Wife gets triple talaq for refusing to take chewing gum from husband


Lucknow, Aug 21 (IANS): A man allegedly gave triple talaq to his wife inside the civil court premises in Lucknow in the presence of her advocate after she refused to accept a chewing gum from him.

The incident took place on Monday when 30-year-old Simmi of Amrai village had gone with her husband, Syed Rashid, to the Lucknow civil court for the hearing of her case of dowry harassment she had lodged earlier against her in-laws.

The woman was talking to her advocate when her husband offered her a chewing gum which she refused.

In a fit of rage, Rashid divorced his wife, uttering 'talaq' three times in the presence of the lawyer.

Indira Nagar Station House Officer (SHO), S B Pandey, said that Simmi, who had married Rashid in 2004, had lodged a case of dowry harassment against her husband and in-laws earlier.

Pandey said a case has been registered against Rashid under various sections of the Muslim Women (Protection of Rights on Marriage) Act, 2019 and the matter is being investigated.

    Education is the only thing which can solve this problem. They should teach in the madrassa about these things which is the need of the moment to enlighten the young. I don't think they teach the true teachings only to by-heart the book not knowing the meaning.

    In Islamic teaching of Quran, the Muslim holy book the marriage don't get nullifies in the single utterance of the 'Talaq'. Islam gives 90 days period or three menstrual cycles of women for reconciliation if both the party agrees to remove discord and once again like live together. The Quran also ask both the party to appoint the mediators.

    The Supreme Court earlier order in Shah Bano case also says that marriage doesn't get nullify in the single utterance of 'Talaq'.

    But the BJP government instead passed the 'Triple Talaq Bill' to destroy the marriage forever. As per the new law, the husband will be jailed for 3 years and has not allowed appealing the case until the wife permits.

    When Islam permits the marriage to nullify if both the parties disagree in 90 days, the PM Modi's BJP government on Sangh Parivar drafted bill keep hanging the marriage for three years until husband finishes his jail sentence.
    1. Which husband will like to accept her as wife once he comes out of the jail?
    2. Who has to look after the children's when the husband is still in jail and divorce is still not complete?
    3. Is this bill don't interfere with religious freedom under the Constitution of India guaranteed to every citizen of India?

    This bill is technically is flawed. Need to be relooked. The Muslim religious scholar needs to be part of this bill before any amendment has to be made.

    The technicality of the triple talaq bill if as you say is not right, then this should be discussed in the court.
    Most parties including Owaisi was against the 3 year jail term. However, proponents of the bill have argued that even after SC gave ruling against triple talaq, this practice continued.
    In India, regardless of religious affiliation, divorce is possible without a jail term. These are (a) divorce with mutual consent, (b) divorce enabled by court. In both these cases, women are protected with some kind of a settlement. Triple talaq was a one-sided affair.
    Your following questions are either naïve or mischievous.
    1. Which husband will like to accept her as wife once he comes out of the jail?
    May be none. But, he will be forced to chose between jail term or a settlement consistent with how law treats any individual. If judge has evidence that husband and wife started living separately for more than a year (not 90 days), this is ground for a divorce backed with settlement.
    2. Who has to look after the children's when the husband is still in jail and divorce is still not complete?
    When triple talaq was in practice, wife and children were abandoned instantly and either her parents looked after her or she had to fend for herself and children. Divorce is never easy on wife and kids. With law on her side, she will get some protection.
    3. Is this bill don't interfere with religious freedom under the Constitution of India guaranteed to every citizen of India?
    Marriage coming under religious freedom -> hearing for the first time.
    There has been sufficient discussion in the public domain on this. Only after the same, was this bill passed in the parliament.

    Why men are not forbidden to stay out of enjoyment with other woman for 90 days?

    The only thing that has still kept me wondering in this whole thing about triple talaq is after doing so another woman (and her family), is ready to get married to this (such) person, that too, in all grandeur.

    The present government has done and doing its best for the betterment of the women, now its time for women to realise and help and aid each other in such matters. The best example for the women of this community is to read the story of the women who have created the brand Lizzat Papad and have restored dignity (izzat) of many women who had undergone troublesome time with their spouse's families and community.

    Do you you have any idea of how Hindu couples get divorce through court procedures .... How long does it take and the court gives ample time to reconcile again .... what are the parameters, court consider while fixing a compensation amount or deciding on monthly maintenance amount .... Court makes sure that the women and children would not be done injustice ....
