Mangalore: 'Flat' Violation of Law: No Muslim Tenants Allowed Here!

Mangalore, Nov 2: In a clear violation of the country's Constitution and law of the land, a flat owners association in the city has resolved that individual owners in the apartment complex should not lease or rent out their flats to Muslims!

A report by local Kannada daily Vartha Bharathi states that as per the notice pasted at Prasad Apartments, Bendorewell here, Prasad Apartments Owners Association has requested its members not to rent or lease their apartments to Muslims.


'6. Members are requested not to let their flats to Muslims on rent or Lease'

This stricture is among the list of resolutions purported to have been passed at the meeting of the owners association held on March 20 this year. The condition is listed as the sixth of the seven resolutions reportedly passed at the above meeting. This particular condition has been underlined with red ink to ensure that the owners take note of this particular condition without fail.

While complaints which came in from various parts of the country so far including Mumbai spoke of oral, unwritten diktat against sale or letting out of flats to people belonging to certain communities, this particular association has gone a step ahead, by publishing the resolution passed at its meeting on its notice board.

The incident, which has come to the fore in a democratic republic which is backed by the aim of providing equal status to people belonging to all castes and religions, is shocking to say the least. The notice continued to be in the notice board for about eight months till now, and surprisingly, no one has raised an objection to this illegal resolution so far.

A few lawyers from the city, who were contacted for their opinion on the above incident, said that Indian Constitution clearly forbids maltreating people on the basis of their religious or other affiliations, and that giving rise to communal hatred is a crime under various laws. The police commissioner also reiterated this view, and said that the policemen will take legal action if they receive complaint about the same.

    Though it is not right to single out a community as a whole and punish each and every member just because they belong to that community, I do see the same trend being practiced in an entire state.

    - Can non-Muslim living within the Union of India buy property and live in the Kashmir valley?
    - When non-Muslims who have been living in Jammu long before the arrival of Islam have driven out of their homes and ancestral lands just because of their religion and have not been allowed to return, thereby languishing in refugee camps?

    Remember always treat people the way you want to be treated.

    Blame game is easy and introspection is wise thing.
    When we hurt others, it does not pain us, But when others hurt us, we never forget it.

    If a particular community or people of some profession are not allowed by the housing society to sell or rent, it is the society decision. If one cannot manage a particular person, better not to give entry and take unnecessary additional problem. Prevention is better than cure.

    As per my opinion Prasad Apartments Owners Association has violated e country's Constitution and law of the land by mentioning a particular religion is not welcome which is not healthy. They should have drafted the resolution wisely without hurting any particular community.

    Hi guys, no surprise for me. These flatowners are doing this publicly. one of incident happend in Mumbra (mumbai). i was trying to book apartment. in fact mumbra is muslim majority area. i was told by the buiders that all the apartments have been sold. 2 days later 2 of my colleague they are muslimms got booked in the same building. then i came to know that they are selling the flats only for muslims. but no one bothered about this. Good luck

    This might be a first for our city of Mangluru, but very common in Metro cities. It is a private decision, though totally against the law. But, if it serves the purpose of the society/community welfare then nobody can stop it. There are valid reasons for this which everyone knows but are acting innocent!! Forget about this a famous actor like Emran Hashmi was refused a flat in a posh society in Mumbai. What he could do was only plead in the courts. People should think with an open mind and reason out why this is happening!!!

    I think this is Flatowners decision, since it is his own property he has the full authority to whom he want to sell or rent. If it belongs to government property then the constitution law is applicable. it seems that some bitter experience may be the reason to take this decision collectively.     I strictly believe that all Indians have a fundamental right to own/rent a property in any place we wish to say but unfortunately the truth is different. With this incident the message is very clear and we cannot refute the fact that most communities would not prefer to lease their property to this particular community.     I have myself faced similar situations in mlore where flat owners refuse to rent out their flats on simply knowing my religion, a faith which i'm proud of for the fact that it is an obligation to be loyal to the country. A religion where faith is strengthened by fighting for the rights and safety of fellow countrymen. A religion where ur faith in it is reflected by the way one treats his neighbours.
    And today its sad to see such incidents occuring among educated people. When such people fail to realise that holy scriptures of all religions do not approve of such hatred then how do v expect them to follow the constitution.
    My sincere request to people of mangalore to come forward to take action against such discrimination.

    Daiji World thanks for bring this to electronic media, now this info spreads like fire, well DW please shed some more light on it by finding out who is the real people behind this resolution, so we can talk to him and show him that there is a world beyond his knowledge where all religions live together peacefully for centuries e.g middleeast, Arab Muslims and Arab Christians and now all people from all countries come here to d business, job etc. Most of the real estate developments, educational advancements of NRI's leaving in Gulf finance them from their earning from Middle east which accounts to more than 66%. So the people who buy these so called flat owners may be NRIs residng in Gulf sharing homes with Muslim brothers. Well i personally feel like avoiding such sick mentality people and stay away from them as far as possible. What a shame to me and to those who wish not to let their homes to lease me.

