recalled, according to a complaint filed by a woman, seven unidentified people allegedly gang raped her at Bengre beach last week. The victim had filed a complaint on November 25, at women’s police station in the city. The woman from Bantwal visited Bengre beach with a youth. A group of seven men approached the couple, thrashed the youth and gang raped the woman.

The police have arrested 7 accused including three minors in connection to the case.

    Let them engage some one from outside and pay through their nose for it. No one can prevent any advocate from representing them but they can voluntarily decline. If there is no advocate to represent them, the state will have to appoint one.

    Super,good news .Fight for the right things but notch a case.whether they have a right to have a lawyer at their side or not,they will feel the heat now.Think next time before you do a crime.(if you comeout with clean chit)Lawyers should not support such a crime.

    If no lawyer takes up their case, they can defend themselves, if they are capable. Else, if they request the court, court appoints a criminal defense lawyer on their behalf. Either way, the law should take its course and these rapists should be punished accordingly.

Further, right to access justice delivery system is also a basic structure of the Constitution of India. Hence, easy availability of quality legal services and the independent performance of function by the chosen advocate without fear or favour and with full dedication is the basic necessity of every society where the Rule of Law is the basic structure of the Constitution”, said senior lawyer A.
