Bengaluru: High court declines stay order on FIR against Nalin Kumar Kateel

Bengaluru, Dec 14: In the case related to the obstruction of duty of a government official, the high court rejected the request for quashing the stay order on the filing of First Information Report (FIR) against Dakshina Kannada Member of Parliament (MP) Nalin Kumar Kateel.

Nalin Kumar had applied for the cancellation of the FIR filed against him in Kadri police station in Mangaluru. The one member bench of justice K N Phanindra, which conducted inquiry, rejected the request for stay. The court also clarified that even if the police file a charge sheet in relation to this case, it falls under the final order of the court.

Arguing the case on behalf of Nalin, during the inquiry, advocate H Pavana Chandra Shetty told the court that the MP has discharged his duties as the activists of his party were arrested without sufficient reason. He has not caused any obstruction to the duties of a government official. This FIR was filed by the police officer to malign his personal charisma and requested the court to grant stay on the same.

The lawyer for the government objected the request by saying, "The applicant has obstructed the duties of a police officer. Not allowing the higher officials to speak, he flung the chairs twice. Inquiry in this regard has been completed and chargesheet is about to be filed. So stay order should not be granted,"

It may be recalled that on September 7, several activists of BJP were arrested during a BJP’s bike rally that was organized at Nehru Maidan. Subsequently, a video went viral on the social sites, in which, MP Nalin Kumar was seen threatening police inspector Maruti G Nayak.

A FIR was lodged in Kadri police station in this regard.
