Gujarat RS poll: HC issues notices to EC, Ahmed Patel on Balwantsinh's plea


Ahmedabad, Aug 21 (PTI): The Gujarat High Court on Monday issued notices to the Election Commission (EC) and Congress leader Ahmed Patel on a petition filed by BJP candidate Balwantsinh Rajput challenging the EC's decision to invalidate the votes of two rebel Congress MLAs in Rajya Sabha polls.

Justice Bela Trivedi issued notices to the EC, Patel and also the two other candidates - BJP president Amit Shah and Union minister Smriti Irani.

The notices are returnable on September 21.

Rajput, the BJP candidate who lost the Rajya Sabha poll from Gujarat, had moved the court against the EC's decision to invalidate the votes of two rebel Congress MLAs. He had quit the Congress ahead of the August 8 polls.

Rajput contended that the votes of two other Congress MLAs should also be discounted as they too had shown their ballot papers to unauthorised persons, and he be declared the winner.

The EC's decision paved the way for the victory of Congress candidate Patel - who got 44 votes, the minimum he needed to win - in the high-stakes electoral battle. Rajput polled 38 votes. Rajput's petition said once the returning officer had used his discretion to accept the two votes as valid, the EC had "no power to issue any direction to the returning officer for accepting or rejecting any vote".

The EC had invalidated the votes of former Congress MLAs Raghavji Patel and Bholabhai Gohel. Congress' polling agent Shaktisinh Gohil had lodged a complaint before the counting began, saying the two MLAs showed their ballots to BJP representatives before putting them in the ballot box. The MLAs are not allowed to show their ballots to anybody other than the authorised polling agent of their party, Gohil said.

Both these MLAs voted for Rajput instead of voting for Ahmed Patel. However, as the votes were held invalid, Patel was declared the winner (along with BJP's Amit Shah and Union Minister Smriti Irani).

Had Patel got less than 44 votes, Rajput could have won with second preference votes from the BJP. Rajput urged in his petition that the EC's order be set aside, as it was "patently illegal".

Once the returning officer had exercised his discretion of accepting these two votes as valid, the EC had no power to hear any appeal against the order. The only remedy the aggrieved party had was to move a court, it said.

Rajput also alleged that Patel won because of "corrupt" practices. Two other MLAs of Congress had also shown their ballots to unauthorised persons, and these two votes, which went to Patel, must also be held invalid, the petition said.

If these two votes were rejected, Rajput would get more votes, and hence he should be declared as elected to the Rajya Sabha in place of Patel, it said.

    The Party of difference BJP is no way of respecting the democracy or people's verdict. Gujarat High Court judges always seems to be favourable for BJP it may fake encounter or post Godhra communal violence.
    Balvantsinh Rajput himself is Congress elected MLA from Gujarat. He joined the BJP in 2017 after leaving Congress before Rajya Sabha voting.
    Thanks to unique democracy of India from autonomous Election commision of India a elected member of house can defect from his original party and vote against his own party before the complete 5 years tenure.
    Principles emerge from good practices not bad ones. Good principles recognise constitutionalism and democracy. I suggest recognition of the following:
    Governors should not be party men and politically neutral by criteria declared and stated by the president based on constitutional commissions and committees.
    All parties and individuals must abide by their mandate during the critical period between the declaration of results and the first post-election session of the assembly or parliament. This is the dangerous time when the anti-defection law does not apply. It is undemocratic to abandon the mandate of the people.
    Prima facie, the governor must reject party candidates and individuals that abandon the mandate. India’a democracy cannot be put to ransom by governors in the drawing rooms of a Raj Bhawan.
    Governors must not consult union ministers to decide what to do.
    If there is a hung result, the governor shall select the single largest party or pre-election combination and reject post-election alliances and defections including individuals.
    For a minority government to survive, it must face no confidence motions rather than confidence motions.
    In the assembly, those who change their party or mandate will be subject to the anti-defection law.

    EC has nullified those two votes on the basis of govt installed CCTV footage recording and its a crystal clear proof and evidence. Does HC have some other evidence to prove otherwise?????.

    If he genuinely had number then we can accept defeat gracefully..its not the case..Ahmed didnt have number, till now he has no number..He short of 2 votes..Congress MLAs voted for BJP & shown to Congress election agent, so EC disqualified vote..looks ridiculous, anyways if so then another 2 Congress MLAs vote should also be disqualified..BJP has genuine point in court of law..
