No need of JPC on Rafale after apex court verdict: Akhilesh


Lucknow, Dec 15 (IANS): Samajwadi Party (SP) chief Akhilesh Yadav on Saturday said that his party has given up its demand for a Joint Parliamentary Committee (JPC) probe into the Rafale deal after Supreme Court verdict in the matter.

Yadav said at an event here that SP had demanded JPC when the apex court had not given its judgement.

"But now the Supreme Court verdict has come and it has looked at all aspects. If someone has to say something in the future, then the doors of Supreme Court are open," he said. 

"There is no bigger court than the Supreme Court and there is nothing bigger on which people have faith," he added.

The stance of Samajwadi Party is at variance with Congress which is persisting with its demand for JPC into the Rafale jet deal with a French company.

Yadav's remarks have come at a time when efforts are being made to bring opposition parties together against the BJP in the 2019 Lok Sabha polls. The SP has offered support of its lone MLA to Congress in Madhya Pradesh after the Assembly elections.

    The allegation that this contrived deal has been struck only for the purpose of giving large commissions to Anil Ambani’s company in the guise of offset contracts still needs to be investigated. One should understand theThe Supreme Court’s judgment is thus by no means a clean chit to the government on this deal.

    The SC order dismissing petitions challenging Rafale deal is a curious one. It says SC has no jurisdiction to examine sensitive defense deals but goes on to pronounce it didn’t find procedural lapses. Strange are the ways of the Supreme Court. It first admitted a batch of petitions praying for a court-monitored probe in the Rafale deal. It then declared that it would examine if it had jurisdiction to examine a sensitive defense purchase deal. Thereafter it called officials of the Indian Air Force to the court to brief it on defense preparedness of the Indian Air Force. And, finally, it concluded that

    1. From the standpoint of jurisdiction, it is not for the court to examine the feasibility, pricing, technical aspects etc. of the deal. That there are limits to judicial review and national security is a paradigm which the courts regard themselves as incompetent to investigate.
    2. The court also stated that it is not for the judiciary to examine the wisdom of purchasing 36 planes and not 126 as contracted earlier
    3 And it is not for the court to examine pricing of the planes
    4. Had the apex court stopped there and dismissed the petitions, eyebrows would not have risen. But for reasons which are not entirely clear, the Supreme Court also went on to rule that
    5. There is nothing on record to suggest any commercial bias in favor of one Indian company.
    Since the earlier deal was not coming through, there were compelling reasons for a new deal
    6. The court is satisfied that there were no procedural flaws.
    7. This has been interpreted by the BJP and the Government as a ‘clean chit’ by the apex court. But surely the court could have asked for a time-bound inquiry by the CBI or the CAG to answer the following questions:
    1. Did the PM of India have the authority to decide on a defense deal on his own in April 2015?
    2Was the cabinet’s approval obtained after the deal was announced?
