Suryanelli: Victim's plea against Kurien dismissed


Thodupuzha (Kerala), Jun 29 (PTI): In a major relief to Rajya Sabha Deputy Chairman P J Kurien, the Sessions Court here today dismissed a petition filed by the victim in the Suryanelli sex case seeking inclusion of the Congress leader in the case.

The victim in the 17-year-old case had moved the court against Kurien based on the 'revelation' of the sole convict in the case Dharmarajan, who had claimed in a media interview a few months back that he had taken Kurien in a car to a guest house at Kumily where the girl was lodged.

Dharmarajan had later retracted the claim in the court through an affidavit stating he had never met Kurien and he was in an inebriated state when he made the charge through the media.

The victim filed the private review petition on the basis of the lone convict S S Dharmarajan’s 'revelation' that he had taken Kurien to the guest house.

A few days after his interview to a channel, Dharmarajan was arrested from Karnataka after absconding for several years by jumping bail.

However, Dharmarajan had on May 28 retracted his statement in an affidavit filed before the court.

Two other accused in the case, Jamal and Unnikrishnan Nair, whom Dharmarajan had earlier claimed to be witnesses to the incident, had contested his claim.

The victim moved the sessions court after the Peerumade First Class Judicial Magistrate Court rejected her plea for a fresh inquiry in the case based on Dharmarajan’s statement.

The 1996 case came into focus recently after the Supreme Court invalidated the Kerala High Court's verdict acquitting 35 accused in the case.

The girl from Suryanelli in Idukki district of Kerala was abducted in January 1996 and was taken from place to place across Kerala and sexually exploited by different persons.

    A person never lies when he is an inebriated or semiconscious state. That is why techniques like brain mapping, hypnotism, etc. are used to find out the truth. Obviously Dharmarajan didn't have the guts to speak the truth against a powerful man, when he was fully conscious. What he said in an inebriated state was the truth but was coerced to lie in the affidavit, since this is the only way out for Kurien. What if Dharmarajan again retracts his statement made in the affidavit? Will the police or court dare to take action against Kurien?

    Everybody likes to express their own views and give lot of justifications.

    Without any basis, firm conclusions Opinions will differ depending upon the person, his Political affiliations and his religion, caste etc.
    Some times would believe and quote
    Courts pronouncement if it favours whom they like and some times no consideration for courts
    pronouncements.
    Luckily Courts in India are not much affected!

    In all riots major victims innocents, target :MINORITIES!
    Masterminds are NOT punished or held guilty.
    NO FAULT OF COURTS, THEY HAVE TO RELY ON EVIDENCE!
    In riots, murderers and Rapist were protected and glorified.
    Thereafter crimes increased many folds, like rogue Countries!

    We knew already that nothing will happen to Great Kurien since he is associated with ruling Party and belongs to most favoured community in Kerala. Dharmarajan took the name of Kurien in his inebriated state of mind but only Gods knows why did he took Kurien’s name only instead of Cherian, Karian, Gopalan, etc? Instead of questioning this lady again and again in various Courts, I think better we leave this case to “God’s Darbaar” so that he will take necessary action at appropriate time

    Well said....especially last line.

    Also Manipal rape case if victim refuses to file complaint and testify in Court....for sure Court has no option than acquitting all accused.

    I believe there are no lawyers,witneses, evidence,examinations, cross-examinations, proof in Gods court...and truth always prevails there inspite formal complaint by victim.
