Marriage of Hindu woman with Muslim man not valid: Supreme Court


New Delhi, Jan 22(PTI): A marriage of a Hindu woman with a Muslim man is not a “regular or valid” but the child born out of such wedlock is legitimate, the Supreme Court on Tuesday. It also said that the legal effect of such an irregular marriage is that a wife is entitled to get dower but cannot inherit the husband’s property.

The court held that the child born in an irregular marriage is legitimate just like in the case of a valid marriage and is entitled to inherit the property of the father.

A bench of justices N.V. Ramana and M.M. Shantanagoudar upheld the order of the Kerala High Court by which it was ruled that the son of a couple — Mohammed Ilias and Valliamma (who was Hindu at the time of marriage) — was legitimate and was entitled for share in his father’s property according to law.

“We conclude that the marriage of a Muslim man with an idolater or fireworshipper is neither a valid nor a void marriage, but is merely an irregular marriage. Any child born out of such wedlock is entitled to claim a share in his father’s property,” the bench said.

The top court while dismissing the appeal against the high court order said that since Hindus are idol worshippers, which includes worship of physical images or statues through offering of flowers and adornment, it is clear that the marriage of a Hindu woman with a Muslim man is merely an irregular one. It was hearing a property dispute matter in which Shamsuddin, son of Ilias and Valliamma, claimed share in the ancestral property through inheritance after the death of his father.

It said “the legal effect of a irregular marriage is that in case of consummation, though the wife is entitled to get dower, she is not entitled to inherit the properties of the husband. But the child born in that marriage is legitimate just like in the case of a valid marriage, and is entitled to inherit the property of the father.”

The court said that on other hand the effect of a void marriage is that it does not create any civil right or obligations between the parties and the children born out of such wedlock are illegitimate. The bench said that under Muslim law, a marriage is not a sacrament but a civil contract and there are three types of marriage — valid, irregular and void.

“A void marriage is one which is unlawful in itself, the prohibition against su-ch a marriage being perpe-tual and absolute. An in-valid marriage is descri-bed as one which is not un-lawful in itself, but unlawful for something else. .(like absence of witnesses),” the bench said.

    The dispute was about the inheritance of the child. There was no judgement on whether Muslims or Hindus shall marry or not. It's the personal choice of individuals. SC just said legally wife cannot claim the right to inheritance.

    As far as Islam is concerned, it is not permissible to marry idolator, but if someone do marry it's matter of disobedience to Allah , which he will decide on the day of judgement but it was nowhere said in Quran that if someone marry idolater, the wife and children are not eligible for the inheritance.

    Hence the supreme court judgment could have added to mandate wife's right as they rightly did for the child.

    Thank you SC for such magnificent verdict. You have followed sharia law. As per sharia A MUSLIM MAN CANNOT MARRY A HINDU GIRL (IDOL WORSHIPPER). IT'S AGAINST OUR Aqeeda. He can MARRY OPTION FIRST Muslimah, then jew or Christian(as Muslim, jew and Christian are of abrahamic faith) other than this Muslim cannot marry a polythiest. It's HARAM.

    Indian personal law is very complex, each religion adhering to its own specific laws.
    Separate laws govern Hindus including Sikhs,Jain's and Buddhist,Muslims, Christians and followers of other religions.
    The exception to this rule is in the state of Goa, where a uniform civil code is in place, in which all religions have a common law regarding marriages, divorces, and adoption.
    Therefore, inter caste marriages issues are very complex, common citizens are unable to understand it's impact to their marriage, child's rights and inheritance. For them LOVE is blind!

Mrs Tanvi shet didnt changed her name as per nikah nama as Shazia anas..Passport officer asked the same, she created an issue & officer got transfered..is she still Hindu or mulism!..she has to take right decission now..or else..

    thats why parents/society opposing particularly this kind of interfaith marriage. still TTL/Polygamy not banned which is ruining lives.now this judgement came has harsh reality. on one hand it supports interfaith marriage, says no need to change name but now risks women & kids rights... supports live in relationship, says adultery no crime but says will be ground for Divorce!!

    I love this saying by Jesus Christ so very much that it always close my heart..
    'Be innocent like a child to enter the kingdom of God'..
    A child born does not know to which caste he belongs...!
    He is "educated" later on and among other things 'branded' depending on his caste!!
    So much educated that he also is part of these " Nonsensical Laws" and "Judgement" that are passed time and again passed now even on "Caste Basis"!!
    Where will all this "Legalities" end..God only knows...
    Now being innocent to reach God means..."Un-learning what you have learnt all your life"!!
    Tell me ..Is it possible??

    Inheritance is based on religious laws in India.

    Like Mohammadan law, Hindu Succession Act etc.

    These laws have different basis of inheritance and hence contradicts when two individuals of different religion marry each other.

    That is why better to have common law to avoid these issues or for at least in case of marriage of inter religion. Otherwise justice will not prevail to aggrieved.

    The question of inheritance comes after someone's demise as per Islamic Law.
    A Muslim man give one third part of his property to anybody as per his will and wish when he is alive.
    So whoever is in "irregular" marriage as per Supreme court's verdict, now may opt for this provision to safeguard the wife's right.

    Yes. (1) If somebody has adopted/sponsored a child; (2) Married a woman from non-muslim (3) would like to give part of the property in charity, in such cases a Muslim can write a will for maximum one third of his property. Remaining two third will be inherited by legal heirs.
