No reason to doubt process: SC dismisses petitions for CBI probe into Rafale


New Delhi, Dec 14 (DC): The Supreme Court on Friday junked petitions seeking court-monitored probe into the Rafale jet deal saying that there was "nothing questionable" in the decision-making process and the bench was not competent to go into the question of pricing and the choice of offset partner by Rafale manufacturer Dassault.

A bench headed by Chief Justice Ranjan Gogoi said it "sees no reason to intervene" in the defence deal as the four petitions sought a court-monitored probe into the deal for 36 Rafale fighter jets in a fly-away condition from Dassault Aviation.

The Centre had defended the deal while admitting that there was "no sovereign guarantee from France, but there is a letter of comfort..."

The petitions seeking the probe were filed by Prashant Bhushan, Arun Shourie, former Finance Minister Yashwant Sinha, advocates M.L.Sharma and Vineet Dhanda, and AAP lawmaker in Parliament Sanjay Singh.

    Some folks here mentioned about CAG audit. In fact, because it is a government-to-government deal without any middleman, it is subject to CAG audit in both the countries and hence, there is no scope for corruption. Compared to China, HAL has been slow in developing indigenous, 4th or 5th generation aircraft that would meet IAF specifications not to mention, the IAF fleet is running low on the aircraft inventory both for the current and future needs. So, the government had to tap in private sector to build that capability and not just rely on HAL for all the needs. In USA for instance, major suppliers of fighter aircraft to the airforce are private companies. They developed that capability after decades of research and development. Unlike China, India never stole any technology from other nations. Only relied on technology transfers. No high tech aircraft vendor such as Rafael will transfer their core technologies to another nation. The SC rightly consulted the IAF and other technical experts before coming to a decision. Sure, Mr. AK Anthony, the previous defense minister was not corrupt, but looks like he delayed decision to sign 126 aircraft deal and then prime minister Dr. Singh was not strong enough to press for the deal since they were already dealing with 2G and other serious allegations.

    Very disappointing Judgement of the Supreme Court saying that there is no need for the court to order an investigation into Rafale deal. The Supreme Court says price seems OK on basis of govt's sealed cover, which was not shown to the nation. On the day when SC dismissed 4 petitions demanding an investigation into the Rafale deal. ‘The Caravan’ has published a sensational expose saying that Rafale jets price was increased by PM Modi himself from 5.2-7.8B Euro.
    The Supreme Court also accepted govt claim that selection of Ambani as offset partner was done by Dassault and the government has no role in it, despite the fact that defense procurement procedures and offset guidelines require that all offset contracts must be approved by the Defence Minister!
    The Supreme Court also accepted govt's claim of the procedure followed in Modi's Rafale deal is OK, though the rules require AF to give a requirement of planes & then DAC to approve them. Here, Modi himself ordered 36 aircraft in the Ambanified deal through Air Force needed 126 & DAC required TOT & make in India.
    The SC also takes note of the govt claim that Dassault had been seeking an agreement with Reliance since 2012(to suggest that Modi had nothing to do with Ambani's selection)that Reliance was a Mukesh Ambani company, and offset contract was given to a new&bogus Anil Ambani Co!
    This isn't the first time when the SC has failed us in ordering a probe in cases of high-level corruption. In the Birla/Sahara case, where IT& CBI had recovered docs showing large payoffs to politicos which tallied with their books of accounts, SC had also refused to order a probe.
    The primary duty of the Supreme Court is to ascertain whether the laws are executed and obeyed properly and to see to it that no person is deprived of justice in any court of law.
    1. The judiciary of the SC which is supposed to be transparent has rejected the four petitions on the basis of 'sealed envelope'?

    By this verdict you have indirectly diverted LSpoll voters to Rahul's/congress side.Rafaele deal issue was the wildcard for Rahulji to highlight and Ram mandir issue and oldcity naamkaran was all cherry ton top of congress cake.

    As per the Supreme Court there is no fault in the PROCESS followed in the Rafale deal. But while giving judgement the Court also said comparing the PRICE or going through the PRICE is not their business.
    The whole Rafale scam is about the price involved in the deal and if the price paid is excess where that money is gone.

    Without take any sides, I would like to state that the petitioners Yashwant Sinha, Arun Shourie, Prashant Bhushan and others are all educated and responsible persons with unimpeachable integrity.
    I have no doubt in my mind that before filing their petition, they must have perused the case in great detail and only after being convinced about the authenticity gone ahead. Knowing their background, they would never have filed the petition in the event the case was on shaky ground. It, therefore, comes as a great surprise that the Court has dismissed the case.

    I have no knowledge about what must have gone through the Judges' minds before delivering such a judgement. However, I do dare to say that in case they have yielded to pressure from any quarters, that does not speak highly about our judiciary.
