Kerala HC issues order asking Centre to open Mangaluru-Kasargod border


Kochi, Apr 1 (IANS): After three days of hearing, the Kerala High Court on Wednesday night issued interim orders, asking the Centre to open the border connecting Kerala's Kasargode district to Karnataka's Mangaluru.

Since last Thursday, Karnataka had closed the border, after Kasargode had become the hotbed of positive coronavirus casest.

A division bench headed by Chief Justice S. Mani Kumar issued the interim order after hearing both the sides - Kerala and Karnataka -- through video conferencing, issued the interim order.

The bench refused to give one more day, when the Centre's counsel asked for it.

In the interim order, the bench said it is the responsibility of the Centre to open the border as it is a national highway and Karnataka has no right over it..."

The court said the final orders will be issued later and the two sides can come back again.

Kerala for the past three days has been pleading for opening the border with even Chief Minister Pinarayi Vijayan speaking to PM and two Union Minister and telling them numerous Keralites go to Mangaluru for medical treatment.

By now, seven people from Kerala passed away after not being able to cross the border and reach Mangaluru, forcing the bench to speak tough and pointed that they are forced to issue the interim orders, as lives are precious.

    Kartnataka Government is duty bound constitutionally to protect its people. Sealing boarders and restricting entry of people is a SOP approved by WHO during epidemics. Already, four Covid patients are admitted in Wenlock Hospital and is consuming state funded infrastructure and consumables. If court says national highways cannot be arbitrarily closed by state, let Kerala government understand that no NH directly leads to hospitals in Mangalore and Karnataka Government is well within its rights if they close state highways. Let CPM first admit there are lapses at Kasargod which have lead to present crisis and accept ownership for not developing the boarder district. If they have scarcity for funds to develop the district, let them implement Mahajan Committee Report. This "Dog in the Mangel" policy cannot go long to fool the people. Notwithstanding the above, stealing scarce food from neighbour's kitchen cannot be a long term strategy to satisfy hunger.....!

    Reasonable Restriction imposed by the Karnataka state government blocking roads and ristricting entry is not total prohibition and violative of Article 19 and it is in the interest of the citizens under Article 21,Disaster& Epidemic Act and notifications.#Justified

    Instead they can ask for Vijayans Govt Helicopter to shift patients or can request centre to provide Military Helicopters to shift the serious cases.

    Telling to open borders is NOT AT ALL a decision a living BRAIN to decide at this crucial time.

    Help each other..there are so many keralite nurses working in our hospitals ... We cannot ignore.. afterall they are asking on ground of life and death situation.. because we have good hospitals. What it will serve if we dont consider help when needed most. no one wants to be sick and sickness is cannot be avoided even if we try to but we can help. In this time of grief think positivly and let us have patience and kindness to each other. So please be kind..we can take care by not allowing them to mis use the facilities.     They pride themselves in constructing Airports in competition with Mangalore ( Not 1 but 2), but unfortunately cant mobilize treatment for their Northern part of the state.

    They have taken over all the agriculture, construction, jewellery, bakery, trading business in the state .
    They will ask you to speak in their language and shoe their arrogance when you dont reply.

    Go to any hospital and try asking directions or help in tulu, konkani, kannada.....

    The whole world is together at this time of difficulties. Countries are sharing the knowledge, some countries shower aids to less privileged countries, Pope prays for the world keeping aside his ailments, Temples are serving food to the needy along with churches and mosques.......and at this time 'some' Mangaloreans are hell bent on denying medical facilities to the people from Kasaragod!!!!

    Ban everything from entering, but consider ambulances with patients struggling between life and death.

    For me, at this moment, my hate for cunningness of mallus, their selfishness, their colonizing nature...everything is overtaken by empathy to those people who have always depended Mangalore hospitals for medical care. Foe that matter I would help any person in requirement of emergency medical care, irrespective of his state, religion, language or political affiliation.

    State borders are closed. Even within the state some districts are sealed. KeraLa govt could have arranged beds at least in the existing hospitals
    China built big hospitals within two weeks. Then this advanced state could have anticipated and arranged beds for the patients. There was enough time. Now blaming Karnataka for the death of an old lady. Don't they have facility to treat a single patient? The high court should snub the CM for his failure and blaming Karnataka.

    if you do, you would understand why Karnataka is not allowing to open the borders. its not selfishness dear Kerlites. Just imaging if we allow patients who come in for Necessary medical treatment like chemotherapy or Dialysis to Mangalore for treatment and they wont come alone they will come with a relative just imaging if he is infected just 2 days back (due to the lot of Cases in Kasaragod the probablity is high) , he wont have temperature and will be allowed to cross the border and here comes a disaster.

