Enough evidence to prove my case, says Vijay Mallya outside UK court


London, Jun 13 (PTI): Embattled Indian tycoon Vijay Mallya, who is wanted in India on loan defaults to several banks, today claimed that he has "enough evidence" to plead his case as he appeared before Westminster Magistrates' Court here for his extradition case hearing.

The 61-year-old former chief of erstwhile Kingfisher Airlines, who has been out on bail since his arrest in April, arrived for the hearing in Court Room 3 after a number of other extradition cases on schedule for the day.

"I have not alluded any court...I have enough evidence to prove my case," Mallya told reporters outside the court. Chief Magistrate Emma Louise Arbuthnot will preside over what is referred to as a "case management hearing", when a final hearing date is expected to be set.

Britain’s Crown Prosecution Service (CPS) will present the case in court on behalf of the Indian authorities. Mallya's defence team is being led by the firm Joseph Hague Aaronson LLP. They have instructed barrister Clare Montgomery, a specialist in criminal, regulatory and fraud law,to argue in court on their behalf.

The CPS have instructedMark Summers to act as a barrister for the CPS Extradition Unit and the Government of India. Summers is a leading expert in extradition and international law matters.

"There might be a few more hearings in this case in the coming months to deal with case management or any issues that arise, before the final hearing takes place, at which the full arguments from both sides in this case will be heard by the Judge,”explainedJasvinder Nakhwal, partner at Peters and Peters Solicitors LLP and member of the UK's Extradition Lawyers Association.

The CPS had met a joint team of Central Bureau of Investigation (CBI) and Enforcement Directorate (ED) officials in London last month to thrash out details of the case. "Our aim is to build a strong, infallible case and these meetings will help resolve issues across the table. The CPS will be arguing based on documents provided by CBI and ED, therefore a joint team is here to address queries they may have," official sources had said after the meeting held in early May.

A CBI official has also flown in from Delhi for the hearing today. Last week, Mallya was welcomed with chants of "chor, chor" by Indian cricket fans as he arrived to watch the India vs South Africa Champions Trophy match at The Oval cricket ground in London.

Earlier, he had caused a stir by his attendance of the India vs Pakistan match in Birmingham after which he had declared on Twitter that he would be attending all India matches in the ongoing ICC Champions Trophy.

Mallya, who is wanted in India for Kingfisher Airlines' default on loans worth nearly Rs 9,000 crores, has been in the UK since March 2016 and was arrested by Scotland Yard on an extradition warrant on April 18.

He had attended a central London police station for his arrest and was released on conditional bail a few hours later after providing a bail bond worth 650,000 pounds, assuring the court of abiding by all conditions associated with extradition proceedings, such as the surrender of his passport and a ban on him possessing any travel documents.

An initial case management hearing date of May 17 had been postponed to June 13. If the District Judge rules in favour of extradition at the end of the trial, the UK home secretary must order Mallya’s extradition within two months of the appropriate day. However, the case can go through a series of appeals before arriving at a conclusion.

India and the UK have an Extradition Treaty, signed in 1992, but so far only one extradition has taken place under the arrangement – Samirbhai Vinubhai Patel, who was sent back to India last October to face trial in connection with his involvement in the post-Godhra riots of 2002.

However, unlike Mallya, he had submitted to the extradition order without legal challenge.

    First take action on banks who gave him huge loans without proper guarantee. Atleast send some culprit managers behind bars for wrong doings. Then we can say this case is going in right direction. Otherwise this case will go nowhere and Mallya will be enjoying his scotch on the rocks at Westminster.

    Really shameful that the government wants him extradited but are not able to provide proof to the UK courts even after 6 months. We have to understand that the UK has a very good legal system and is not a banana republic where you can buy people to do your bidding. The whole episode is a farce which is being done to gain political mileage and that is backfiring slowly. Mallya has said time and again that he has not diverted funds illegally and that he is willing to pay back the banks, but our political parties, our government, our courts, our misinformed public and our media are more interested in hounding him, humiliating him rather than getting the money back. Allegations are made about him but no proof is provided. It is the same story of creating false perceptions like the so called 2G and coal scams when in reality there seem to be no scams at all. Repeat a lie a million times and it gets perceived as the truth. Mallya is not a crook, he is just a businessman who failed in one of his ambitious ventures. The only thing that I disapprove of him is his not paying his staff and yet having lavish parties after that. Had he paid them, he would have generated a lot of goodwill. That is one blunder which must be haunting him today.

England has well known working Legal system and let Indian Government and people ask England to handle Vijay Mallya case in England by English couts. Let British and Indian educated Lawers handle this case in London.

    Before harping on Mallya,let the perpetrators of mega scams like 2 G,Adarsh,common wealth games,coal scam etc., under go legal process to ascertain how damage they have caused to the nation.Also let RBI take up issue of loans of big business tycoons written off during last ten years.Let Bank chairmen of those banks stand in line to face enquiry how the process of loan sanction and write-off went off putting mud to poor banking community.Simply pointing fingers at Mallya is meaningless unless whole procedure writting off is undergoes scrutinity.One should not forget how much Mallya given to the nation since years by way of indl output,giving employment to to lakhs directly and indirectly.

These things are ongoing events in business but the fact that he left the country through back door deal with politicians and himself being a politician says a lot about the way he was doing his business.     He can stay outside country as long he wish but not against rules of that country.Why his pp impounded...?Before contemplating action against him others whose loans become bad should be enquired.No pick and choose policy here....however banks are empowered tu I proceed against him even without exhausting available avenues.Before that issues of banks role in sanctioning,securitization,followup lapses etc come .Why bank has not acted timely and at whose behest.?He should be listened before enacting law or initiating punitive action.Putting him behind bars will not happen as many wishes as there is no rule duc. In banking.If it happens many ministers,big politicians,bank executives too will follow suit.

    Who is the present govt it is the BJP. When BJP has CBI, ED, IT etc why can't they raid and recover the money from the corrupted people. BJP and Modi gave so big big speeches about Robert Vadra, what happened, all empty promises. In fact RV and Adani have close business connections. So let us not talk of 2G, 3G, Coal scams etc. BJP has nothing to do but only false and fake statements. Both Congress and BJP are two sides of the same coin and they will scratch each other balls and will continue their work since 3 or 4 decades and the people of India will get jacked.     Who will see better leader...is there better leader than present one...is there any other clean non corrupt leader....all these things will haunt for long time.Yest,there are reservations about Modiji for taking corrupts right and left and also not intimating quick action on already spelt cases including Vadhra land deal....many times felt that whether there is any tacit understanding between these two parties and making us fools till next election...?Small defaulter Mallya is only being chased and big bandicoots left Scott free or ignored because of vested interests of politicians,corrupt bankers and allied forces .

    What about the huge loans taken by other Corporate houses which are far greater than the reported default of 9000 crores by Mallya. What about the reported news about banks extending loans without counter gaurantees.

    It is very interesting that once he runs away from Indian law, he uses the British Law to say that he has enough evidence to prove his case and innocence. He knows that Indian courts are like Banana republic and he has no faith in it that is why he ran away. A Rs. 9,000 crores absconder will walk away freely under British law because Indian CBI or ED or IT can prove nothing because if they do, VM will spill the beans of Political donations.

    Firstly catch hold of Bank authorities and Bank Managers and higher ups for granting so much loans amounting crores of rupees taking commission/bribe from Mallya. they are solely responsible and they are the main culprits for this lapse.
