US court dismisses 1984 riots case against Sonia Gandhi

New York, Aug 26 (IANS): A US court of appeals in New York has affirmed a district court's order and dismissed Nov 1984 anti-Sikh violence case against Congress party president Sonia Gandhi for lack of subject matter jurisdiction.

"Upon due consideration whereof, it is hereby ordered, adjudged, and decreed that the judgment of the district court is affirmed" the court said in its order Tuesday.

Sikhs For Justice (SFJ) filed a lawsuit in 2013 against Sonia Gandhi for allegedly shielding and protecting Congress party leaders accused of inciting violence against the Sikh community after the assassination of then Prime Minister Indira Gandhi.

The three-judge panel affirmed the district court's order that it lacked subject matter jurisdiction over plaintiffs' claims because "all the relevant conduct took place outside the United States" in India.

In June 2014, a federal judge had dismissed the class action lawsuit filed by SFJ and victims against Sonia Gandhi ruling that she is not liable under Torture Victims Protection Act (TVPA) and that the plaintiffs have no standing to bring the lawsuit.

SFJ plans to file an appeal to challenge the summary order, according to Gurpatwant Singh Pannun, legal advisor to SFJ.

    Mrs Sonia Gandhi is innocent in this mass murder case..When Smt Indira Gandhi was assassinated,everyone was stunned and speechless..Naturally,Congress leaders and party workers too..Their leaders planned revenge attack or did not show any interest in stopping communal violence against poor,hapless Sikhs..Sonia Gandhi was neither Congress leader nor Congress worker at that time..She was just a wife of Mr.Rajiv Gandhi..So whatever crime taken place against SIkhs were well planned by Cognress Leader Mr.Sajjan Kumar and others..Sonia's hand was NOT there at all..I believe it 100%..She did not want to come to politics too,fearing about the safety of her children..but Congress leaders forced her to enter politics after Rajiv Gandhi's death.I don't remember exact date of her entry into Indian Politics..but she joined little late..But once she enjoyed the taste of POWER,she tried her best to make use of it..No need to say again about SCAMS..That is the reason why Congress was reduced to 44 from 274 !! and she became Italian Madam !!
    As I came from a Congress family and knew some Congress leaders those days,I can confidently say that Sonia Gandhi is INNOCENT in Sikh mass murder case..

    So are you saying Sajjan Kumar well planned the attack ? How come ? Did Satwant Singh and Beant Singh tell him in advance that Indira Gandhi was going to be assasinated ? Absolute rubbish comments ! Fact is that Sajjan Kumar just took advantage of the situation to incite the mob as he has been accused. There was no planning involved here.
    You also say in your comment that there was no interest in stopping the communal violence by the Congress which is another fabricated lie so that you can concoct a tit-for-tat defence for your Feku.
    The Congress leadership did not give any tacit approval for the riots to continue. Nor were they accused so. These lies cropped by Feku and his parivar band of followers.

    Maybe you need to read your comments again atleast once since I simply copy pasted them when quoting you in my above comments. Once is enough if one can read properly.
    Know that I am pretty thick skinned and have dealt with many such bullies.
    Who I support or not is not relevant here. What is relevant is to not allow damaging lies go unnoticed/unchecked which is what I have done.     First of all in 1984-Sonia was not at all in the politics.. She was just wife of rajiv Gandhi ..In 1984- Bindranwale was supported by Akali Dal and some other factions of Punjab's regional parties...
    Some of the well rich settled US Sikh citizens tried our Sonia in US Court. If they are so confident , why they didn't tried Sonia Gandhi in Inidan Court? Its a million dollar question...

    There are also Bajrang Dal and RSS activists on record who are officially accused of involvement in the Anti-Sikh riots of 1984.
    The Congress leadership had no hand or any tacit approval for the riots. Three Congressmen viz. HKL Bhagat (deceased), Jagdish Tytler and Sajjan Kumar accused of inciting mobs acted on their own and cases against the two living accused are on going. Two BJP governments at the centre still cannot get them jailed.
    Please don't spread lies here to please your political party supporters and Feku.
