Panaji: Salcete based builder ordered to refund buyer with interest

Panaji, Jan 17: A Salcete based real estate company has been ordered by the Goa Real Estate Regulatory Authority Rera to refund Rs 25 lac along with 10% per annum interest with effect from June 2016 to a complainant.

Rera member, Pramod Kamat passed the order on a complaint by Clifford D’Mello in July 2018. Clifford D’Mello had booked a flat at Varca from the builder in April 2016 after paying Rs 25 lac as deposit.

Clifford D’Mello requested to refund the deposit as the project did not begin even after two years. The builder was in no mood to refund the money and only gave false assurances. Therefore, a legal notice was sent to him.

The builder agreed during court hearing in June 2016 to refund the amount with interest, but failed to do so despite reminders.

Rera held that it is the duty of the builder to refund the sum as Clifford D’Mello is not an investor, but intended to buy the flat.
