Bengaluru, Nov 16: An advocate, Amruthesh NP, has filed a public interest litigation (PIL) in the state high court, seeking it to direct the state government to ensure that medical services continue to be extended to citizens of the state during the period of doctors strike. Medicos are up in arms against the ammendments proposed to be brought to Karnataka Medical Establishments Act (ESMA).

Health situation in the state is heading for the worse with the doctors preparing for a showdown with the government. On Wednesday, 11 persons including two small children and a BJP leader died, taking the death toll on account of this strike to 25. Towards intensifying the pressure on the government, the doctors have decided to close down outpatient services in over 40,000 hospitals, clinics and nursing homes including 600 in the city, all over the state. Although the state government has cancelled leave of all the doctors and other medical staff, there is risk of the state moving towards a state of medical emergency.

The petitioner has sought restoration of all medical services to patients all over the state with immediate affect. He also has requested the high court to invoke provisions of Essential Services Maintenance Act towards placing blanket ban on the strike by doctors. He has drawn the attention of the high court towards unfortunate deaths of people on account of this stir and compared denial of medical assistance to violation of fundamental rights of citizens. He also wants the high court to take stringent action against doctors organizations supporting the strike and sought declaration of the strike as illegal and unconstitutional, as the doctors have denied medical assistance to needy citizens.

He also has sought holding of effective dialogue between the government and organizations participating in the strike call to end the strike and achieve cooperation between the two.

One more petitioner, D V Adinarayana Shetty from Nelamangala too has approached the high court. He has sought directions to the state government to make immediate arranagements to extend timely medical care to needy people during the period of the doctors stir.

Patients go to a Doctor for treatment only when having faith in treatment. Doctors are not God. Sometimes if the treatment doesn't work out the patient will suffer. You cannot expect 100 percent recovery all the time. Recovery depend on fate of the patient for which a Doctor cannot be blamed. Sometimes when patients don't respond to treatment, Doctors are manhandled which is unfortunate. People need to have gratitude for the selfless service Doctors render. Around us even poor patients prefer private Doctors for the treatment. So one should respect their profession and should not make them to go to this extent.

I kindly and humbly urge the doctors to withdraw their agitation and get to work. Patients are humans, Doctors are also humans. We are all humans.

GO TO NEGOTIATING TABLE AND GET THE WORK NEGOTIABLE AND ACCEPTABLE TO ALL.

I SEE SELFISHNESS IN THE ATTITUDE IN THE STRIKES.

BOTH THE DOCTORS AND THE GOVERNMENT ARE ADAMENT.

I HAVE NOTICED MANY PATIENTS CASES WERE NOT GIVEN COMPENSATIONS FROM THE DOCTORS MEDICAL ASSOCIATION DUE TO THE TREATING DOCTOR HASN'T AGREE TO HIS ERRORS.

I HAVE NOTICED MANY DOCTORS WHO ARE SELFLESS AND SELFISH ALSO.

NOW A DAYS MAJORITY OF THE DOCTORS ARE SELFISH.

GONE ARE THE DAYS PREVIOUSLY A DOCTOR WAS TREATING A PATIENT KINDLY HUMANLY AND WITH DETERMINATION.

NOW A DAYS DOCTORS ARE WANTING TO SQUEEZE AS MUCH AS THEY CAN PLUS THEY ARE HAPPY WITH THE MEDICAL INSURANCE POLICIES.

WE CANNOT CLAIM ENORMOUSLY FROM THE INSURANCE COMPANIES, AFTER ALL, THEY ARE ALSO FOR PROFIT. EVERYBODY WANTS THE PROFIT THEN WHO WILL BEAR THE LOSS......

It is not necessary to call the Army Doctors.

There is a solution through negotiations. GO TO NEGOTIATING TABLE. WITHOUT PAIN THERE IS NO GAIN AND THAT IS THE MAIN.

PRIVATE DOCTORS ARE CROPPING UP LIKE MUSHROOMS IN OUR VICINITIES.

I FIND THERE IS SELFISHNESS GALORE IN THE DOCTORS.

If govt cancelled licences of doctors, even more people will die. Its in the best interest that govt talks with doctors and settle the issue. Doctors are also humans, govt cannot take away the right to protest from them.
Suddu govt like tippu issue has made this also a ego issue, govt thinks going back in a decision is their defeat.

It is a private profession. They have paid fee from their fathers pocket and burned mid night oil to reach this stage. They have invested hard earned money to set up an hospital. Government can regulate reasonably but cannot unilaterally dictate terms and fees. Doctors need not dispose their ancestral property for taking care the health of general public. Bye the bye, what is the duty of government elected by you?

Please read the law what they intend to pass and then comment... for ur better understanding .. let’s take for example .. you are a teacher.. if a student fails ur responsible for that.. u have to explain to the committee, the committee memebers are ( rag picker’s, watchman, sweeper) all illiterates.. if they say u guilty then jail or fine or both... remember no lawyers can represent you..

Agree with above facts but I was more concerned about the dying patience due to this strike. things could have been solved by mutual negotiating on table.. as this uncalled protest resulting into deaths of many innocent patients.

Instead of govt controlling doctors, let them control the medical seat fees first. After spending crores for medical seat, obviously they will be in recovery mood. If the fees is less, more people can afford to become doctors and demand supply gap will reduce and also they will not become greedy. Sadly govt is involved in giving only Bhagyas and they are not worried about education, infrastructure etc.

