Prez refuses assent to Delhi govt bill on Par Secy issue


New Delhi, Jun 13 (PTI) : In a jolt to Delhi's ruling AAP government, President Pranab Mukherjee has refused to give assent to a legislation that protects 21 party MLAs, who have been appointed Parliamentary Secretaries, and face the prospect of disqualification.

Petitions have been filed with the President seeking disqualification of these MLAs on the ground that they occupied office of profit violating constitutional provisions.

Acting as a quasi judicial body, the Election Commission to whom the President referred the issue, had sought replies of the MLAs. The Delhi Government had sought an amendment to the Delhi Members of Legislative Assembly (Removal of Disqualification) Act, 1997.

Through the Bill, the AAP government wanted "retrospective" exemption for the parliamentary secretaries from disqualification provisions. The Bill was forwarded by Lt Governor Najeeb Jung to the Centre, which in turn was sent to the President with its comments.

After examining the issue, the President has not given his assent to the Bill, official sources said today. On March 13, 2015, Kejriwal had passed an order appointing the 21 party MLAs as Parliamentary Secretaries.

    This joker (AK) is good for nothing character. I am yet to see him contribute anything towards the well being of the people of Delhi. Instead he is now focusing on getting Punjab. He is only good at finding fault with others. The bunch of crooks around him in AAP are busy doing the same and boosting his ego. I wonder how people of Delhi can bear him for so long. Please allot him a pemanent space in Ramlila Maidan where he and his crooks can sit the whole day and keep finding fault with every public figure.

    Next thing Kejriwal would do that…. start blaming NaMo and BJP for this issue too. People overwhelmly voted AAP to serve the Delhi people….but this party does everything except serving the people at Delhi at least!!!!

    Good people, saints, serving for the weaker section, in pursuit of righteousness do have untold problems.
    Acche Din ka vaada karenge, lekin Acche din kabhi nahee aane denge!
    Hell bent on pushing AAP backward for giving good governance in Delhi.

    I do believe that the AAP Government means well. It has left no stone unturned in providing good governance to the people.

    It is the MLAs that are answerable to people. Not an appointed public servant. This gives the appointed public servant a free hand to be denying good service to the public for which he/she was hired.

    So obviously the AAP Government wants committed people to drive the various public service departments. Hence it wants to appoint the MLAs as Parliamentary Secretaries.

    But here in lies the dilemma. India's governance separates the MLAs(non-salaried "board" roles) from the appointed/hired 9am-5pm public servants who are paid salaries.

    MLAs are the 'board' positions and not full-time 9am-5pm jobs. The MLAs cannot draw a salary like the appointed/hired 9am-5pm public servants.

    So as much as the AAP wants to do its best, the hands of the elected representatives are tied.

    This is precisely the reason why Congress and BJP have not been able to transform India as Indians hoped. So blaming an elected Government does not really help!

    The only reason of the law is to weaken the Delhi government.After losing the Delhi,PM Modi BJP is hell bent projecting Mr.Kejriwal Delhi as a failure.The governor power is being misused repeatedly state with minimum power.

    Mr.Prez who has signed Maharashtra beef ban without thinking religious freedom and constitutional rights has lead more starvation and farmers suicide.

    Do you know what is called office of profit.. If not read the Supreme Court judgement on jaya Bacchan or read high court judgement on office of profit when mamtha banerjee did same foolishness like kujliwal... Without knowing abcd of the issue you and kujliwal know one thing blame modi..
