Thackeray Facebook Post : Magistrate Transferred, Two Cops Suspended

Mumbai, Nov 27 (PTI) : A week after two girls were arrested for a Facebook post on Mumbai shutdown for Bal Thackeray's funeral, the Bombay High Court has transferred the magistrate who had sent them to judicial custody and later granted them bail.

The transfer orders were issued yesterday by the Registrar of the High Court following which it was communicated to the Home Department, Chief Judicial Magistrate and Judicial Magistrate First Class R G Bagade.

The order said, "Judicial Magistrate First Class at Palghar R G Bagade is hereby transferred in the same position to Jalgaon with immediate effect."

The girls-- Shaheen Dhada and Renu Srinivasan-- were arrested last Monday after Dadha posted a Facebook status lamenting the Mumbai shutdown for Thackeray's funeral on November 18 and Renu 'liked' it.

They were arrested under IPC sections 295 (A) (deliberate and malicious acts, intended to outrage religious feelings or any class by insulting its religion or religious beliefs) and 505(2) IPC (statements creating or promoting enmity, hatred or ill-will between classes) and the IT ACT.

Later, the girls were produced before the magistrate, who sent them to judicial custody and later granted them bail on Rs 15,000 each.

The incident had sparked off a debate in legal circles with some lawyers opining that instead of being granted bail, the girls should have been discharged from the case as they were booked under wrong charges.


Two senior cops suspended


The Maharashtra government today suspended two police officers, including a Superintendent of Police, following the row over the arrest of two girls from Palghar in neighbouring Thane district for a Facebook post on the shutdown in Mumbai for Bal Thackeray‘s funeral.

SP (Thane rural) Ravindra Sengaonkar and senior police inspector Shrikant Pingle have been suspended in the case, state’s Home Minister R R Patil told reporters. He said action has been taken after obtaining legal advice.

“There was no need to charge the girls under wrong sections,” Patil said, adding that there was no need to take hasty action (against the girls).

The girls Shaheen Dhada and Rinu Shrinivasan, both 21-years-old, were arrested after Dhada had lamented in a Facebook post the November 18 shutdown due to Thackeray’s funeral. Shrinivasan had ‘liked’ the post.

Though Dhada didn’t name Thackeray, the local Sena leader complained against the girls and police arrested the duo on 19 November, sparing an outrage.

On 20 November, police arrested the vandals who had damaged Shaheen’s uncle’s hospital on 18 November, despite her removing the post and apologising that day itself.

There are two things we have to learn from this incident. First of all, these two girls should have abstained themselves for making any comments regarding Mumbai Bandh observed due to Thackeray’s death. Just imagine if somebody died in their family and we made any unwanted or absurd comments regarding homage paid to those person and how could have retaliated by their family members and well wishers? Same way, Thackeray Family has more friends and well wishers than foes and by keeping one day Mumbai Bandh, sky is not going to fall, rather people would enjoy their holiday with their family and friends back at home. Secondly, Police should not have taken such an over enthusiasm action just because to show sympathy with Thackeray Family Members or Shiv Sena Followers. People may talk about one day bandh affect on Market, GDP, etc. But same time we have to be happy that at least one day revenue has been saved from those corrupt Officials and Politicians siphoning public money on daily basis. The truth is one day everybody departs from this beautiful earth as & when their call comes from GOD. We have to wait & watch if somebody dies in Congress Top Leaders Family at Delhi due to natural death and somebody makes same comments like this girl made for Mumbai Bandh, will our Police spare anyone?

Thousands of sena activists became unions leaders and caused losses for many organizations like Air India-Indian air lines.The whole Marathi workers are lazy to work and can work only from 9 to 5pm.The Bombay is Mumbai and still standing strong not because of Bal Thakray but because of Mangalore and Gujrathi people who contributed so much to Mumbai economy.

I am a great admirer of Balasaheb Thakre. He is my favourite. I prayed for his good health when he was sick breathing his last. When I posted comments on Facebook for his good health, so many posted dirty comments n were wishing his death. I want to know if those guys they were not arrested? These two girls just questioned about bandh were arrested for no reason. Their uncles clinic was ransacked. That's not the way to pay tribute to Balasaheb! Twenty lacks fans attended his funeral in such a peaceful procession. Action taken by Govt is absolutely right. Justice should be done with girls.

These young girls were arrested under IPC sections 295 (A) (deliberate and malicious acts, intended to outrage religious feelings or any class by insulting its religion or religious beliefs) and 505(2) IPC (statements creating or promoting enmity, hatred or ill-will between classes) and the IT ACT. It is absurd to say that protesting against the bundh hurts religious sentiments. Under Article 19 of our Constitution, freedom of speech is guaranteed fundamental right. We are living in a democracy, not a fascist dictatorship. In fact, this arrest itself appears to be a criminal act since under sections 341 and 342, it is a crime to wrongfully arrest or wrongfully confine someone who has committed no crime.
If people lose trust on the police and the judiciary then there is nothing left to tackle the corrupt political cartels, the emotional terrorists and the big bullies who had openly destroyed the hospital of the girl's uncle.
Even I feel that respect is earned, not given and definitely not forced. That day Mumbai had shut down due to fear and not due to respect.
Very vocal support from Press Council of India chief Markandey Katju, who has demanded "immediate" action against the police personnel who arrested them, was a big relief for these girls. Until we have people like you, we are safe in this uncertain and incredible India.

What is the use of transfering the Magistrate from one place to another in the same position. It has no meaning at all. If he was demoted and transferred then it would have been some meaning to it.

Salute the Judicial System. If an individual judge did not do proper homework understanding the case and taken an erratic decision, Higher level not only taken action but also action is seen to be taken. If the erring persons dismissed from the services summarily, it would be great and that will be real deterrent. This actions seen in Maharastra State to be replicated in entire country which will bring better control in entire system and Mr. Kejriwal and Anna Hazare will not have much job to do.
