Do not hurt religious sentiments, Kerala HC tells activist Rehana Fathima after granting her bail


Kochi, Dec 15 (PTI): The Kerala High Court on Friday granted conditional bail to social activist Rehana Fathima, who was arrested for allegedly posting controversial remarks on Lord Ayyappa devotees and Sabarimala on social media.

Granting the bail, Justice Sunil Thomas directed her to furnish a personal bond of Rs 50,000 along with two sureties for the like amount.

She was also directed to not enter the Pamba police station limits for three months and not hurt religious sentiments of other communities.

Fathima (39), who unsuccessfully tried to visit the Lord Ayyappa temple in October, had submitted that the Constitution guaranteed freedom of speech and she should be granted bail "in the interest of justice".

Fathima is an accused in a case registered by the Pathnamthitta police for offences punishable under Section 295A of the Indian Penal Code (Deliberate and malicious acts, intended to outrage religious feelings of any class by insulting its religion or religious beliefs).

She had allegedly posted some pictures on her Facebook account and written her opinion which hurt the religious sentiments of Lord Ayyappa devotees.

Fathima, a BSNL employee, was arrested from her office here on November 27 and remanded to judicial custody.

Her bail plea was rejected by the judicial magistrate at Pathnamthitta earlier.

Fathima had courted controversy when she attempted to trek to Sabarimala, along with Hyderabad-based journalist Kavitha, during the 'thulamasa' puja in October.

The Supreme Court had on September 28 pronounced a verdict permitting women of all ages to offer prayers at the Lord Ayyappa shrine.

    Kannada word "Sundari" means Beautiful , and Arabic word "Jameela " means Beautiful.
    Both names are being used by respective religions while naming ceremony of children.

    So, we cannot conclude who belongs to which religion with their names. Everyone has their own choices.

    TEMPLE VISITS TO BE RESTRICTED TO THE PRACTICE FOLLOWED OVER A PERIOD OF TIME AND NO COURTS NEED TO GET INVOLVED IN SUCH MATTERS WHEN THERE ARE CASES IN LACS SEEKING SOLUTION ARE PENDING BEFORE THE COURTS. COURTS MEANT FOR GIVING SOLUTIONS BUT NOT FOR CREATING PROBLEMS. SHABARIMALA ISSUE HAS CREATED A LOT OF PROBLEMS UNCALLED FOR .

    I am confused when the Supreme court instructed her not to hurt the sentiments of "other communities".

    My question is why only "Other communities"?; Why not "Any community"?

    My second observation is- As she has called herself a devotee of Ayyappa swamy, she is no more a Muslim. So she is hurting the sentiments of her own religion?

    My next question is- What if the followers of a particular religion are practicing something that is against their own religion. What is considered as the religion by the Supreme court? Is it the religious practices of the followers or the original religion itself?

    Better ask the followers of the religion. I don't feel like commenting on about who wrote the other religious books. But I have complete faith that Islam is the religion prescribed by the Almighty to all human beings; and The Quran is the collection of verses revealed by the Almighty Allah.

    There is no conflict in Islam. Because we follow our religious scriptures in case of any conflict; and women are allowed to enter the masjid for prayers according to our scriptures.

    What does your scriptures say? Allowed or not allowed? Please explain why
    Is the conflict.
