State Bank of India may announce Mallya a 'wilful defaulter'


Kolkata, May 24 (PTI) : State Bank of India, which has an exposure of Rs 1,600 crore to grounded airline Kingfisher, on Friday said it is exploring ways to declare promoter Vijay Mallya as a 'wilful defaulter'.

"We are looking at various ways to declare Vijay Mallya a wilful defaulter and trying build a strong case in that regard," an SBI source said. The source said that as per RBI guidelines, it would have to be proven that the borrower had diverted funds which he taken from the bank and not paying up despite having the ability to pay.

 "If we are sure on these two points, then the bank will declare Mallya a wilful defaulter," the source said.

A person declared wilful defaulter would lose directorships in companies and would never be able to borrow further. SBI leads a 17-member consortium of lenders that is trying to recover dues running into over Rs 7,500 crore in principal alone from Kingfisher Airlines. SBI has the maximum exposure of Rs 1,600 crore to the airline, which has been grounded since October 2012. The loan to Kingfisher Airlines had become bad, forcing the bank to go for provisioning of the loan amount.

    Just like Mallya's King Fisher Airlines, even his IPL cricket team is in shambles - it is at lower 6th Position and did not qualify even for play-off. It resemble the performance of Congress.
    Mumbai Indian Players tightly hugged and lifted high Nita Ambani.
    But there is no one to lift Mallya ! His name is Vijay-the Victory, but now a loser.

    Two entirely different issues.
    IPL RCB has nothing to do with KFisher airines.
    RCB is owned by VMallya but KFA is not owned by VMallya but by shareholders. VMallya was not paying salaries of KFA Employees as an individual meaning he is not the individual owner of KFA. He was the CMD of the KF.

    I personally think he is a very astute and ethical businessman, but in his diversification into the beleaguered airline sector brought his nemesis despite having been warned by experts!! Now it is the banks who loaned him should have taken sufficient securities and collateral!! He was perhaps giving the best remuneration and facilities to his employees when the going was good!!

    All businesses have multiple inherent risks and if this independent business failed then those who participated in it directly or indirectly too have to bear the brunt of the losses!!

    Ultimately in our system, the rich and uber rich can employ the services of top financial advisers, lawyers, etc. to advise them to take full advantage of the loopholes in the system so that they not come into trouble in cases of heavy losses or defaults, unlike the common man who would be behind bars by now!! Jai Hind!!

    SBI cannot prove that he has done willful default. SBI has no clues how to recover the loan.


    For those who comparing Mallya with frauds and corrupt people,......it loss in business. He as not done any fraud.

    To pay employees salary....Kingfisher airlines should generate the income....every time, he cannot bring money from outside and pay them.

    Morality is one thing and legality is another. Legally, it looks, Mallya has not committed any act that is ultra vires. He has not given his personal surety as a director of Kingfisher to the loan. Neither he has diverted money to other places. Kingfisher is an insolvent company and it has no ability to pay. I think SBI will not be able to prove him a willful defaulter. SBI has dealt with a legal entity, a person in the eyes of law as the one able to deal under contract act, that is Kingfisher. Liability of Mallya, as a member is limited to the extent of unpaid share capital of the company. Here, the bank has dealt with not a partnership firm or a sole trader Mallya can wind up the company on voluntary basis after taking shareholders permission. Since, he has a fond of reviving the company, he does not seem to do that. Finally, the company will have to be wound up under compulsory and involuntary court order, where the liquidator will manage the winding off of the company as per insolvency act.

    Please read fond, as fond hope. SBI has not dealt with partnership firm or sole trader, where the liability of the partner or trader is unlimited and personal, which is not the case with a limited company.

    Send vijaya mallya to a judicial custody like subrato banarjee. Both are big frauds of our country. Though they spend enormous money for various entertainments, cricketers, clubs, models, etc., but they seems defaulter in the view of Govt sector. These are all drama of swallowing the public money. Supreme court is requested to confiscate of all their assets & them as 'bankrupt' & send them to life long imprisonment.

    The earlier Union Government is also equally responsible for this mess or non payment of various dues including salaries to its employees.
    The UPA government showed all step motherly treatment towards to all of his revival plans of his airlines.
    The same Government has continue to exist our great AIR INDIA with Rs 50000 croes debt and over Rs 35000 croes accumulated loss.
    What a disparity ?
    Who will repay our Air India's debts ?
    Is not the same yard stick should be used for all PSU!S ?
    Its very easy to pronounce Mr Mallya as willful defaulter, But equally it makes more complex to recover the said dues and repercussion on other things like other banks dues,employees salaries and their PF pending payments, these things are also looked after.
    SBI still can suggest the new government to give one more chance to Mr Mallya!s with time frame to come out from things mess and also SBI brings to the notice of present government the hurdles created by earlier government and set right the things in the interest of people at large specially the employees of Mallys other companies too.

    As regards other small borrowers the SBI s them ' Wilful Defaulters' as soon as the fourth installment becomes OVERDUE.

    Mallya lost business in Kingfisher because of step motherly treatment by Indian aviation industry. Most rules and regulations are favoring Air India and the government is backing the AI over the other carriers. If he had started his Kingfisher Airlines in the USA, he would have been very successful now.

    I still admire the man and hope that some day he would bounce back.
