Udupi: Raid on Private Zoo – Several Cases Registered against Sudheendra Aithal

Udupi, Oct 25: Forest officers have registered cases against Sudheendra Aithal under Wildlife Conservation Act 1972 for keeping rare animals illegally. Earlier the officers had assured of taking action against Aithal only after examining the animals seized from his home.

As reported earlier in these columns, Sudheendra Aithal’s private zoo which had been a favourite spot for locals to visit was raided on charges that the rare animals were kept illegally and that Sudheendra had no permission to run a zoo.

The department is yet to conduct the examination of animals but already the officers have booked cases against Aithal under section 9, 38(4), 38(1), 39, 40, 44 (2), 50, 51 for violating Wildlife Conservation Act 1972. The Act allows for arresting the persons who are rearing animals without prior permission of the state government.

Meanwhile Sudheendra Aithal has been hospitalized and is recovering from the shock following the raid on his house conducted by the deputy conservator R K Srivastav.

Animals that were rescued from the house of Aithal, few of them have been taken to Mysore Zoo and few of them are abandoned at Aithal’s house.

It is also learnt that few of the birds and animals died on the way to Mysore Zoo and the remaining of them are not taking food without the master and his love. The officials have left behind some of the animals at Aithal’s home in Saligrama starving as there is no one to take care of them.

Besides this, Aithal has been booked under Prevention of Violence against Wildlife Act 1960. According to the Act, chaining of animals in a cage is a crime. It is unfortunate that all these cases have been filed against a man who took care of the animals like his own children.

    Going by this article, if not the journalist is biased towards Mr Aithal,must admit its an bureaucratic hegemony.Before officials proceed with the case,need to explain to the public, the reason behind abadoning few animals at place from where they have confiscated them, the reason behind death of animals on transition.Meanwhile we wish to know the credentials of Mr Srivastav.

    Shri Anand Kudla has raised a valid point. If holding animals in captivity by private persons is wrong then how come they are permitted in Zoos? Did the birds and animals species originated in forests or Forest Department Zoos. If the private persons are booked even though they care for the animals then what should be done to the Zoo personnel under whose (s)care animals die at the Zoos.

    Mr. Sudheendra Aithala was a nice person, he was giving medicine to so many people when their pets where ill. We too bought a Doberman puppy from him 3yrs ago, which died in a fight with a Cobra. He was loving those animals like his kids. He never did any business out of it. He was loosing a lot of money in taking care of those animals. Despite a holy man doing his daily Pooja's in near by temple, he used to do this prayer for those animals who loved him so much. The milk he was taking from his cows daily never reached dairy farm, but was used to feed his animals.

    Who is responsible for those animals died on the way to Zoo? Will Rules & regulations take action on those officers who are responsible for the death of birds 7 Animals? This is just politics nothing else. Action should be taken on those who kill such rare animals and not on, who protects them. I don't think animals are more safe in Zoo. There are so many cases of deaths inside Zoo.

    There are two aspects to this story. One, where the defendent is at the moment 'guilty' of possessing wild animals. The other, where the cops did more harm than good. It was necessary for Mr. Aithal and for the cops as well, to have a level of maturity. Mr. Aithal is not wrong. He's right in his own way by taking in those animals who would probably have been dead if not for him. But, knowing how funnily the Indian Legal system works, he should have been wise and got his zoo legalised.

    On the other hand, I don't understand why the law enforcers created havoc when there was no reason to do so. They could have given Mr. Aithal a notice to legalise his zoo and a'm sure the gentleman would have paid heed to their advice. Who asked the policemen to barge in and disrupt the situation especially as they had no back up plan to shelter all the animals and provide for their physical and emotional safety. Now, the policemen ought to be taken to task for causing death and injury to those very animals whom they had sought to 'rescue', through that very dramatic and uncalled for crackdown. This is a matter of great shame for us all. It's sad to see animals being humbled this way...It's sad to see how unprofessionally our cops go about their jobs...It's sad to see that our judicial system has no real consideration for animals. Mr. Aithal did what he thought was right for all those animals. Right he was too. Sadly, his good intentions were misjudged. He must now bounce back to good health, continue with his mission, legalize his zoo and take the guilty policemen to task.

    The person who issued the policemen orders to disrupt the zoo should not be spared either. He is the sole, thoughtless culprit. Mr. Aithal needs all the support he can get, and it is up to animal lovers like us to give him that support. This gruesome and barbarian act should never be repeated. Ever.

    Sir, My heart goes out to Aithal and his dear animal breed which he so lovingly cared for and now the authorities are going to charge him with some offence. Rather than take action against Aithal, it is the authorities who should stand charged against for their reckless handling of the brood of breed that he so lovingly brought up and the irony of irony is that he is now taken to task!! Just look at Aithals innocent face it is full of pain and agony, can’t one see it writ large on his face at the imminent loss of his well cared for and well loved dumb creatures of God.

