IAS officer to move court over govt gag on his religious preaching


Chennai, Jan 29 (NDTV): C Umashankar, an IAS officer of the Tamil Nadu cadre, has said he intends to go to court over a notice sent to him by the state government, asking him to desist from preaching in churches on his days away from work.

The notice, sent on 24 January by Tamil Nadu Chief Secretary K Gnanadesikan, had asked Mr Umashankar to stop preaching on the grounds that it could lead to communal disharmony. The 1990 batch officer argues that the order is a denial of his Fundamental Rights.

The state government had warned Mr Umashankar, 50, of disciplinary action for the alleged violation of service rules laid down for All India Services officers. However, Mr Umashankar says the service rules cannot stop him from exercising his Fundamental Right to practice and propagate the religion of his choice.

"Fundamental Rights guaranteed by the Constitution are paramount to service rules," he said. "As a Hindu officer, I used to worship at temples and pull temple chariots. Nobody complained then. So, why now?" asks Mr Umashankar, who had converted to Christianity in 2008.

However, former Tamil Nadu Cabinet Secretary TSR Subramanian is in disagreement with this argument. "IAS officers represent the government, and they have to be not only be impartial but seen to be impartial. He can always resign and do this. To speak in a politically partisan way is unacceptable," he says.

Since his conversion to Christianity, Mr Umashankar has been active in religious meetings, but says he does not indulge in proselytizing activity. Less than two weeks ago, his vehicle was stoned in communally sensitive Kanyakumari District. The attack was allegedly carried out by Hindu groups, who said he was trying to convert people. The officer was to address meetings in Tuticorin, Tirunelveli and Kanyakumari this month.

An expert in e-governance, Mr Umashankar was favoured by former Chief Minister M Karunanidhi to launch his pet projects - the free colour TV scheme and the state's cable TV wing. Presently, the senior bureaucrat is the Commissioner for Disciplinary Proceedings.

The Tamil Nadu government will soon be taking an action against IAS officer C.Umashankar, who is seeking legal options to challenge the government's directive that stops him from preaching Christianity, according to Times of India.

When approached, a senior government official stated that many government officials had demanded Umashankar's suspension following the issue.

However, the government wanted to give him some more time.

"But his continuous interviews and media debates have embarrassed the government," the senior official told Times of India.

If Tamil Nadu is taking any legal action against Mr. C.Umasankar's personal freedom to preach in the Churches, wait and watch the consequences coming behind this totally reckless and miscalculated action of the Government infringing the fundamental right of a citizen.

    We must take note of one thing - all who live in Hindustan are a Hindu (as per RSS chief MB, b'coz it unite us based on our cultural identity).
    We also know that the apex court ruled that Hinduism is a way of life based on cultural identity.
    A Christian living within Hindustan can be identified as Hindu based on his way of life which is very much Hindustani.
    There is a difference between christian living in Hindustan vs the life style of a christian living in US or UK.
    Similarly a Hindu born & brought up in US not necessarily follow the way of life which he is followed in Hindustan, further he rather identify himself as an American than an Hindustani.

    By name itself, this IAS Evangelist recognised by one & all as Hindu or Hindustani by his Name. (Uma Shankara).

    This issue is nothing but a media creation. It is not prudent to give much attention to this matter that too the national attention is really unwarranted. For no reason IAS Evangelist become a Big Christian Brand.

    As an IAS officer he has the fundamental right to practice his own religion BUT he is duty bound to respect all religions and faiths and work for the people with out any bias. As an officer he needs to be sensitive to the people and their faiths and live the values of of justice,generosity,harmony honesty,integrity, compassion and above all Love and make a difference by his life as an officer.     Fundamental rights? yes i agree as far as he preaches after his duty hours and inside the church. But he can not utter words like:
    "Christianity is only the true religion, all others are bogus."
    "Those who do not follow Christ, will never go to heaven."
    AND
    "Utter Pradesh flood was due to the sinners."
    These statements are not fundamental rights.

    Is religious activities are refrained to Mr. Umashankar for he embraced Christianity?
    On their own, so many Christians too embraced Hinduism and other faiths.
    Whether similar restrictions do apply to people of other faith also? Why then restrict to Christians?
    I am thoroughly aware, except for Parsees, all admit people of other faith into their faith!

    We can see daily in the Government offices and Banks they keep the photos of gods and goddesses make pooja and distribute prasaadha to all whoever is taking.

    An IAS officer in his off duty hours cannot preach and practice his faith?!

    What a rubbish government.
    Remember this Jayalalitha has banned conversions in Tamil Nadu one time and after that she withdrawn ban of conversions.
    I have commented many a times whenever the bjp comes to power it wanted to catch the nerve of the Christian faith. RSS is working behind the screen everywhere. Chaaiwaala is everywhere 24x7 in T.V. bhaashans.

