California, Jul 9: A fitness club in Southern California has been sued after a 23-month-old boy allegedly sustained a traumatic brain injury while under the care of its daycare staff.

According to US media reports, the lawsuit was filed on July 2 by the child's parents, Matthew and Elena Kittle, against The Bay Club, alleging negligence and other violations arising from the incident that occurred on March 17.

Court documents state that the toddler, identified as C.K., was attending the club's daycare when an employee allegedly tossed him several feet into the air during play and failed to catch him. The child reportedly fell head-first onto the floor, after which the employee also lost her balance and fell on him.

The parents alleged that the club failed to adequately acknowledge the seriousness of the incident. The child was diagnosed with a concussion and traumatic brain injury and is reportedly continuing to suffer from its effects.

The lawsuit accuses The Bay Club of negligence, negligent hiring, retention and supervision, negligent infliction of emotional distress, intentional concealment and intentional infliction of emotional distress.

Meanwhile, CCTV footage of the incident has surfaced on social media. The video purportedly shows the employee playing with the toddler before lifting him into the air, after which he falls to the ground when she is unable to catch him.

The case is currently before the court, and no ruling has yet been made on the allegations.