    SO PLEASE DON'T OPEN THE BORDERS , its for the safety of all and india

    Its time Kerla to do the unbelievable that is build a Hospital in Kasaragod within 10 days or less, we will hats of if CM dose this with the funds that he has said he has kept for Coronavirus.

    How come Kerala HC has jurisdiction on blockades which are in Karnataka? This comes under the sole jurisdiction of Supreme court.. Kerala HC has no jurisdiction over Karnataka. However the roads are still blocked until this dispute is solved in the Supreme Court. Even if the road is opened will the Kerala CM provide the hospitals here with funds to cater for the patients needs? I am sure the answer is No

    Our Medical colleges run mostly on the patient inputs from northern Kerala.
    Our educational institutes, mostly payment seats are occupied by mostly keralites.
    You may ask the 'tender coconut' seller in front of father Mullers, Unity or KMC in the city about the number of Malayali customers.
    Even there are many keralite doctors in our medical college. Some of the big hospitals are owned by doctors from Kerala. So the development of Mangalore has lot to do with contributions from Kerailtes.

    As human beings, let us not deny medical care to people from north Kerala. Open the borders for ambulances. There will not be ambulances passing every minute. You may well stop them at the border for a quick check of temperature. Let us become human beings rather than just Mangaloreans.

    Excellent, very well said in detailed. Few person here and some(can’t disclose here) are showing inhuman behaviour and discrimination, they don’t know that such behaviour comes with a large consequences.
    Mark my word, this attitude of few people going to cost a lot for real Mangaloreans, a medical college, multiple private multi specialty hospitals , several international standard institutes are gonna come up in Kasaragod just because of this behaviour.

    Some may think why you didn’t do it before.. I specified before in another article as well, people from Kasaragod are Gadi Nandu Kannadigas and setup everything in mangalore considering fact that both district regardless state, will benefit due to people, transportation , infrastructure etc.. that’s no more...

    Nipah virus has also been caused from Kerala recentlt.. where was Kerala govt. Back then?

    They should have learnt from the old Nipah virus and established hospitals in all populated districts which includes Kasargod.     Don't tell me that Kerala is not having hospitals for the treatment for their own people,in the whole of the gulf there are all kerela doctors and nurses .

    Kerela is a well renowned state to have medical professionals ,so I don't understand why treatment in Mangalore ,in Mangalore health professionals are few in number we need to protect them too .So concerned authorities please keep in mind all these little things .we are not having too many hospitals in our state itself, if anything big comes to us ,we have to face it so better be ready now itself ,before it's too late.

    DK residents have no concern for their own fellow residents what will they have for other state people?

    I'm also a DK resident and I go out on essential duty on every working day as mandated under govt orders and this is what I observed in past few days:
    - selfish behaviour on display on March 31, when markets were opened after many days of lockdown; zero concern for others while hoarding as much as possible.
    - zero concern for migrant labourers who have made our city their home; they remain forgotten, to be remembered when we need them to do our dirty jobs next.
    - people of all castes, religion, economic status, education level ignoring social distancing and quarantine regulations
    - birds, stray animals left to fend for themselves without usual scraps of food or water.

    We are quick to pass judgement on others and label them as ghatta, gowde, kadapu, annachi but we don't realise how much we depend on them for our social and economic growth.

    All these years we happily took economic advantage of their infrastructure shortcomings but during crisis we are quick to pass judgement on the same shortcomings that have contributed towards a not-so-small part of economic development of our district.

    I'm personally not in favour of opening the border and risk infection spread but this crisis is bigger than me or any individual. Medical help must not be denied to anyone; if we have it we share it with those that don't have it. We need not treat them specially but denying essential / life saving medical service during crisis is not humanity.

    I'm not sure Sankara, Ramanuja, Madva, Basavanna, Jesus, Prophet Muhammad (PBUH), Nanak Dev, Buddha or Mahavira would have approved of this hostility.

