SC withdraws ban on Allahabad HC judge from hearing criminal cases

New Delhi, Aug 8: In a significant development, the Supreme Court on Thursday recalled its earlier order restraining Allahabad High Court judge Justice Prashant Kumar from hearing criminal cases. The apex court also expunged certain remarks made against the judge, terming the matter as "closed".

A bench of Justices JB Pardiwala and R Mahadevan had, on August 4, prohibited Justice Kumar from presiding over criminal matters after he upheld criminal summons in what was essentially a civil dispute.

The turnaround came after Chief Justice of India (CJI) BR Gavai wrote to the bench, urging them to reconsider their decision. "We have received an undated letter from the CJI requesting us to reconsider the directions passed in our earlier order," the bench noted, before setting aside the previous judgment and remanding the matter to the High Court for a fresh hearing.
