In battle with Centre, Arvind Kejriwal scores big win in High Court


New Delhi, May 25 (NDTV): In the midst of a seething dispute with the Centre, Delhi Chief Minister Arvind Kejriwal has received solid vindication in court. Delhi's anti-corruption branch must take its orders from Kejriwal's government and not the Centre, the Delhi High Court said today. The judge also said that Lieutenant Governor of Delhi Najeeb Jung is "bound to act upon the aid and advice of the Council of Ministers."

"Today's HC judgement a huge embarassment for central govt, (sic)" tweeted Kejriwal.

Last week, the Centre said that its officers could not be investigated by the Anti-Corruption Bureau of the Delhi government because it does not have the right to intervene in matters of land, the Delhi Police, or the appointments of key bureaucrats. The Centre also said that the Lieutenant Governor, who acts as its representative in Delhi, is not obliged to consult Kejriwal on these issues.

Kejriwal has described the Centre's stand as perfidy and a blatant attempt to provide cover to corrupt officials.

The clash between the Centre and Kejriwal is over how their powers are divided in the administration of Delhi, which is a union territory and not a full state.

That is what Kejriwal, elected in February with a dazzling mandate, wishes to change. Today, in a characteristically maverick move, he has summoned a cabinet meeting at a public park in the heart of Delhi, and has sought the attendance of the aam aadmi or common man that his party is named after.

Kejriwal and the Lieutenant Governor, combat veterans in the capital, clashed with furious ardour earlier this month over the postings of bureaucrats. Jung said the final say on appointments is vested in him; Kejriwal said an elected head of government is entitled to choose members of his team.

The Chief Minister has also said he will challenge the Centre's notification in court.

    What a Prime Minister we have.. want to concentrate all powers with him and Daku and want to show off his Feku chest. Brag himself outside India about his election promises and insulting all other previous governments as if he had achieved something that no one was able to do. I voted for BJP thinking that they will make my country proud but now I realised this btards are defaming my country in the world stage. Shame on these BJPings who calls themselves deshbhakths.     It is the win of David over Goliath. The performance of AAP in 100 days has been tremendous and BJP was firm in controlling the development through notifications which fell flat due to Delhi High court order. The notification was dictatorial and a suspect. With corruption reduced by 70% the illgotten income that Cong and BJP accumulated has been completely halted by AAP in 100 days. That is where it hurts badly. If this can be the effect in 100 days then for 1725 days it will be a disaster for Cong/BJP. BJP manifesto for Lok Sabha and Assembly mentioned full Delhi State hood but that never will come or nor they will do. But with AAP cutting down all the resources of Cong BJP they will definitely agree to give Delhi Full statehood. Gone are the days of looting and it is time to give back to the people what is looted.

    Kejriwal is not the issue here. The issue is whether the central government by a notification can take away the powers that the Constitution of India has conferred on the the Delhi Legislative Assembly. The answer to that question is a very big no and the Delhi High Court and any other court will say just that.

The people of Delhi and India need good governance and not stereotyped speeches from PM of India. No problem if people could not get Rs. 15 Lakhs into their account but atleast let us bring our PM to India. There is no governance in 365 days only speeches and selfies.     Delhi Lieutenant Governor Najeeb Jung seems to have extended his boundaries and thrown all caution to the winds as it were in the ongoing battle with Delhi Chief Minister Arvind Kejriwal, now in the penultimate stage. At the start the jury was out on who was being more absurd, but now it does seem that Jung, getting the support of the Centre, is crossing all limits.
    The question of the civil service and control of the Lt Governor over all postings and transfers seems to fall in a grey zone according to constitutional lawyers like Indira Jaising and Rajeev Dhawan, both renowned experts. However, keeping this aside as well as the rather pedestrian arguments presented by both sides, this face-off does bring into focus the exact powers vested in the Chief Minister of Delhi the issue of federalism and the authority (or otherwise) vested in the office of Lt Governor, particularly if an incumbent, such as the present one, demonstrates no respect for the elected representative heading the government.
    In the media war generated by both sides, it is easy to lose sight of the fact that the spat is all about an acting chief secretary, who was to replace the chief secretary currently on 10 days’ leave. The issue was small, and it appears that initially Kejriwal had shortlisted Shakuntala Gamlin as one of his suggestions for acting chief secretary.
    He subsequently changed his opinion when her alleged close links with power discoms became known to him. By that time Jung, who incidentally had worked with one of the power companies, Reliance, earlier in his career, had appointed her. The CM wanted this cancelled, the LG refused, and what should have been quietly settled between the two has become an ugly war.
    This spat can however have a positive side if it helps clarify the position of the Delhi Chief Minister in terms of the services. And if Jung and the central government are right in maintaining that he has no jurisdiction on something as basic as transfers and postings in his government, then clearly this needs to be looked at afresh.
    The Delhi CM while being held accountable by voters for poor law and order in the state, has no control over the police that remains a Central subject. Former chief minister Sheila Dixit repeatedly asked for powers but even though her own party was in power at the Centre, this was not done

    But I don't expect Modi to learn a lesson & stop interfering in elected governments affairs to stop Aap from discharging their duties to end corruption.
    If they continue to rule by proxy through notifications & amendments or appeal in higher court, they will get their nose bloodied & lose moral ground with people getting to know BJP is no different in corrupt practices which will cause drubbing in next election.
