Mangalore: Buildings Regularizing Schemes on Dec 11

Mangalore, Dec 11: Interim provisional orders would be passed by the Karnataka High Court with regard to the appeals made by the city residents and the residents of Bangalore, who have filed Public Interest Litigation (PIL) petitions challenging the 'Sakrama' scheme evolved by the State Government for regularizing buildings, which have violated norms and made illegal use of land, stated the Karnataka High Court in Bangalore on Monday December 10.
An appeal by the federation of JP Nagar 6th and 7th Phase Residents’ associations was admitted by the Court, who then ordered issuance of notices to the State Bruhat Bangalore Mahanagara Palike (BBMP) and other respondents.
A division bench made-up of the chief justice Cyriac Joseph and justice Ashok B Hinchigeri was investigating appeals by the federation and residents association of the city. While the Bangalore residents’ association requested the court to reduce the quantum of punishment and extend the deadline for those who wish to opt for the scheme, the residents of Mangalore city on the other hand urged the Court to come to the rescue of the honest citizens and nullify the proposed scheme.
A N Jayaram, senior counsel and former advocate-general appeared before the Court on behalf of the federation of JP Nagar residents association. According to him, he represented over 1.6 lac people. Hence urged that the deadline for the same should be extended, as the time allotted for Bangalore residents to accept the scheme was short.
M R Naik, another senior counsel, who represented the residents of Mangalore city, averred that the said scheme would be beneficial only to the rich and those who have flouted the law with impunity, and it would not help the common man too, he added. The Bench on its part said that this being one of the rare cases when all the parties viz., the State, BBMP and even the petitioners wanted an interim order, decided to admit the petition and ordered issuance of notices. The Bench then posted the case for Tuesday December 11.
