Muslim Law Board moves SC challenging criminalisation of instant triple talaq

New Delhi, Oct 21: Challenging the criminalisation of Instant Triple Talaq, the All India Muslim Personal Law Board (AIMPLB) on Monday moved the Supreme Court.

Earlier, in August, when Rajya Sabha passed the bill, AIMLB convenor Zafaryab Jilani had said that the triple talaq bill will be challenged in the apex court since the AIMPB legal committee had considered it and deemed it fit to be challenged in court.

Divorcing through instant triple talaq was declared illegal Under the Muslim Women (Protection of Rights on Marriage) Law 2019 and would attracts a jail term of three years for the husband if found guilty after the government passed a law to this effect in August.

The government had said the bill was passed for providing gender equality and justice to Muslim women who were being divorced by 'talaq-e-biddat'. The government has also promulgated three ordinances to criminalise instant triple talaq before the law was passed

    Even if there is a law it is undemocratic and unlawful if a chance is not given to the accused to speak in defence. Straightaway criminalizing is dictatorship and one sided.
