Bengaluru: Man claims to be HIV-positive to avoid marriage - Gets arrested

Daijiworld Media Network - Bengaluru (SP)

Bengaluru, Dec 11: A person who broke his engagement to a girl by claiming himself to be HIV-positive, is behind the bars now after the girl found out that he was lying.

Often we find people lying about marriage out of enmity or to mislead someone, but in this case, the boy falsely claimed that he was HIV-positive. His marriage therefore was broken and he has been arrested now for relying on falsehood to hoodwink his would-be bride.

Policemen of Vijayanagara station here have arrested Kiran, the would be groom, after finding that the complaint of cheating filed by the girl was true. They got Kiran tested and the report said he does not have HIV infection. The youth is now lodged in Parappana Agrahara prison here.

Kiran

The girl is from Pattegara Palya in the city while Kiran  from K R Pura here is employed in a private company in Manyata Tech Park. The marriage was slated to be performed on December 1. The parents of the girl had spent hugely for the function and invitations had been distributed. Kiran, who went to USA two months before the marriage on official work, sent a message to the girl's mobile phone a few days before the wedding day, telling her that he was infected with HIV and hence marrying was not right. The girl brought to this to the notice of parents who met Kiran's family at K R Pura and insisted that their son should come back from USA. Kiran returned on November 27.

When he was tested for HIV, the results proved to be negative. It came to light that he lied to avoid a marriage which he was not happy with. The girl has sought justice. A case in which six persons including Kiran and his family members have been named as accused, has been registered.

Even before getting married, they have taken a step leading in different direction. Forced marriage is like sailing in a broken boat and would sail for a limited time... Wasting money for nothing. Only the lawyers will benefit. Now girl’s side may try to claim all the expenses from the boy. Whatsoever, this marriage is broken for a good ending.
Let both of them venture into second attempt with the choices of their own heart.

What rubbish case is this? The height of stupidity in Indian legal system.

If this guy doesn’t want to get married, that’s the end of it. Can the police or courts force any individual to tie the knot against his will? Has the police station in India started relationship counselling business?
More importantly, how can police or anyone else force the guy to undergo HIV testing? What happened to right to privacy judgement of the Supreme court? What authority does the police have to force the matter?

This guy badly needs one good lawyer who can take on this case to nip in the bud. Otherwise, even 10 years from now he will be going around courts.

The engagement was in June,2019. Agreeing to marry is only an implied contract and it may not stand to be enforceable. Boy has now said to police, that he found something in girl and he does not want to marry and he made the story of Aids to protect the dignity of girl.

Girl's parents claim that they spent 3.5 lakhs during engagement and 13 lakhs now preparing for marriage ceremony. Girl is prepared to marry him now, since the Aids test showed negative. It is like "You can take the horse to water and cannot make it drink". I do not know why a girl wants to spend her whole life with a man who does not love her.

Boy has already got the bail and he is out. May be he will have to give the compensation to girl's parents for the money they spent, unless he proves the imperfection in the girl.

Exactly... Santan sir, I agree with your comment in full consent. What you ou put up here especially the point "why the girl would like to marry the boy who doesn't love her" ?

She is using "by force" method, for which boy should give complaint in return. Secondly, why to arrest him? For which reason? Good that he announced his inability to marry the girl......before their marriage, mentioning that he is so and so in order to protect the girls dignity.....Girl, asked him to come back from USA. Going and coming from USA like eating ladoos? Moreover, after arrival, complained/arrested him... She wanted remark on his passport and so his career should spoil. After marriage if he said so its is agreeable... Yes... Stupid mentality... May god bless this boy for his future.

    Height of stupidity!

They were NEVER married nor did they have any "Type" of relationship and he was miles away in another land.

When has it become a CRIME to break up an engagement? where is the "cheating" involved ?

It's either this article does not state all the facts or that the rural police are.....you know what! ( start from beginning)
