Mangaluru: Sick senior citizen Salvadore under 'house arrest' for no fault of his

Mangaluru, Jun 27: As a legal procedure, we know about the concept of house arrest, problems associated with it and consequences. When it is enforced by legal authority, it comes with its own set of rules and regulations and is dealt with in tune with the law of the land concerned. Except by the order of the court, no one else has the right to confine any other person inside a building or house, as it is tantamount to house arrest. But Salvadore Nazareth, a resident of Kuntikula, Neermarga here, has been in a house arrest-like situation as a private party has blocked the path to his house, thereby depriving him access to the only means of maintaining contact with the outside world.

18 years ago, Salvadore Nazareth bought a piece of land from a person at Kuttikula, near Pedamale which is located within Neermarga village. At the time of purchasing the land, there was an agreement between Salvadore and the seller that the purchaser would be vested with the right to use a road which connects the property concerned with the outer world. After purchasing the land, Salvadore constructed a house on his land and was using the said road to access his land and house.

After few years, the seller sold the remaining portion of the land, which surrounds Salvadore’s house. After purchasing the land the new buyer immediately installed a wire fence, duly blocking the path that connects Salvadore’s house. After the intervention of locals and relatives of Salvadore, the new buyer allowed Salvadore to use the walkway. Experiencing difficulty while bringing vehicles and things to the house many times, Salvadore expressed his willingness to sell his land to the same buyer. But he did not show any interest in Salvadore's proposal.

In the midst of all these hassles, all of sudden, the individual installed more rope walls last month thereby blocking the path which Salvadore was using. Since the last one month, Salvadore has been living in the same house like a person who is under house arrest as he is unable to come out of his house. Till some days back, his relatives used to bring grocery items for him but the new owner of the adjacent property warned them against using his property for supplying things to Salvadore. After his relatives were asked not to access the land of his neighbour, Salvadore himself is compelled to jump over the rope wall once a week to bring groceries and other items for his survival.

Speaking to Daijiworld, Salvadore said, “I am 60-year-old now. My children are living abroad and I am alone at home. Last month onward I have been facing house arrest-like situation and am unable to move out from my house. The private person who has acquired the adjacent property has blocked all ways of access to my house, which connects Pedamale junction. He dug the soil of the path and blocked it with aluminium sheets. I do not want his land. I am just requesting access to the path and entry of vehicles which I normally use to go to hospital.”

“As per law, blocking the movements of a person, that too an elderly man, and confining him to one place is an offence. This is a senseless act by the individual who has been defying humanitarian values. Local people's representatives and the administration should intervene on this issue immediately. The current situation poses danger for Salvadore's life because he is living alone and suffers from many health issues,” says a neighbour.

    This is the reason now universe is filled with sins . I have seen in my brotherhood declaration , forcibly enrolling property etc by our loved ones . On the power of money .     Uncle is soft spoken hard working guy
    They used to visit us and we were going to santmari and me bro VV used to enjoy .
    Last time VV came and we enjoyed a lot and he promised next time please visit .

    Anand Moras Bajpe If you are really worried about your uncle,why dont you take legal help for him.He cant go outand alone.Insist some friends and relatives to do this.:Seller had duped him.Now they make him to sell his property for less money .Thats the trick ,knowing he is alone.One shouldnt give up easily.Cant one as neighbour think and make his way easier?When want yes.when his papaers are clear ,why one must fear.wish him luck.

    I feel sorry for Salvatore who is a sick senior citizen. When you bought the property, you should have taken a notarized statement from the seller. But in any case you will win and you will be able to go in and out of your property.

    It looks like this is declaration plot .
    He should check records first. Then d file a Prima facia complaint in nearby police station for illegal encroachment as well as possession of public property. Before that should consult property experts or advisers

    I really do not know the veracity of this case and hence very cautious of giving any comments, since this is a legal matter. People give their comments according to their knowledge, understanding or feeling pity for Salvadore due to his inability as well as physical problem. Genuine lawyer will guide properly in this case and bring a resolve.

    In all probability, if Salvadore's neighbour is willing to give way on mercy grounds and understands the true meaning of 'Love Thy Neighbour', all the gates of peace and happiness will be opened for both the Neighbour as well as Salvadore and they will live happily forever!!

    The main issue for this is " Declaration " sites

    . Because of legalisszing these during Indira Gandhi prime minister tenure , many lost path ways to their house . The aftermath effect is coming now .

    Many dont have path to their plot or site. Even my bro got around two acres of land at Padil from declaration during the period . It was difficult for him to go the plot because pathway was blocked and restricted by neighbour. Finally my bro purchased pathway for a vehicle to pass his plot and now he is happy. Whenver he goes to India he frequently visits his plot or site with his friend and see the progress in the plot. Once he cleaned the plot , but because now the plot is not used he kept as it is.
    Thank s to my bro and the neighbour who sold his plot to brother for his walkaway or plot

    It’s fact that during olden days by bribing surveyors documents processed . During those days everything was manual and records were stacked even on roof huts of the panchayaths.
    Even now records are computerized and digitalized all old records we can see in the computerized .

    True Mr Abru CN. There will be some records with the neighbour Which prohibits the path to access the house of the deceased .
    Otherwise he is not dared to close public pathway .
    I am sure there is something fishy in the plot records !

    The seller of the property should be sued as he is suppose to keep enough pathway for the
    next plot or earlier sold plot to venture out.

    Why only seller to be sued? how panchayath officials measured the land when one house isstanding inside that land?? how they going to issue them 9-11 document ? how they can prepare a sketch of a land, how their RTC will be?

    Can anyone tell how much under table money taken by panchayath officials here?

    All the real estate agents in and around the city and also the district probably are just behind making money and fooling people.
    One should be very careful and verify the documents from experts. Otherwise, there is a high chance that one will have to face difficulties like this in future. Moreover, a normal human being builds or buys house only once in life time.
    Hope Lord Brahma will open the eyes of the neighbour of Salvadore and he will live happily in future.

    Access to a property is a very tricky mater. Mr. Salvadore should have ensured that right-of-the-path is mentioned on the sale-deed when he purchased that piece of land. No word of mouth works when you go to fight for justice. The seller is at fault for selling the piece of land without giving legal access (path) to the land in writing.

    The seller is also at fault for selling the remaining land to somebody else along with the piece of land that is supposed to be a road to Salvadore's land. How did the corporation approve the sale deed without verifying if it includes some other property's access ? If it was about leaving set-back to future development, would they have ignored that part ?

    Let his children come to his rescue, help him in legal matters. They are abroad is not a reason good enough. When Salvadore will clear out all hurdles they will appear to ask for property share ?? He should give away the land to an old-age-home and live in the comfort of a home there. Then the children will understand the value of a own property.

    These things happening around Mangalore, when i approached a lawyer for one of my christian friend lawyers answer stunned me as he says 75% of land, road and path way issues are for Christians only !!

    Where ever you go infighting between communities for giving way issues.

    Only one thing i could not understand even after panchayath issue a 9-11 document showing road to site also people having problem of road and pathway...

    I'm grateful if daijiworld can put some light on land issue, related documents requirement etc...

    requesting daijeeworld to highlight exact rules and regulation of road or paths in private land and its access and the role of gram panchayat in solving the issues