    Human being a social animal.This is what i learn in my school.Once i was reading article from Shabana Azmi who is liberal lady who is born and brought up in Mumbai in atmosphere where she didnt taught much about religion related practices.well,when she was hunting for the flat in Mumbai she everyone was debieing just because she belongs to minority community.A celebrity like Shabana Azmi had facing such troubles to get a flat in one of the capital city we can imagine and conclude how ordinary man in village where people are conservative could react.We all are Indians and all Indians are our brothers and sisters.The people whoever has issued such notice should be boycot by the society around in order to avoid hatred and create brotherhood and prosperous India.These are frogs in the well and millions of people are living in abroad like Gulf and Western countries as expatriates who are renting flat from Muslims and Christians.I felt so bad when I comes to know about the subject.Few People in my hometown are still blind and communal.May God open their heart to love the people around them..

    In this case, the building owner legally avoiding other religion through a notice. But, many of the times there will be just a verbal communication. Here in Gulf, the building security guard allow only ed nationalities. This is everywhere.

    In India even though we think all are equal and same, in actual it is not like that. why because our constitution is providing law based on the caste. for example one community can marry many and have as many as children's and other should marry only one otherwise its against the law. This differences in the law will result in social imbalance like after some years the minority will become majority and our country will become a Muslim country like Indonesia.

    As a developed country we should have a common law for all its citizens irrespective of the cast. The people who are financially backward and lack of education and employment must be considered as minority and provided all facility from the government irrespective of Hindu , Muslim or christian.

    So my only wish is that as a developing country all Hindu, Muslim and Christians are brothers and should live together with same status and loving each other. Whoever is backward should be considered backward class and all additional facilities must be provided. Until these things happen, the issues like above will keep on happen and no use of worrying.

    I advice Muslims not to buy or lease a flat in that building because it is in a real bad shape and not worth staying there.
    There are cases where all the occupants are vegetarian and they avoid giving it to any non-veg buyers that is justified.

    Muslim's play their major role in building Mangalore's economy. Look at the festival season or marriage season, they are the highest consumers in Mangalore Market. As my friends said all the top five builder's in Mangalore. They are the flow in economy and restricting them to take flat on rent or liese does not stop the flow, instead the builders or owners are at loss! This news might have already reached to DC and SP. Why they do not take action against these owners association and bring them to sense. Integrity of human relation is very important in Mangalore to improve the relations in soceity

    Dont want to mention the name of the person living in Prasad Apartments, Bendorewell , but the fact is me and my friend during 2009 December. We the Muslim brother have donated blood to the peson who is admitted in city hospital, and his mother in need of (O ) blood. and also we arranged other friends to come and donate the blood to her. Thank God his mother is living healthy life now.
    When a non-muslim can share his blood of muslim brother or sisters, why dont they live together with harmony and peace.!!

    This sort of discrimination is widely prevalent in Mumbai where certain communities do not allow certain other community members to lease or even sell flats, but this is done tacitly. Mostly pure vegeterians would not like to have non vegeterians in their buildings. The recent famous case of actor Emraan Hashmi being refused a flat in a prominent housing society. However, he moved court and won the case against the society.

    None to lose from this policy but the building owner himself because the tenants who are not welcomed by him will go to Vishwas Bawa Builders ?

    May it be business or politics, the more neutral we stay the strong we grow. For example BJP, a party represents the majority, who are over 80% of India's population, is influenced by RSS/VHP. How many years did they rule the country ?

    See some Middle Eastern countries - they operate on Sharia Law but clubs, alcohol is permitted there. Their principle is 'its forbidden for us but not for our guests who give us the revenue out of which our country progresses'

    One example of shrewd businessman is Shri Narendra Modi. He refused a cap and shawl from Muslim brothers but did not forget to ask Haj Pilgrims from Gujarat to pray for the state (that gave them support to go on the pilgrimage). Not one pilgrim retaliated !

    There are bad apples in all communities but distancing from the complete community will deprive us of certain benefits. If this isn't the reality we would not have had a very respected ex-President or present vice-President to name just two.

    This reminds me of the British diktat -Indians and Dogs not allowed. While we can talk about rule of law, deeply held prejudices cannot be overcome by rules and laws. This can only be resolved over a long period when communities integrate well in a pluralistic society. Media should not make an issue by taking a one sided view of this prejudicial issue.

    Dear friends, this is perhaps the extreme the religious extremists (I do not want to name them) can go in perusing their fundamentalist agenda. What happens in housing societies is that there are very few people who want to shoulder administrative responsibilities, which offers an excellent opportunity to extremists to have their say in the running of such societies.

