Kerala business tycoon found guilty of murdering guard with Hummer


Thrissur, Jan 20 (PTI): A Kerala court today convicted beedi tycoon Mohammed Nisham, who had crushed to death a security guard with his luxury vehicle Hummer over delay in opening the gates of a posh residential complex here on January 29 last year.

The quantum of punishment would be pronounced here tomorrow by the Additional Sessions Court which found Nisham guilty under various sections of IPC including 302 (murder), 326 (voluntarily causing hurt by dangerous weapons, 427 (committing mischief).

The prosecution today argued for maximum punishment of death sentence and a compensation of Rs 5 crore to the family of the 51-year-old security guard Chandrabose.

Public Prosecutor C P Udayabhanu submitted that the "society wanted the maximum punishment meted out to the accused, who was a threat to the society".

Police charge sheet had contained scientific evidence and other documents to prove the charges, including murder, against Nisham.

Though Nisham's wife Amal was a witness to the incident, she had later turned hostile.

Statements of 12 eyewitnesses, including that of Amal, had been been recorded under section 164 of the Code of Criminal Procedure.

Besides, statements of over 100 witnesses had also been recorded and attached with the charge sheet.

Nisham, who was in an inebriated state, had allegedly in a fit of rage assaulted Chandrabose and later rammed his luxury vehicle into him over delay in opening the gate of his residential complex here on January 29 last year.

The guard succumbed to injuries on February 16.

The case had evoked widespread protests across the state.

    Absolutely no mercy should be shown to this nut. The honourable Court should pronounce the maximum punishment for killing a poor guard who was working away from his family to support them. This will surely set a precedent that rich can do any thing and can get away with it.

    Horrible.He is not the first Person and will not be the last who has the power and Money to use it on the poor and not in a state to fight for the rights ,to eithr kill them or Harass.I personally know in my childhood one who did it on a fellow from backward caste,who later got krupple and died.I cant Forget it till today.such Persons dont have mercy,feelings .only power,money,alcohol and what not.They require hard punishment and should pay a high amount of compensation to the victims Family that should really make him to realize what he had done.

    People with money and power think that they can do anything. Killing someone is even bad and not acceptable, he should be punished to the maximum. A death sentence to the accused would be the best since no one else in future would try to kill their employees. The family should be compensated very well, so that they can live a lavish life like the accused.

    I see from both the sides. first think no use hanging him and taking his life. Second thing, the victim's family should also be supported meanwhile. So, I appreciate, since he is a billionaire , compensation of 3 / 5 Crores can be given to the victim's family. Regarding this killing man, let him be in the jail for life time for the mistake he has done, which was not a mistake, it was a crime.