    I only hope the law enforcing agencies, with their overzeal, have not deprived Aithal of his two front teeth. They can be up to any mischief, these so called guardians of the flora and fauna. It is time they took their task seriously and protect the unprotected animals in the public zoos and forests as their breed is declining to a dangerous proportion. I would rather people like Aithal tookover the care of animals than let them under the care of these forest guards and their superiors most of whom, I am afraid, allegedly prefer to line their own pockets.

    Violating freedom of animals is a sin. Not only Mr. Aithal authorities should shutdown all the zoo. And need to bring all the culprits to justice. Every Zoo keepers whether it is legal or illegal should punished as they they treated the animals.

    Keeping certain animals at home may be unlawful but if it is done with care and love it should be legalised in the interest of the animals. More over Mr. Aithal is not keeping these animals for any business purpose like sale. Only true animal lovers understand the pain of parting with their loving pets. i have full sympathy for Mr. Aithal.

    Two years ago i had driven all the way from Udupi to this zoo just to see the way Aithal used to take care of the animals. Among other issues Aithal used to take care of animals that were victims of accidents in the nearby highway. His zoo was located very next to a beautiful temple and all the worshipers used to visit the small zoo with their children and spent some light moments. I dont accept the fact that he used to illtreat the animals.

    What Aithal used to charge was 2 Rupees, only to offset the cost of feeding the animals which i dont think he would have made more than 50 Rupees a day. It was more of his love for Animals than money. Possibly not enough to pay off these corrupt officials. Did it take so many years to 'catch' a culprit who used to practice his humane hobby? in a fair and transparant manner. I am sure the officials needed a ladder to shoot to fame.

    Justice delayed is justice denied. Unfortunately our state is busy finding the next leader and therefore the local population should drag the guilty to court. At this stage my suggestion is to handover these animals to Dharamsatala zoo than Mysore as we need something of this in our own region and i am sure Aithal would not mind that as i have seen a photograph of Aithal with the renowned Mr. Hegde of Dharmastala who had given Aithal his blessings.

    It is a shame that the authorities are treating the animals in such cruel way ....... so much that some bird died on way to Mysore zoo, some animals abandoned and left to starve........ whereas the privet zoo should have been legalised by granting permission, so that both the zoo keeper and his pets would have had better times ahead.

I personally saw his pets and admired his sincerity in loving each and every animal in his custody. He used to call each & every pet in name & they used to respond in love. He brought these wounded and left to die animals & treated them as his own children.  I owe Mr. Aithal because my Labrador pet brought from his house & he has taken care during its early days.

Should I clap, or waiting someone to slap. Dont worry Mr. Aithal we are there to support and protect you, but mr. Srivastav we will not look back to protest you and recommend to demote you.

    Good coverage by Daijiworld. we should appreciate Mr.Aithal's work against animals that there is some one who is taking care of them. These so called "Police force" need to concentrate on other important task of controlling rowdism,theft,riots,harrassers,animal hunters,sandal thieves etc.

    Sudheendra Aithal is an animal hoarder and the Forest Department did the right thing by taking steps to relieve these animals from their deprived conditions. Aithal kept animals who should be roaming over miles of territory in tiny, squalid pens. All their natural behaviors and inclinations were denied to them. His treatment of these animals to satisfy a twisted “hobby” is abysmal and cruel. Officials should be commended for intervening. Moreover, the pictures of the animals clearly state how badly they were kept. These animals were captured from their natural habitat & kept chained just for human amusement.

    If Sudheendra Aithal would have treated them as his children he wouldn’t have chained them or kept them in tiny cages. No one who truly cares about wildlife would keep animals in captivity for their own amusement and gratification. Above all animals belong in the wild and not in captivity.

    Reading through several comments it seems sympathy is on the side of Aithal and displeasure and anger of the public population on the side of the law enforcers. Now it is time for the public to uphold law in a right way and thus bring about these law enforcers to justice. Some one has correctly said that the law enforcers are quick to catch the animal lovrs and not the those who kil the animals for mere amusement, recreation and game! Come on! Awake! Let not these selfish guys go unpunished for the crime they have committed against those innocent and helpless animals and birds whom they rendered shelterless, without food to eat and water to drink and eventuaolly let them die!!!

    This is intolerable. Cases must be filed against these law enforcers for their negligence to catch the "culprit" in time, there must be some definite corruption involved and being carried on for a long period of time, and now they have not dealt with Aithal but they have acted worse than animals toward these animals.

    I admire the ability of Sudheendra Aithal for his love of animals which he has maintained in his private campus and gave an opportunity to the local people to come and admire the animals. The "Forest" Officers, instead of filing cases against him under several sections of law, must offer him a job in one of the Zoos in India and appreciate his ability to maintain the Zoo all by himself. He has these inherent qualities to look after the animals with great love and affection for them.

    Now these "Forest" officers will take away these animals from Sudheendra's custody and may put these animals in situations which are harsher the situations in the zoos is the proof of this. Some animals are said to have abandoned in Aithal's campus after the raid by the "Forest" officers is yet another proof that they are no better to take care of the animals but Sudheendra Aithal is the best suited person to work in a Zoo.