    Ordinary members of the society do not utter a word of disagreement against such unethical strictures. Just as it is the moral duty of moderate Indians to enter politics and vote without fail, it is also the responsibility of moderate flat owners to take up responsibilities in running societies to suppress such irresponsible and atrocious behavior of extremists.

    It is sad that just because of some misguided individuals a whole community is being painted black. This situation also exists in Mumbai unfortunately, however, it is unwritten here. The reason why people are afraid to complaint or raise this issue publicly is because they know that those spreading communal hatred are certain that the government of the day who tacitly support communal alienation will not take any stern action against them.

    Action taken if any, is only cosmetic in nature and the offenders are quickly released on bail. Sad state of affairs in our country. Some people are determined to divide this country on religious lines. It is time a person like Anna Hazare includes the fight against this evil in his agenda sooner rather than later because our faith in the government to fight against this menace is virtually non existent.

    This apartment might have built by assistance/labour hiring from muslims for works like brick supply,cement supply,plumbing work,masonary work,electrical work etc.,But flats can not be rented/leased out to muslims.Looks very strange.

    In Kerala,in Malappuram dist which is a muslim populous dist in the country, in Hindu house hold there is one Manager known as 'Karyasthan' who is a Muslim by and large.Like wise in every muslim house where ever there is a 'Karyasthan' he is a Hindu. Karyasthan is the most confident worker/manager of that house and he has eentry even to the kitchen of the respective house.

    I have a personal experience while I was in Malappuram.The street where I stayed for nearly three years in Manjeri town was a brahmin locality and there was a 'Samooha Madom' means community centre. Every year during Ayyappa vratha season Thulasi laksharchane being performed there. Nearly Rs.10000/- was being collected for the purpose. Out of the total collection nearly 75% collections were from muslim contributions. There are number of instances like this in the coutry inspite of disturbing news we hear occasionally.

    When Kargil war was broke out some year back,and when even the Pakistani cricket captain accused our national pride Tendulkar whole country came together irrespective of cast, creed, color, religion to condemn Pakistan.

    Every body has his own views. However ,what is being heard above is really condemnable.
    Indians are simply superb,let us live to it!

    Completely unacceptable! It is bad enough that the unstated 'dikat' prevents Muslims from assuming legal tenant ship, now they have that stated as part of the association by laws? Where are we living? In Hitler's Germany?

    The irony is that large blocks of real estate is being purchased by the newly wealthy Muslims returning from the gulf. These very same narrow minded people are perfectly willing to sell their property to Muslims when they see the money.

    Prosecute these people who openly flaunt the law of the land to the fullest extent. Let us all live in harmony and not like in the by gone dark ages.

    The promoters, who has issued this particular notice should be penalised, they should be behind bars. A huge amount of fine should levied. Government should take legal action against them. They must have forgotten the creator of the world, they act as, that the base land on which the apartment is constructed has been built by them. Shame on Indians!!!!!!!!!!!

    A recent circular issued by Muthoot group have now courted controversy because of it's Talibanic nature of strict warnings in the name of dresscode, which has been posted in one of the Malayalam website. (http://www.scoopindia.com/showNews.php?news_id=18855)

    Attached the circular which is of self explanatory. The circular bans Hindu lady staff from wearing bindhi and sindoor which is of religious significance and also prevents staff from having sandalwood paste or Rakshabandhan.

    It is up to Hindus to decide whether they still want to run to their nearby Muthoot branch to submit their Gold valuables or to have any business with them who thinks such Hindu symbols are anathema to their business.

    I think such discriminations based on relegion and class of people are quite rampant in Mangalore, and should be fully condemned. There is one society which I know terminated the services of the watchman, for his wife was watching too much TV, and it was felt that the society could not afford the electricity bills. An NRI who moved in to his house in a society was told his pet dog could not be with him, and he had to find a pet care to look after the pet which was expensive, and later he bought another apartment. Another issue was the children were noisy when they used the lift, and the parents were warned frequently. The worst is being discriminated because of religion. There a number of societies in Mangalore who practice this, but perhaps do not put it in paper. Shame on them

    In mangalore, it tend to occur because of communal divide over various reasons.I don't think builders or aspiring flat sellers segregate such kind of customers.Because flat abundantly available in Mangalore or any metro cities.In fact Muslim builders and flat sellers are equally available in such circumstance.In rural areas also have some restrictions in selling their properties to opposite community for complex reasons.

    The issue here that also in the city like Mangalore is not augur well for democratic country like India.The misconception or the reason well known for them not conducive for secular country.The said flat owner's association land in jail for publishing such a anti- constitutional material.

    I think Daijiworld should contact the President of Association and find out the reasons for such notice. Before passing resolution normally discussion takes place in Associations. May be a particular incident might have prompted them to put such notice and may be Association is not aware of Law. Ignorance of Law is not an excuse. But when chief Minister himself is breaking the law without ignorance, we have to forgive the Association, provided they don't have hatred towards particular association instead of creating communal tension.
