Petition to re-probe Mahatma Gandhi murder: SC appoints amicus curiae


New Delhi, Oct 6 (PTI): The Supreme Court today put some searching questions on a plea seeking to reopen the investigation into the assassination of Mahatma Gandhi.

After a brief hearing, a bench comprising Justices S A Bobde and L Nageswara Rao appointed senior advocate and former additional solicitor general Amrender Sharan as amicus curiae to assist the court in the matter.

During the hearing which lasted about 15 minutes, the apex court was initially of the view that "nothing can be done in law" in the case which has been decided long ago.

However, it later told Sharan that its observation was not binding on him to make an assessment of the matter and posted it for further hearing on October 30.

The petition filed by Mumbai-based Dr Pankaj Phadnis, a researcher and a trustee of Abhinav Bharat, has sought reopening of the probe on several grounds, claiming it was one of the biggest cover-ups in history.

Gandhi was shot dead at point-blank range in New Delhi on January 30, 1948, by Nathuram Vinayak Godse, a right-wing advocate of Hindu nationalism.

    I have listened to many lectures about the turn of events leading to the assasination by none other than Nathuram Godse's brother residing in Pune. A thought always crept in my mind that Gandhiji was going to wind up a political party after independence, so is it possible that people with political ambitions paid the killer to get the great Mahatma assasinated.

    One RSS leader went to Italy to study Mussilini's fascist ideology, the gun was used by Mussolini's top military official who had used it. In 1935, Italy’s Mussolini's army attacked Africa’s Ethiopia, and one of the senior officer used that gun. In 1941, when Italy fell down on the knees of Britain, the gun came to Gwalior Infantry and Commander General V V Joshi took that gun as a trophy. Somehow, this gun came in hands of Jagdishprasad Goyal, a local weapon dealer, who sold the gun for Rs. 500, which eventually was used to assassinate Gandhi.
    As per old news paper report it was handed over to Godse in Nagpur & the assassination was celebrated there afterwards.
    Now it is left for the readers to decide, who was behind it & which organization conspired for the same.
