Udupi: Bhaskar Shetty murder - Rajeshwari seeks cancellation of death certificate

Udupi, Aug 15: Rajeshwari Shetty has approached the state high court with a writ petition to cancel the death certificate issued in the name of Bhaskar Shetty.

Rajeshwari Shetty is the wife of Bhaskar Shetty, who was allegedly murdered last year. Rajeshwari is one of the five accused persons in the case. Other four are, Navaneet Shetty, Niranjan Bhat, Srinivasa and Raghavendra. Navaneet is son of Bhaskar Shetty and Rajeshwari.

The petition was heard by single bench chaired by A S Bopanna on Monday, August 14. The judge sent notice to revenue department, prosecution, Gulabi Shedthi the mother of Bhaskar Shetty, Manipal police station, Tahasildar of Karkala and district birth and death registration department and adjourned the case to a later date.

The petition says that a missing complaint was lodged regarding the disappearance of Bhaskar Shetty and his body was never found. The investigations relating to the case is in progress. But the death certificate has been issued by the concerned department without proper proof about the death.

Rajeshwari has objected to the death certificate on the grounds that the certificate was issued illegally and was obtained for the purpose of taking over the wealth of Bhaskar Shetty.

    If what you are saying is true...report has come in november 2016..
    why hasnt prosecution started prosecuting in the court yet?
    when she applied for bail, prosecution told that they still have investigation to do and she may tamper th evidence.
    since the report you quote is sure that its his bones, what are they waiting for?
    its nearly 10 months from the report you quoted.

    i am not in way suggesting that she is innocent nor that she is guilty. I just want truth to come out.
    As this case as warranted lot of public interest, hope this case comes to a logical conclusion soon.

    DNA has not been confirmed.
    Police intially only suspected. They got the wrong bones.
    Thats why the police is arguing that investigation is not over,because they dont have concrete proof yet.

    This is a brilliant idea to get bail.
    Till toady there no proof of death.
    When there is no proof of death how can the prosecution say that he was murdered.
    If there is no proof of death, she cannot be charged with murder.
    Bhaskar Shetty is just missing person and there is no proof of his death.
    Homa Kunda story was totally a fake story created just to mislead the Police.
    Our Police have done nothing other than going around the Homa Kunda for the past one year looking for some evidence. They continue to do the same thing for few more years.

    I think there are some confession statements by bhatta and other accused.
    There is one person I think driver turned out to be approver or witness..

    He will be presumed dead only after a certain period ( 6 or 9 years, not sure).

    so how was the certificate issued?

    Cancel the death certificate because it is not yet proved her husband has dead. So transfer all the property on his mothers name till he is found alive. Wife and all accused should remain in jail till he is found alive. Simple.

    Mr. Bhasker's death has been contested as part of Rajeshwari's defense in the murder trial. There has been no judicial findings yet as to whether he is dead or not. So Rajeshwari is perfectly justified in seeking cancellation of the death certificate as it otherwise affects her claim for a fair trial.

    And if the death certificate is cancelled; then who do you think is going to "transfer" all the property to his mother? No judge in the district is going to unilaterally pass such an order.

    How are you so confident that Mr. Bhasker Shetty is dead?
    Reading each of the comments in this forum, it is clear that people have already made two assumptions:
    - That Mr. Bhasker Shetty is dead; and
    - That his wife, son and one Bhatta killed him.
    It might very well be true that both the assumptions are right. But I have to ask just one question – WHERE IS THE EVIDENCE? All we are hearing is the claims made by the police which are yet to be judicially tested in a court of law. And even the arguments presented by the police to-date does not inspire much confidence in a lay man like me. I just wonder as to what any shrewd defence lawyer (and with resources to bring on expert witnesses) would do to the body of evidence presented so far. As of now, it looks like acquittal is a foregone conclusion.
    Bhasker’s body (or his distinctly identifiable body parts) have not been found. There is no judicial findings yet as to whether he is dead. So who are you to confidently assert that he is dead?
    And the failure to file a missing person’s report is your evidence that she killed him? Really? Neither prosecution nor the defence has denied that there wasn’t any marital discord between the two. So she might not have even cared if he goes missing. Who knows, I do not know. But this itself does not incriminate her on a murder charge.
    I know that you will not like my response. But this is the thought process that is applied in a criminal trial; and it is the duty of the prosecution to prove their case. The defence does not have to prove their innocence. And if you read the NCRB’s report on prosecution success rate in Karnataka for the last few years, I will be betting on an acquittal straight away.
