Passport officer transferred for harassing interfaith couple

Updated

Lucknow, Jun 21 (PTI): The regional passport office here today transferred an official accused of humiliating an interfaith couple and expressed regret over the incident.

Regional passport officer Piyush Verma said a show cause notice has been issued to the officer and he has been transferred with immediate effect.

Verma said passports were issued to the couple-- Mohammad Anas Siddiqui and Tanvi Seth, after he met them in his office here.

"We have also sent the report to the Ministry of External Affairs for further action," Verma said assuring necessary action against the official.

The RPO expressed regret over the incident and assured that it would not be repeated.

The couple had yesterday taken to micro-blogging site Twitter to share their harrowing experience of how the erring officer questioned Seth for not changing her surname after marrying a Muslim.

In a series of tweets to External Affairs Minister Sushma Swaraj, Seth spoke about the "high handedness" of the official and also sought her intervention.

"I was told my passport cannot be issued because I have married a Muslim and did not change my surname. I asked what I should do now and I was told to change my surname in all documents," Seth told newspersons.

"The said official while interviewing me spoke very loudly and in a very humiliating manner in view of a lot of people," she rued.

"I do not know if he had any personal grudge...he started asking questions just after he saw our names," Siddiqui said.

"We had applied for passport and after going through all the formalities, I went for the final verification and the official there made absurd queries over my marriage as I have not changed my surname...he said that it is duty of every woman to change her surname after marriage and used demeaning language besides making gestures...," Tanvi alleged.

Inter-faith couple alleges shocking harassment at Lucknow passport office

New Delhi, Jun 21 (IT): An inter-faith couple has alleged that they faced harassment at the local passport office in Lucknow. Twitter user Tanvi Seth, in a series of tweets, reiterated the incident and tagged External Affairs Minister Sushma Swaraj.

Tanvi alleged that she was mistreated because she was married to a Muslim and had not changed her surname even after 12 years of marriage.

She claimed that passport officer Mr. Vikas Mishra spoke to her rudely and was loud enough for others to hear the discussion pertaining to her case.

While checking the couple's documents, Mr Sharma apparently said "apke saath to masla hai. Apne Muslim se shaadi ki hai toh aapka naam Tanvi Seth kaise ho sakta hai? (There is an issue here. You married a Muslim man then how can your name be Tanvi Seth?)".

To this Tanvi answered that it is her personal choice. "I have not changed my name. I have been married for 12 years and all the documents I have are on my maiden name. There is no law where a woman is forced to change her name,” read the mail the couple sent to Sushma Swaraj which Tanvi's husband posted on Twitter.

Tanvi said that she was told that it is her duty to change her name after marriage.

"I have never felt so insulted in the last 12 years of my marriage with my husband. It is my personal choice to choose a name I want to after marriage. This is our family matter and last thing I expected to hear at the passport office was it is your duty to change your name after marriage,” she tweeted.

Calling it a clear case of "moral policing/religious prejudice", Tanvi said the officer had both both their passports on hold.

The passport department has called for explanation from the passport official for his behaviour with Anas and his wife Tanvi Seth. The passport official has also been transferred to Gomitnagar passport office and asked to submit a written apology.

    His version
"Incorrect," says Mishra, giving his version of what transpired yesterday.
"She was showing nikahnama that had her name as 'Shazia Anas' but had said on documents that she has not changed her name Why did she not endorse this on paper? I asked her to endorse her 'nikah' name, but she said she did not want to do that, which is when I sent her to the higher official," said Mishra.
The passport officer denied he discriminated based on religion.
"I myself have done an inter-caste marriage. I am not communal and respect and sit with people of all religions," said Mishra.

This is his version, which needs probing as he had withheld her husbands passport too which proves he had done wrong & now trying to wriggle out by twisting the story a bit.
An affidavit & Registered Marriage Certificates are only accepted by Passport Office rather than those given by religious bodies.
He needs suspension & not transfer until he proves his innocence .

Discrimination in workplace can be in different forms; there might be a single reason or a combination of multiple grounds of discrimination. Discrimination in a workplace may constitute in form of: 1. Age, 2. Sex, 3. Qualification, 4. Disability, 5. Pregnancy, 6. National origin, 7. Race/ Colour, 8. Religion, 9. Sexual harassment, 10. Equal pay or compensation, 11. Region/Place of origin, 12. Caste and 13. Ethnicity.

The Constitution of India has several provisions which grant certain fundamental rights to its citizen, which includes right to equality.

Article 14 guarantees Equality before Law.

Article 15 prohibits state from discrimination on the grounds of religion, race, caste, sex and place of birth.

Article 16 empowers the state to make reservations with respect to appointment for posts in favour of backward classes of citizens if in the opinion of state such classes are under-privileged.

Under the 1992 National Commission for Minorities Act, five religious communities – Muslims, Sikhs, Christians, Parsis, and Buddhists – were considered minority communities.

Section II. Status of Government Respect for Religious Freedom.

This civil servant act is violation of Article 14 and 15. The trial should be held under The Central Civil Services (Classification, Control & Appeal) Rules, 1965 RULE 10.

I request External Affairs Ministry to conduct internal departmental enquiry and the civil servant should be terminated for violation of his contract.

According to United Nation convention this is clear violation of the state for discriminating services based on one's religion.

First of all in Islam ,both son and daughter cannot change their name be it whatever status they have(married, widowed, divorced, single etc)

We can have one initial name of our choice followed by father's name Compulsory (father's name)

A wife cannot change her father's name into husband's name after her marriage.

Because by marrying she will change social status ,but biologically she is always be her father's daughter.

Spiritually it is believed in heaven angels will call us after death"oh daughter of so and so ,oh son of so and so .."(literally meaning father's name).

In our graveyard also our name should be attached to our father's.This is the honour given to dad in Islam,if mom is given a tribute of having heaven under her feet. Then father's is also such a big honour. Both the sex are given equal rights .

That's why arabs have for eg sheikh Hamdan bin mohamed bin rashid Al makthoum.
Bin means SON OF ...If u admit ur child in arab oriented school they automatically join father's name even if passport donot contain. They follow the Islamic shariah properly.

This lady Tanvi seth or her husband can't change her name.Father's name is already sealed once the baby comes to this earth.

There is no bigger lie than officer saying convert to Hinduism. It’s a big big lie just to corner the officer. Couples angered by officers demands to give proper documents so they added masala. In India religious sentiment masala sells quickly. From national media to celebrities start holding play card. But who ever is right comes clean sooner or later. Too much said written on Rohit vemula, VC dent on leave, minister transfered. Every one knows truth. Now mother openly says who incited and duped her. Karma returns.
