Rajya Sabha passes Juvenile Justice bill


New Delhi, Dec 22 (IANS): Parliament on Tuesday passed the juvenile justice bill, a day after members cutting across party lines agreed that the important legislation should be taken up immediately.

However, members of Left parties walked out of the Rajya Sabha before the bill was passed, demanding that it should be sent to a select committee of the house.

The Juvenile Justice (Care and Protection of Children) Bill, 2015 was passed by the Lok Sabha in May.

Asha Devi and Badrinath, parents of the 23-year-old paramedical student who was gang-raped by five men and a juvenile on a moving bus in Delhi on December 16, 2012, were present in the visitors' gallery as the Rajya Sabha took up the bill for discussion.

The bill provides for the trial of those between 16 and 18 years of age as adults for heinous offences. Also, anyone between the age of 16 and 18 who commits a less serious offence may be tried as an adult if he is apprehended after he attains the age of 21.

Giving out the bill's details, Women and Child Development Minister Maneka Gandhi said borstals -- a custodial institution for young offenders -- would be set up under the proposed law to house juveniles accused of heinous crimes.

Maneka Gandhi said juvenile crime was being encouraged by the existing law.

"Juveniles' involvement in crime is increasing the fastest. Children walk into police stations and say we have murdered... send us to a juvenile home," she said.

Leader of Opposition in the Rajya Sabha Ghulam Nabi Azad said juvenile convicts should not be kept in jail with "hardened criminals" and there should be a separate place for them.

Parliamentary Affairs Minister M. Venkaiah Naidu, meanwhile, said the government had listed the bill several times in the monsoon session as well as the winter session but it could not be taken up.

"This law will not be applicable in retrospective," he said, which means it will not be applicable on the rape convict who has already been freed.

Members from the Nationalist Congress Party (NCP) and DMK also questioned the hurry in passing the bill, suggesting that it may be sent to a select committee.

However, none of the notices to send the bill to a house panel were presented to Deputy Chairman P.J. Kurien.

Communist Party of India-Marxist leader Sitaram Yechury called it an emotional move.

"If tomorrow, a 15-year 11-month-old commits a crime, will you change the definition again? Today, ISIS is recruiting 14-15 year olds. Are we going to reduce the age from 18 to 16 to 14?" he asked.

"The culprit who has committed the horrendous crime, you cannot punish him. That sentiment of punishing him is there. These are matters that merit a certain consideration. Refer it to a select committee," he said.

Kurien, however, said there was no proposal to send the bill to a panel, after which members of the Left parties staged a walkout.

The bill was passed through voice vote after that.

The mother of the victim, who met Minister of State for Parliamentary Affairs Mukhtar Abbas Naqvi on Tuesday morning, said had the bill been passed earlier, the juvenile convict would not have walked free.

"He (juvenile convict) would not have been released if this bill had been passed six months ago. Though it has been delayed, we want this bill to be passed in parliament at the earliest," Asha Devi told reporters.

The juvenile, who was under 18 years of age when he was held with five other men for the brutal rape and murder, was tried under the Juvenile Justice Act. He was put in a remand home for three years, the maximum permissible under the legal provisions.

He was released from the correctional home on Sunday after completing his sentence, amid protests by the parents of the victim and others in the national capital.

    I still feel the Bill passed may not give full safety to the juvenile,untill the punishment is fixed based on the gravity of the crime committed and not the age.

    After so much of public pressure these MP's passed the bill.8 month back LS passed this bill but due to political reasons of sickular parties it was pending . Next for all bills to be passed public pressure is needed.For congress people their one family is important than country. For one family these people stalled two Parliament sessions.I hope and believe people will teach a correct lesson to congress as people's tight slap to SRK.Media and social media are so powerful that people get the msg easily and congress not get away easily for thier deeds.

    Well.. Well... Now that the amendments are in place and the age is reduced by 2 years, can we expect less rapes in the country ? Believe me - a big 'NO' ! Because, all these rapes are not carried out by the minors alone - it could be just 20% of them. Then, what about the rest 80% ? Didn't the offenders fear the law ? I say - they did not think about the law at-all, while carrying out the heinous crime ! All that mattered to them is getting relieved of their lust ! They had no inkling of any consequence ! There may have been regret afterwards but that does not bring back a life in the woman whom trampled a while ago ! Period !

    A sigh of relief is that those who were considered minors by two years so far will hereafter come within the bracket of stringent punishment !

    Where are we now ? Not a step ahead than square one ! Because those who offend in future will continue to offend, with or without the age limit reduced ! Therefore, what stands in front of
    us is creating public awareness !

    Awareness that 'forcing a female, young or grown-up, into sexual act is a crime' ! Conducting sexual activity without the agreement of the other member is called a RAPE and its punishable by law ! Well, don't repair the damages by offering to marry her - whom, you would never have married otherwise - you would have considered yourself a price and would have gone looking for a princess otherwise !

    Until we put forward this message loud and clear and drill it hard down the brains of all illiterate thugs, India is going to suffer - our children/wife/mother is going to suffer !

    In this message, I pain for those men who refrain from such offences, who give a hand to help a woman in distress irrespective of the fact whether she is related to you or not. I salute you all men out there because if all of you too had done similar acts, I would not have been here, robust in mind, to write this message !

    1. Rajeev Gandhi Govt., had set the age to 16years. It was BJP Govt., in 2000 changed it to 18years. If nirbaya juvenile rapist walking free today, it is all because of BJP. Shame.
    2. Current bill, still allows the juvenile board to say the young criminal could be tried as Adult or not. This clause will be used and mis-used by police and the board for sure. If a rich kid gets involved he will be treated as Juvenile irrespective how heinous is the crime and a poor boy, will automatically qualify as adult.
    3. There are no jobs for millions of youth. If one gets involved in a crime - he has better solutions for future. Govt. will fund his education and rehabilitation.

    These 3 are serious concerns.

    Again our MP's proved that, they don't have brain. Now Juvenile age limit reduced to 16 in cases of rapes and murder. But what if in future a boy of 15 year 11 months commits rape and murder ??. Every time they make laws with some loopholes. Better to add a proviso which empower Supreme Courts judges to make decision case by case.

    Well done and looks like some sense prevailed among the administrators. Get few culprits under this law and punish them for their crime which will send some positive signals to those who plan such crimes or think about committing such crime.

    when i read your comments it feels that u never read news about this bill before.
    BJP have majority in Lokasabha and passed the bill almost 8 month ago. and it was in corner of Rajya Sabha.

    Just read some old news paper from December 1st onwards. Many congress man itself agreed they stalled Rajyasabha including your pappu Gandhi. so u will come to know who was in deep sleep.

    Exactly ! Arrest him and try him all over again. There is no need for any new witness and proof - all is available from the original case ! Let him find a lawyer who is capable of defending him till he wins !

    The entire nation should unite and demand this justice to Nirbhaya !

    Your hats off can be interpreted like below:
    Hats Off to congress for delaying the bill so that the victim didn't get justice and rapist freed from Jail.
    Hats off to AAP for defending the culprit and providing sewing machine and Rs. 10,000/- for the rapist to do more crimes.

    In my opinion, If this law would have been passed before the court proceedings, at least the rapist would have got punishment.

    BJP govt passed this bill after heavy pressure from the Opposition parties, Nirbhaya parents and other citizens. Any way fine and welcome. Still this bill is useless, they cannot punish Nirbhaya juvenile rapist. I want to see how the Modi govt will give the justice to Nirbhaya parents.
