Cases of married men committing suicide on the rise: Report


Kolkata, Oct 3 (PTI): Every nine minutes a married man commits suicide in India due to alleged misuse of section 498a of IPC against them, taking the toll to around a whopping 64,000 every year, says a report.

"National Crime Records Bureau statistics reveal more incidences of suicide by married men than by married women. In 2012 approximately 64,000 married men committed suicide vis-a-vis 32,000 married women," says DS Rao, president of Hridaya-Nest of Family Harmony, an NGO, quoting a survey by it.

As per Section 498a the husband of a woman or his relative who subjects her to cruelty shall be punished with imprisonment for a term of up to to three years and shall also be liable to fine.

Rao said the misuse of 498a also leads to suffering of old parents as well as the family members and relatives of the men against whom the complaints have been lodged.

"The law is not serving its purpose and is instead being used by a section of the people to vent their anger and extort married men and their families," claimed Amit Gupta, an official of the NGO.

In West Bengal the number of cases under the section has grown exponentially at the rate of 11 per cent in the last two years but the conviction rate has dropped to just 4.4 per cent from 6.3 per cent earlier, as per the survey.

West Bengal accounts for 1.06 lakh case, which is more than 20 per cent of the total cases filed under the section and 80,000 people were arrested for such cases against him last year, Indranil Gupta, an official of the NGO said.

The NGO works for upholding the rights of married men and providing them mental support when falsely implicated under the section. The police say it is 'really hard' prove the cases as false.

"Till now we have not been able to prove that these cases are false because they are cases of mental torture. How would you prove that mental torture has not taken place?" said Joint CP(Crime) Pallab Kanti Ghosh.

Criminal lawyer Kaushik Chanda agrees that Sec 498a is "miused" but said whether the suicide of married males is linked to it should be looked into. "The reason for suicide by married males should be looked into because in most cases they get bail (after being charged under the section 498a)," he says.

The NGO findings is rubbished by West Bengal Women's Commission chairperson and leading women activist Sunanda Mukherjee, who feels there is still a huge section of women in the country who need to be sensitised about their rights. "This (the findings of the NGO) is nothing but a product of male chauvinism. There is still a huge section of women who need to be sensitised about their rights and who are regularly tortured," she says.

Hridaya-Nest of Family Harmony has started helplines and is providing free counselling to the callers and victims of harassment who have been falsely implicated. Besides, it also provides knowledge sharing and legal aid. "There are many people who come to us for help. Some of them are so mentally devastated that they are on the verge of committing suicide," says Gupta.

"We have bank of court orders and experienced members to guide the victims to fight the false cases against them under section 498a," he said. RTI and public interest litigation are tools to fight for the rights of such men, he adds.

    Let me assure you, I practice what I said - I hope I don't need to elaborate.

    You are not wrong in saying that girls will not agree to it. I have witnessed, to my utter shock, daughters demanded unbelievable things from parents though the fragile couple had to sustain heavy loans to satisfy their daughters. All fingers are not alike - similar is the case with men - not all demand objects from their in-laws.

    Well, its the parents who must explain it to a daughter 'have educated you, now you earn your riches'. Allow her to find a partner who understands this and accepts her. No conflicts !

    Even kids are not spared by police they arrest each and everyone..if the wives deliberately names in their complaint..

    Please go back to their history and find out how kind the humiliated men were to the parents of their wife at the time of marriage. I have said it before - you torture her parents until marriage - you will be jointly tortured thereafter.

    Its time we adopt a policy 'accept no dowry - invite no worry'. Opt for a simple marriage - forget culture and tradition - marriage is a two step ceremony (1) Religious (2) Civil. Both can be carried out with very minimum cost.

    Opting for extravaganza at the expense of girl's side is cursing the parents for bearing a daughter ! Well, misusing the Dowry Act is wrong but its beginning is made by the groom and his parents - none other !

    Sadly nowadays married women and her side misuse DV Act, Section 498A for their personal gain. For every of a hat she threaten to file false case against husband and her parents. . Because of biased and pro wife laws Men have to face all these tortures and he silently face all humiliations at the hand ov his wife and in laws for the sake of his children’s future and social stigma. Why I wrote pro wife law because it supports wife only and not women who could be mother in law or sister in law. Adding to injury government going to bring one more legislation in which married women entitled to fifty percent rights of husbands inherited or inheritable property in case of divorce. Then one can see more and more misuse of DV Act. Government should treat both the gender equally and punish the guilty one regardless of men or women.

    West Bengal Women's Commission chairperson says the report is wrong and its male Chavinism.
    Madam, These are death number what about others who are suffering and do not end up committing suicide?
    Educated women are using this law to blackmail poor men.
    I have 2 relatives in mangalore who have been effected by 498a and their family too was put in jail. All the husband did was to ask her to be more adjusting with everyone thats all.
    They ended up paying lot of money to remove the case.
    These days if you tell your wife not to talk to strangers or chat with men late its mental torture.
    If you dont buy her something she wants its cruelty
    If you want to sleep with her its sexual harassment.

    These laws are not being used by the real women victims since these women ngo's are not going to villages to educate them. They prefer sitting in city and chilling till something comes to them.

    As far as for MEN, Pray that the government will reconsider these laws to at least make it fair to both sexes.

    Take a woman in marriage in the clothes she wore, jewels she has on her - do not demand a dime from her parents. Future providing will be as per your ability.

    Warn your parents that from the day of your marriage you are divided into two. One half is you, the other is your wife. Tell the wife, your parents are hers. She disobeys, consequences will be that she will packed off to her parents house.

    No need to commit suicide !
