SC sends Hadiya to Salem in TN to pursue her studies


New Delhi, Nov 27 (PTI): The Supreme Court today spoke to a Kerala woman in the alleged love-jihad case and sent her to Salem in Tamil Nadu to enable her pursue homoeopathic studies.

A bench headed by Chief Justice Dipak Misra directed the Kerala police to provide Hadiya with security and ensure that she travelled to Salem at the earliest.

The apex court appointed the dean of the Salem-based homoeopathic college as Hadiya's guardian and granted him liberty to approach it in case of any problem. Hadiya has been staying at her parental home for several weeks.

The bench, also comprising Justices A M Khanwilkar and D Y Chandrachud, directed the college and the university to re-admit Hadiya and grant her hostel facilities.

During the hearing which went for over-two hours, the woman said she wanted to go with her husband Shafin Jahan.

The top court fixed the hearing on Jahan's plea against Kerala HC order annulling his marriage with Hadiya to third week of January next year.

Jahan had on September 20 approached the apex court seeking recall of its order directing the NIA to investigate the controversial case of conversion and marriage of a Hindu woman with him.

The Kerala High Court had annulled the marriage terming it as an instance of 'love jihad', following which he had approached the apex court.

The top court had on August 16 directed the NIA to probe the incident under the supervision of retired apex court judge, Justice R V Raveendran.

Jahan, who had married a Hindu woman in last December, had moved the apex court after the Kerala High Court annulled his marriage, saying it was an insult to the independence of women in the country.

The woman, a Hindu, had converted to Islam and later married Jahan. It was alleged that the woman was recruited by Islamic State's mission in Syria and Jahan was only a stooge.

Ashokan K M, the father of the woman, had alleged that there was a "well-oiled systematic mechanism" for conversion and Islamic radicalisation.


The high court, while declaring the marriage as "null and void", had described the case as an instance of 'love jihad' and ordered the state police to conduct probe into such cases.

    As per SC’s judgment she seems to be intimidated or under threat or pressure from either side. That’s why they have set another date for hearing husband's plea. Hope she will be bold enough to express herself once she continues and completes her studies as directed by the court.

Imagine how a govt agency can use the word of hypnotism in court to defend hadiyas parents illegal claim. Supreme court must not pass any balenced judgement here rather it validate the marriage of hadiya and shafin jahan which their fundamental right.     The supreme court has taken her out from parents house and made her to continue study. The main problem is the Kerala High Court had annulled the marriage terming it as an instance of 'love jihad', following which her husband had approached the apex court.     Her husband is allowed to meet her in the college as per some papers. The girl seems to intelligent and brave and once the NIA declares the "love jihad" angle is not there, definitely, they will be together as good couple. But, they may have to live outside her parent's place, otherwise, they may not be allowed to live in peace

    When the lady is saying she was not forced, she accepted Islam with her own will and wants to live with her husband and be as a family then how come Supreme Court didn't grant her permission to do so along with pursuing her studies? Is she not of matured age to take her own decision?

    I really feel suspicious on this judgement of Supreme Court,...If the judges are sanghi mindset then definitely what they expected turned hollow when Hadiya said that she wants to be with her husband, so instead of sending her to husband's place then sent her to college. What Rubbish

    Anyway, jab Miya-Biwi Raazi to kya karega Kazi. If not today then Insha Allah some times later she will definitely be with her husband and start a happy family too as she is matured and none can stop her not even the constitution.

    After the hearing, it sounds like Hadiya has been sent to limbo for two months so far as her marriage to the mussulman is concerned; no mention of the so-called "husband".