    U need to know why we call them ghatta coz they lack civic sense.
    We don't mock them coz they are poor, we mock them for their lack of civic sense. Behaviour such as spitting on the roads, listening to music in high volume in public places etc etc.
    You will rarely see native mangalore labourers doing such things and Of course all these migrant labourers are paid to do their job and not doing it for free.
    and they are paid handsomely compared to other places in the state and thats why they come in large numbers.
    Please open Udayavani and see how locals in udupi and other areas have come together and provided accommodation , food clothes etc to these migrant labourers free of cost.
    So please stop passing judgement on we Mangaloreans that quickly.
    Its in cities like bangalore where migrant labourers are being asked to vacate their rental houses, but not in Mangalore.
    Even a Mangalorean when he goes to other districts of the state is mocked as Mangaluru Manjunatha, Kobbari Yenne and what not. So its a universal problem and not restricted to Mangalore or Mangaloreans alone

    calling ghatta / gowde etc. is ignorance / arrogance (koopa manduka syndrome), not realising there are many gowdas (vokkaligas) in karavali itself...when a person becomes self obsessed, he loses sight of what is around, he gets into illusion that he is perfect , others are inferior..unfortunately this has happened to some extent in mlr...Gowdas are the most prosperous community in KN, no questions about it...

    I have visited Hassan Mandya and other places and I have seen their prosperity and arrogance both.

    They are mostly either into politics or as contractors. How many Gowdas are famous doctors, engineers ? Hardly any.

    I know you must be a Gowda and thats why you say they are the most prosperous community LOL.

    They are self claimed prosperous and superior and mention their surnames as GOWDRU instead of GOWDA on Facebook and other social media. They might be prosperous but they lack CLASS.

    We should first try to understand why lockdown is in place first. It's mainly to restrict movement of people so that we can keep the virus at bay. If people are allowed to move between states ( patients specially ) the whole purpose of lockdown is lost.

    Look at the state of countries which did not enforce lockdown seriously ( USA, Italy, etc ). I too agree we need values like compassion. But the need of the hour is minimize the effect of pandamic.

    Our authorities in our state and district have done a fairly good job so far compared to other states. We need to follow their instructions and let this crucial phase pass. Opening the borders and allowing people to enter from the virus hotspot will just put all the efforts done to keep the pandamic under control go down the drain.

    This development is really really distressing. One set of people are having their way.
    With a calculated determination they can takeover whatever they wish for be it our
    land,railway lines and stations and now our health system. Since the HKOK refused
    to give one more day obtaining a stay also may not be possible.

    We can perhaps mitigate the damage to a certain extent by insisting that the patients
    from across the border to have a prior confirmed appointment from the local hospitals.
    This document must be checked at the crossing.

    As we understand only Wenlok hospital is Covid ready with few beds. Whether the
    district will be asked to throw open all other hospitals too to receive 'guests' from
    Kerala whether they are Covid ready with isolation wards etc? The moot question
    is how many private hospitals are eager to oblige considering the enormous risks
    to the doctors and staff?

    While i support the cause of border to emergency requirement. But i totally disagree with Periya Vijayan's statement . Keralites come to Mangalore for medical treatment. It's not true. They also bring drugs, thieves, stone pelters and world banned groups to DK and create unrest among different religions for their cause. let the Kerala HC and CM guarantee that they will stop such activities in Kerala and it's purely for medical reason, probably Karnataka admin. might believe them and open the border. But it should be strictly controlled. It's like opening the Wagah border.

    Yes dear everyone has the right for medical treatment. But answer me one thing being one of the most educated people why Kerala is lacking proper hospitals ?
    We can see memes on people spending on liquor more than pakistan GDP etc...but they do t have money to build hospitals ? Come on 100 percent literacy means not education.

    Because of the wise decision of Karnataka Govt to close the Mangalore Kasargod border the people of
    Mangalore are safe. If it is opened as per court order the situation would be grave. Then there will be the possibility of extending the period of Lock down for a period of another 10 days. The Kerala govt. should be well equipped with hospitals rather than relying more upon Mangalore hospitals.

    Highways belong to the whole nation, but not the rest of the land, especially not the hospitals. The people coming from Kasargod can be sent back from Mangalore, or the hospitals can be directed NOT to accept any patients from out-of-state places. Only the Stste govt and the District Administration has to have the will and determination.
