Dec 16 gang-rape: SC dismisses plea against release of juvenile convict


New Delhi, Dec 21 (PTI/Agencies): The Supreme Court on Monday dismissed the plea to stay the release of the 20-year-old who was convicted for the December 16, 2012 gang rape and was released from a remand home on Sunday.

The apex court in its judgement said to DCW: 'We share your concern but under existing law, detention cannot go beyond 3 years'.

The Delhi Commission for Women, Swati Maliwal, had approached the Supreme Court to stay release of the juvenile convict, who is now 20 years old and was known to be the most brutal of the attackers.

"How many more Nirbhayas will we create before we change the system. Nirbhayas rapist should not be released under any circumstances today," Maliwal tweeted.

"SC accepted petition. Matter was listed on Monday as Item No 3. Case subjudice now. Nirbhaya rapist should not be released until case heard," Maliwal said in another tweet.

A vacation bench comprising Justices A K Goel and U U Lalit in their order pronounced at 2 AM on Sunday, posted the matter for hearing on Monday.

The Special Leave Petition filed by DCW against the order of the Delhi High Court, which refused to restrain the release of the convict, was referred by the Chief Justice of India T S Thakur before the vacation bench.

After the order by the court, DCW chairperson and the lawyers of the women's panel hoped that since the matter has become sub judice, the government and Delhi Police will not release the juvenile offender today as scheduled.

The juvenile was moved out of Delhi on Saturday even as distraught parents of the victim strongly kept on opposing his release. The parents were briefly detained by the police after they held a protest against the convict's release.

Sources said that the convict was taken to an undisclosed location from a correction home in North Delhi amid concerns that there was threat to his life.

They said the juvenile has been kept under observation of an NGO under protection of Delhi Police.

    Our Law system has lots of Loop holes. It says even if 100 criminals escape one innocent should not be punished. Through loop holes in the system Criminals slip out with the help of Criminal lawyers who are well versed with these defects. Only Reforms and amendments can rectify this. But for this we need approval from parliament. And it is well known that such bills will not be approved and passed unanimously

    Some commentators are saying that previous NDA govt disrupted the parliament. Thats why it is fair to disrupt now too. Shame on you guys...Its just like one child is saying that my friend failed so I am.
    If someone committed the mistake it doesn't mean that we have to do the same. At last we (public) are the losers.

    Modi Govt can bring ordinances after ordinances on land bill to help friends like Adani. But, will not dare to do the same in these kind of cases. This shows the Modi govt's sensitivity and competence. The entire saga in SC was a drama. Everyone knew what SC going to say not today, but since many years. We have a minister of broadcasting as PM and Minister of corruption as FM and RSS strongly backing them in need and deed. Shame.

    Its not a welcome news. But SC rightly rejected the plea because current law should be followed. And even if Juvenile Justice act get amended it will be applicable only to future cases. So here only way left to Jyothi's mom to get justice is to kill the culprit. She can take help from her son or any relative who is below 18 years age. I may sound wrong here, but sometime we have to do. 'Mullannu Mullinindale Thegi Beku'.

    Of late many contradictory and unfair judjements are being given. Had it been a scenario where a doctor and patient were involved,the doctor would have been thrashed by the public but this is not seen in any other profession where the general public feels let down.
    There are instances where the lawyers collect their charges before going to the court and if they cant win the case for their client it is his problem. Such is the face of legal system and judiciary in this country.

When the people protested against his release, Delhi Police detained rape victim's parents, what a shame. BJP is very much interested to pass the GST Bill but they never talk about Juvenile Act Bill. Now where is the justice for the victim under Modi Govt???
    If Modi & Kejriwal having any sympathy towards the victim, just release this juvenile rapist's photo to the media.

    @ Alphonse, yes it happened during the Congress rule and Sheila Dixit Govt nabbed the culprits within two days. Also Congrss Govt successfully proved their guilty in the court and court rewarded the culprits with death penalty except this so called juvenile. There after Modi Govt came to power and two sessions of the Parliament ran successfully. Why this bill was not passed then??? That time Modi was interested only with Land ordinance bill to grab the poor farmer's land for Ambani & Adani. Kejriwal came to power 9 months before and he never talked about this Juvenile Act bill. For Modi and Kejriwal's failure, don't blame Parliament disruption. Running the Parliament and pass the legislation in ruling party & Govt's responsibility, not opposition parties.

If NDA is so willing then why cant this GOVT pass an ordinance on this issue and close the matter for once? By wasting time in NHC issue and raiding CM office in Delhi this government is giving ample reason for the opposition to adjourn the session and now this Jaitley issue will completely wash this Winter session without any productive things been done.     Do you think peoples memory is short? Do you remember how many times the NDA Govt. headed by BJP disrupted parliament proceedings during the UPA Rule? The Parliament was not allowed to function by the so called opposition party headed by BJP. So do not fool around without your comments. The Indian public are wise enough. Present NDA Govt is following what the previous UPA 2 govt,s economic policies. One instance was GST and other important Reforms Bills which were during UPA 2 rule headed by Mr Manmohan Singh. Now the present NDA members shouting from top of their voice attacking Congress and other Opposition members. Remember every dog has its own day. You reap what you sow.
    Be practical.

    Well media giving the publicity that Juveniles get lenient punishment for worst crimes , so every minor now knows laws r on their side . Juvenile crimes will increase specially murder , dacoity etc. Even 12 year old boy or girl is equivalent to adult now a days , they know lots of things and no way children . Also there is fear that Terrorists can use children or anyone less than 18 as their subordinate because laws are loose . India needs better realistic laws . I feel make laws completely gender neutral and Bring down age of criminal responsibility , age of majority , age of consent and marriage to at least 12 as in most countries #GenderNeutrality

    And this entire episode unraveled dual nature of feminists and divided opinions . There were statements like " a lone nirbaya case cannot determine the fate of all juveniles in India " . So now what about biased amendment passed in hurry 2013 just looking at the nirbaya case !? . If child's rights can b voiced , why not adult men's rights also can b heard !?. Its after biased amendment that false cases shoot up in the country . This full mess shows how nirbaya case is been blown out of proportion as a propaganda tactics .