    I have always had a problem with this one Fundamental right given by our Constitution, that is, Right to practice and propagate religion. For me practicing religion could be a Right but not propagating. I have all the rights to practice my religion, my faith and my beliefs. It's my personal choice. But even if the Constitution allows, I do not have any right to 'impose and influence' my religion, my faith and my beliefs on others by way of propagating. If exercising my Rights causes disharmony, unrest and conflict in the society, I am not supposed to exercise this right. Country must be governed by Constitution and not religion. Where religion rules the nation above the Constitution, humanity often takes backseat.
    Religion should be the subordinate of life and not vice-versa. But with us, the problem is that our religion has become of primary importance to us. Religion is only the means and not the end. While religion is the creation of human beings, life is purely God's creation. So how come humans' creation become superior to God's creation? Uma as long as you are govt servant, be faithful to it. Render unto Caesar the things that are Caesar's, and unto God the things that are God's. Don't mix up both. Reverence to God without reverence to thine neighbour is hypocrisy and not religion.

    When you join government service in India, you give up a certain portion of your fundamental rights statutory and agreed to be governed by service rules framed under Articles 309 and 310 of the Constitution of India. While you retain the right to profess your own religion, you cannot be a preacher or Pracharak while continuing to be a government official. It is time for this good man to make this choice rather than be stupid and litigate.

    The news says Mr. Umashankar is preaching on his days away from work, that is, during his off duty hours. He is not preaching during his official duty hours or in his work premises. It’s part of his private life. What’s wrong in it? Is it right on the part of some Ministers, MPs, MLAs and even top govt. officials attending religious ceremonies during official working hours?

    Here the issue has turned like the IAS-IPS-IFS-and the rest of the officials who are holding high administrative level are restricted in their religious freedom. Is that discrimination? Is that written in the Indian constitution?

    Now the Indian religious drama has turned upside down since BJP came into power "religion is only for the lower grade administrative sector of the employed people".

    On the other hand, the low class sections of the society can't change their religion, but only the rich and powerful can do at their own will, nobody will question that. If the poor are changing religion, that is called "forced conversion".

    If Umashankar misuses his office to proleytise then he is wrong and need to be booked...If he is just practicing his religion then no fault....One thing our govt offices are not truly secular...I have seen lot of hindu idols and photos hanging inside the govt offices...I have seen hindu Gods photo,jesus ,some arabic verses (very few) in govt buses...when some of the govt offices or schemes are inaugurated we follow hindu customs by inviting seers and they perform according to their rituals....Even inside police station some of the religious festivals are celebrated with pomp and glory...Secularism is only in paper work...In reality is only our constitution is secular ...
    Let us ban religion inside govt premises ....

    There are 2 options for the officials working in govt. department.

    In the best interest to upkeep the dignity of IAS chair and his position, wish this IAS officer Mr Umashankar who converted to Christianity in 2008, should desist in preaching in public but can practice his religion within 4 walls until his continuance in his chair as IAS officer.

    Once he retires or relinquishes his chair, he is free to preach and practice as per the Indian Constitution.

    The Indian Constitution in Article 25 grants to citizens of India of all religious persuasions freedom to profess, practice and propagate their faith in a way that does not disrupt public order and does not affect public health and morality adversely.

    Note: If this person is practicing his faith outside duty hours then i don't really see a problem with this.

    This is a unprecedented case!I didn't hear so far an IAS Officer propagating his religion off duty or so.I think since it is first case the interpretation of fundamental right for this IAS officer could be future precedent and law with regarding right to preach and right to propagation of his faith.There are certain protocols for IAS officers and I am not endorsing nor subscribing his thinking that being he is an Chief magistrate of particular District.

    This guy is giving hate speech that the persons who lost their life in Kedarnath floods are sinners (because they did not follow the path of Jesus) completely forgotten that in 2004 tsunami affected areas of Tamil Nadu are populated by Christians also (Vailankanni town was among the worst hit and water swept away hundreds of devotees who came to pilgrimage).

    You preach wherever/whenever you want. But, don’t try to divide the society by saying that if you follow only my religion you will go to heaven, otherwise you will go to hell.

    To see this IAS Officer a govt personnel standing for Christ and proclaiming the truth is a matter to be applauded. God is glorified !!! He will be richly rewarded by the Lord. It is individual decision whether to accept the truth what is preached or not. Conversion into Christianity is of the heart,that is the person who converts has heard the message that is preached , believes and accepts it. No one can be forced in this matter.     But on the holidays, while he is preaching his solid religious conviction, nobody can touch him. Is he exhorting the listeners to physically attack other people to spread his religion? Is he physically attacking anybody, or breaking anybody's house to preach that?
