Bengaluru: Govt seeks HC permission to file report in Jarkiholi sleaze CD

Bengaluru, Sep 4: The state government, on Friday September 3, approached the state high court (HC), seeking permission to file the final report prepared by the special investigation team that was entrusted with the investigation relating to Ramesh Jarkiholi sleaze CD case.

A public interest litigation seeking to entrust the CD case to the Central Bureau of Investigation and that the investigation should be held under the HC supervision, had been placed before the division bench of the HC presided over by acting Chief Justice S C Sharma.

Advocate general, Prabhulinga Navadagi, arguing on behalf of the government, said that the HC had restrained the team from submitting investigation report to the concerned court. "The progress report of the investigation had been submitted to the high court by the special investigation team from time to time. Even the final report was submitted in a closed envelope. The court has already scrutinized these things. Therefore, permission should be given to the investigation team to submit the report to the trial court, he argued.

Advocate representing the aggrieved lady said that senior Supreme Court advocate, Indira Jaisingh, will appear on her behalf and argue the case. As she is suffering from fever, the hearing should be postponed by a week, he requested.

C V Nagesh appearing for Jarkiholi said that the petitioner has sought transfer of the investigation to the Central Bureau of Investigation. He pointed out that the petitioner is neither the complainant nor a witness nor an accused in the case. He has no connection with the case. He urged the court to decide the admissibility of the petition soon as the high court had issued interim order barring submission of the final report to the trial court.

The bench adjourned hearing to September 14, and also extended the interim order issued earlier.
