Cheers for home buyers as Real Estate Bill gets cabinet nod


New Delhi, Dec 10 (PTI) : Chaired by Prime Minister Narendra Modi, cabinet gave the nod to the Real Estate (Regulation and Development) Bill, a pioneering initiative to protect the interest of consumers, promote fair play in real estate transactions and to ensure timely execution of projects.

The Bill provides uniform regulatory environment to ensure speedy adjudication of disputes and orderly growth of the real estate sector. It will boost domestic and foreign investment in the Real Estate sector and help achieve the objective of Government of India to provide 'Housing for All' by enhanced private participation, according to a release.

The Bill ensures mandatory disclosure by promoters to the customers through registration of real estate projects as well as real estate agents with the Real Estate Regulatory Authority.

The Bill aims at restoring confidence of consumers in the real estate sector, by institutionalizing transparency and accountability in real estate and housing transactions which will further enable the sector to access capital and financial
markets.

The Bill will promote orderly growth through consequent efficient project execution, professionalism and standardization.

The salient features of the Bill include applicable both for commercial and residential real estate projects and establishment of 'Real Estate Regulatory Authority' in States/UTs to regulate real estate transactions.

Registration of real estate projects and real estate agents with the Authority, mandatory disclosure of all registered projects, including details of the promoter, project, layout plan, land status, approvals, agreements along with details of real estate agents, contractors, architect, structural engineer are other features of the Bill.

It has also specified that deposit of specified amount in a separate bank account to cover the construction cost of the project for timely completion of the project.

The Bill envisages establishment of fast track dispute resolution mechanisms for settlement of disputes through adjudicating officers and Appellate Tribunal.

    This is nothing but a gimmick by the govt.In 18 months of rule there is no tangible benefit for common man who intends to buy a flat/house at a budget price.Instead hike of 2%/service tax has made these mentioned buyers to pay at least 40 to 80 thousands more than earlier rate.This is the reward for voting for Modi.....Simply implementing regulatory norms does not help...

    KRP, what ever rule/schemes/program introduced its ultimately concerned states to responsibility follow up..you will be surprised to see, totally different rules followed in DK & in UDUPI on issuing licenses for House construction..every one with Builder mafia minting money..its my personal experience and i have ran office to office get my license along with so many applicant..we just cant blame central Govt for this mess..

    Dear Prabhu,
    Reforming our multiple archaic laws and judiciary is a must for genuine economic revival of the nation.
    Our businessmen only are harassed lot, how foreign investor can take interest in a country where there is red tapism?
    There should be uniformity of laws /statutory norms with some region wise difference is understandable.
    Any effort made by Govt in this direction should be appreciated irrespective of party in power.
    Nevertheless, increase in taxes, price rise, law and order, we can always criticize.

    I appreciate this Real Estate (Regulation and Development) Bill, enacted to protect the interest of consumers.
    Even a small ceiling fan Mfrs are covered under consumer protection act, but the real estate flat- bungalows worth crores were not covered.
    Hope there is no red tapism anywhere, end users - vis a vis builders,if there are more buyers and fair price, builders too should benefit from this bill.
    I hope GST bill also should get passed in the interest of the nation and revival of sluggish economy.

    ..OK Bill is good..but any chance it will be held back in RAJYA SABHA by Congress & its allies for inquiring ROBERT VADRA deal in Haryana!!..last Parliament discussion washed out by Congress..this time also work not going, just because court a Independent judiciary summoned Congress leaders..and Congress openly shamelessly says MODI not following give & take policy..this is what our system is..and some media which was shouting from roof top on VYAPAM totally silent on NATIONAL HERALD..They are more focused on what SONIA/RAHUL says than the Case itself..No tweet from any editors, no discussion..NDTC which was day & night spend for VYAPAM, now discussing KUJLI's junk odd even vehicle policy, which will bring more vehicle to raod than less since people can still buy a second hand vehicle with different number!!

    As long as there is a nexus between Builders and Politicians in power no Bill will ever reduce the Bills the common man will have to pay or face problems for any property transaction.
    In any property transaction where buyers have grievances the Builders always have the upper hand. The common man neither has the time nor the money muscle to take on rich Builders in the courts/tribunals. Most common citizens are salaried employees and have to attend work daily. Where is the time or the energy to fight injustice which is happening in almost every aspect of daily life ? Easy to say too difficult to do as survival is the primary concern of the common citizen.
    Do governments really bother to bring in a Bill that can be Buyer/Consumer friendly and practical too ?

    Building Codes.. building specifications ...standards should all be in place.. Foundation ..
    Parking.. garbage disposal.. Lighting ...
    Road access all to be considered..
    Quality of construction.. Color codes are all to be specified...
    All erring parties to be convicted by LAW. after heavy penalty..imprisonment..