Doctors are indeed human beings. But who will be ready to invest money and offer subsidized treatment for general public? It is the duty of the Government who is swallowing tax collected from people. Where all this money goes? More over, this is a man made problem created by our elected government. They are not ready to improve the standards of government hospitals. If they are really interested in welfare of people, let the Government nationalize all establishments in healthcare system of the state. Why not similar restrictions imposed for other professionals and why doctors alone is targeted? KPME Bill is the last nail on the coffin of Congress Government in Karnataka. There may be, and there are, black sheeps in medical profession.

The IMA President and other representatives had several meetings with the Health minister and CM.CM agreed to some of the demands but Ramesh Kumar was adamant.Do you thing 50,000 Doctors are fools to go on strike .Doctors begged ,pleaded Health minister not to table the KPME A 2017 .Still he was arrogant ,adamant kept on telling High Command is with me .That is the root cause of all these problems .Doctors are feeling like some one has throttled their neck Can a Doctor work when he feels suffocated ?
Immediate solution would be Health Minister should take back the KPME A bill from assembly

For all of you commenting against doctors..services as OP & emergencies are all open all round the clock in Gov't.Wenlock & Lady Goschen hospitals Mangalore residents..please go there for care.Services aren't shut.Also remember that private shut down now is temporary..if the KPMEA is tabled it.ll be shutdown for good..also nursing staff, support staff, canteen people, security, auto people..everyone is at risk of job loss.It's going to be as disastrous as demonetisation.Yes..cancellation of license is a grand idea too.You can treat yourselves then.Don't throw across loose comments without knowing the provisions of the act.

@sharan mangalore,as you say there is a risk of many loosing jobs,well,when one looses a job ,can be later somewhere achieved ,but a lost life cant be brought back.Dont you think now all doctors have lost a lot of money by their strike,or union is paying it?let alone money,but slowly people too are loosing their patience.How far should this go?Pitiable situation.When this continues for one more week or two,either army,or doctors from other states should be brought to treat patients.Even govt.hospitals are not in a state to treat this situation.Govt must look now strict on their govt managed hospitals and their management.Take strict action on those who violate the rules and dismiss them.

Really, who isn’t greedy in this day and age?
- What about the bus driver who makes an illegal stop on the highway to pickup those two extra passengers from Udupi to Mangalore to earn that extra 100 rupees;
- What about the small restaurant operator in Bajai who increased the menu prices for GST though he is not even registered for GST !!
- What about the schools in our region who increased fees in the name of student safety after the deadly accident in Kundapur, but made no changes on the ground;
What about YOU and I who wouldn’t think twice before claiming tax deduction (like depreciation, petrol, maintenance, etc) on motor vehicle registered in business name but used for personal family use in reality.

The whole system is rotten. A medical seat costs fortune and once graduated they get into recovery mode.

The government hospitals are in worst state and the state wants to convert private hospitals to work like government.

I recollect getting an MRI done in 1996, when the whole of Coastal Karnataka had no MRI machines. A private doctor in Calicut had one, Not even KMC... So everyone is doing their bit.

Why should we call a Doctor commercial minded, aren't we like them ??

Hope this state government has constituted judicial panel in forming amendments. There should be a national policy across all states.

Enough of politics!!!

Somehow, everyone is expecting that the doctors should sacrifice all their earnings and serve the poor and the needy. Sounds good in theory, but devoid of any commercial reality of this day & age.

I would turn around and reverse the question of sacrifice – why shouldn’t everyone working in the state pay an extra 500-1,000 rupees tax to the state government so that Government hospital infrastructure could be improved and also those hospitals could invite expert guest physicians to serve the patients.

Not even a single person in this forum is prepared to give up the slightest of the comforts of their daily life; but expect that the doctors should behave like Daanaveera Karna. This is the very definition of hypocrisy.

Doctors are in trouble. Sickness comes sudden unexpected time. Doctors now days are businessman.
Everywhere they want to make money.

Govt is in right line. Govt has to take steps to treat patients in this emergency condition.

Doctors has to save patients. Whatever may be the condition.

If they are right they need not worry about govt. rules and regulations.

Everyone is prepared to give a lecture on ethics and morality as long as they are not the one to make the sacrifice.
Providing a decent and affordable healthcare facility is the duty of a state government under the Indian constitution. And without any shadow of doubt every common man in this country will agree that literally every state government has failed miserably in this aspect (of course there are few notable exceptions and also the degree of this failure varies greatly from state to state; and various regions within a state).
A private medical clinic / nursing home / hospital are all a “private enterprise” of the concerned doctors. By fixing the prices for services within these facilities, the Government is effectively asking these doctors to subsidise the medical costs of fellow private citizens because the state has failed in its obligations. Why would you expect only the doctors to subsidise the healthcare budget of the state government? Shouldn’t every resident of Karnataka bear this burden of subsidy through higher taxes?
Would you be willing to pay an extra tax of say Rs. 25,000 every year so that the state Government could build few AIIMS quality hospitals in Karnataka? Are you prepared to make this sacrifice?
Also, just like medical profession, there are other professions too like lawyers and CAs who play a key role in applying the law and tax collections in our country. Will the state government be regulating the prices of these services too?
PS – I am not a doctor; and not one in my near and distant circle has any relationship with the medical profession (other than as a patient).
