New Delhi, Sep 18: The Delhi High Court has granted 30-day custody bail to Farhan Ansar Suse, an accused in an alleged ISIS conspiracy case, to undergo surgery and necessary medical treatment at a private hospital of his choice within the Delhi-NCR region.
A Division Bench comprising Justice Prathiba M. Singh and Justice Vikas Mahajan issued the order while hearing an appeal filed by Suse against a Special NIA Court order at Patiala House Courts, which had earlier rejected his interim medical bail plea.
The High Court observed that Suse, who requires surgery for an umbilical hernia alongside treatment for bronchial asthma and Type-II diabetes, "being medically unwell, cannot be prevented from undergoing treatment at a private hospital at his own expense." However, the bench declined his request to receive treatment in Mumbai, citing potential security risks given his alleged network in Padgha and neighboring areas of Maharashtra.
Suse is facing trial under the Indian Penal Code and the Unlawful Activities (Prevention) Act (UAPA) in a 2023 NIA case. According to the anti-terror agency, he was part of an ISIS-linked conspiracy involved in raising funds via extortion and spreading terrorist propaganda. While defence counsel senior advocate Satyakam argued that the main allegation pertained to extortion and that the ISIS connection remained unproven—noting that Suse has already spent over two years and nine months in custody with a witness list exceeding 500—the NIA strongly opposed the relief, alleging he was an active prime conspirator in a network previously operated by the late co-accused Saquib Nachan.
Under the terms of the custody bail, Suse will bear all medical expenses and may be accompanied by two immediate family members, such as his spouse or children, during hospitalisation. The court strictly prohibited him from communicating with any other relatives, friends, or individuals named in the chargesheet.
The bench directed that upon the expiry of the 30-day period—or immediately if declared medically fit prior to that—Suse must be transferred back to jail, noting that any potential extension would strictly depend on further medical advice.