    The law in itself may be good but it appears that the application of the law and the persons who apply the law do not seem to be well educated! If Aithal was maintaining a zoo at his own campus, it may not have been a work of overnight. It might have been existing for a long period of time. Why the "forest" officers did not know this? If one can read in between the lines, it is not difficult to understand the purpose of the raid in this corrupt world!!!!!

    The way department has taken action against Aithal looks like personal grudge. Is any case booked against the people who is responsible for the death of these animals during the transportation. Is this OK. Dept. should have taken Aithals help for transportation. The person who was taking care of these animal is in jail/custody. Here also again power/politics and sensless dept.

    No human being has any right to cage God's creation. Yes I agree Sudheendra Aithal has unlawfully caged wild animals as per the wildlife conservation act. Care should have been taken first to observe him as to how he was treating the wild animals and then action should have been taken against him, taking proper steps. I am sure this action was take based on some complaint from some people with vested interests. I am a animal lover myself, and wouldnt treat any animal less than a human being. But this is inhumane on the part of the wildlife conservators who took this extreme step.

    They should all be equally held responsible for the death of the animals on the way to Mysore zoo and punshed for that. People of Kundapur wake up and bring help! the rest of the animals and bird abandoned by the wildlife officers need to be taken care of and take these officers to task for abandoning them without their master. This is cruelty people and those officers need to be punished. I know what it is like to abandon one's pet, it is crime against God's creation.

    Someone need to look into this matter and resolve it. All readers who are reading this article please respond immediately and ensure suitable action is taken.

    It is well appreciated that, Mr. Aithal was taking care of the rare animals at his private zoo near UDUPI. However the government officials would have considered to support this unique mission instead of leading the animals/birds towards death on their way to Mysore Zoo. Based on the information given in DAIJI World, Mr. Aithal used to look after these animals as his own children then what went wrong between Aithal and Government officals. Ofcourse the rules and regulations of the government are valued, but this private agency was handling animals as a hobby.

    govt. is sleeping when rare animals are pouched and killed for thier meat ivory and fur.most of them are extinct now. atleast aithal treated them and nourished them. it is illeagal to keep certain animals caged i hope govt. or wildlife authorities concider his good deeds and leave him without much punishment.

    Private zoo or govt zoo ,zoo is zoo but aithal is a poor guy so a chain of cases .People like salman Khan definately escape in deer hunting case ,our law & regulation for peoples who do some thing for there daily food .

    It is very sad that deputy conservator R. K. Srivastav raid on Mr. Sudheendra Aitahl House. Mr. Srivastava has not rescued the animal infact he has killd the animals.What ever he has taken a action is wrong. He wants to get a promotion in his job,he didnt get any othr work he thought he do this job he will get promotion,but insted of pramoting him Karnataka govt should hang him up side down because he has killed birds and animals which Mr. Aitahl had kept in his house.

    Tell me in Mysore zoo how many animals are in good health? who is taking care with Zoo Management do they feed the animals Properly. If you see the animals in Zoo any time they will die with out prper food they stave for thier daily food ? What happend Mr. Aithal has looked after all the animals so well so good health ? Cant belive. Do Zoo will look after this healty animals no way diffinatly Mysore Zoo will kill them Espacialy Mr.R. K. Srivastav.

    Very Sad indeed. I have seen Mr.Aithal taking care of the animals, birds like his own children. Now I dont think without Mr.Aithal's love for them , the animals and birds will take any food!. Why dont the authorities look for other illegal traders!. Why should a simple animal loving person like Mr.Aithal be booked? If anything happens to Mr.Aithal and his dear ones, the Forest officials should be solely responsible.

    The Forest officers were probably technically correct. However, in this case I guess their ego has cost the animals their life. I guess they could have served him a show cause notice rather than behave in such a abbrassive manner. After all, Mr. Aithal could not have run away with those animals nor was he hiding anything. The forest officials themselves could have witnessed his care as his mini-Zoo was open to public and took necassary steps by taking Mr.Aithal into confidence. What a shame the law enforcers themselves did not understand the spirit of law while enforcing it. And look how they took care of those animals themselves.

    Well. I understand Forest Dept. is made to protect the animals as well as the forests. Is it mean even to arrest those who takes care of them more than his own children? Can someone expalin to me what is the real purpose Forest Dept. when forests are being cutdown for timber trade. Is that fine because Government has given OK? Or if Government can do whatever they like and it is legal though it is illegal? Goevrnment should have honoured Sudhendra Aithal for taking care of these animals which also gives opportunity to many to see these rare animals. Government may be thinking that they are the only people who can take care of the animals in the zoos even if the animals become skelatons without any proper food and care.

    First offall I thank to daijiworld.com .and I would like to say some thing in my mind about Aithala. These days some people are killing the animals for various perpose, and talking bad about animals. There is few guys now who take care animals like Aithala.

    If he is open the zoo for the perpose of money is illigal, if he opens the zoo for his love with animal its not illigal as per my knowledge. Department must think before they put case on him.
