'Fundamental rights guaranteed': India rejects US report on minorities


New Delhi, Jun 23 (IANS): India on Sunday rejected a US State Department report which made certain critical comments regarding the status of minorities in the country, saying it has "no locus standi" to "pronounce on the state of our citizens' constitutionally-protected rights".

In response to a query on the State Department's latest 'Report on International Religious Freedom', which says that mob attacks against the minority communities continued in India in 2018, External Affairs Ministry spokesperson Raveesh Kumar underlined that India is a "vibrant democracy" with constitutionally-protected fundamental rights of all its citizens, including minorities.

"We see no locus standi for a foreign entity/government to pronounce on the state of our citizens' constitutionally-protected rights," he said.

Significantly, the report was released just ahead of US Secretary of State Mike Pompeo's visit to India from June 25.

"India is proud of its secular credentials, its status as the largest democracy and a pluralistic society with a long-standing commitment to tolerance and inclusion.

"The Indian Constitution guarantees fundamental rights to all its citizens, including its minority communities," the MEA spokesperson asserted.

"It is widely acknowledged that India is a vibrant democracy where the Constitution provides protection of religious freedom, and where democratic governance and rule of law further promote and protect the fundamental rights."

The US State Department report, released on June 21, alleged that some senior officials in the ruling BJP made inflammatory speeches against the minority communities.

"Mob attacks by violent extremist Hindu groups against minority communities, especially Muslims, continued throughout the year amid rumours that victims had traded or killed cows for beef," it also said.

    You have to be really stupid to expect Modi to change his usual brand of politics after getting a massive victory as a result of it. Anyone who has followed Modi’s political career carefully knows very well that whatever mask he wears, it cannot hide his Islamophobic politics. His political talisman has always been Muslim bashing. He was virtually a nobody in BJP’s power politics in Delhi till he presided over a mass killing of Muslims as the Chief Minister of Gujarat in 2002. No other leader in India’s history has used the killing of Muslims as a badge of honor to energize his base as Modi has.

    The lynching of Muslims, as it has been on 21 June in Jharkhand, is not due to lawlessness in the country but because of the state-sanction behind it. It plays a key part in the strategy of Hindutva politics of social control. Lynching is not to punish crime, but to enforce inter-group hierarchy and to keep the political control with upper-caste Hindus. That has been the reason for Modi to maintain a strategic ambiguity on the lynching of Muslims.

    While India celebrates 150 years of the father of nation Mahatma Gandhi who gave freedom on the basis of 'Ahimsa', unlike the 2014 election, the 2019 election victory has given Modi the legitimacy to brazenly pursue an anti-Muslim position as he fought and won the election purely on the Hindutva agenda.
    PM Modi government has failed to protect minorities of this nation. It is time to submit a report to the United Nation that MEA statement is false.

    The US report confirms what is going on in India. Ground reality is something different than what is written in the Indian Constitution. In fact this report should be the basis for India-USA relations rather than extending red carpet to Modi.

    I dont think there will be a change on the ground because of this report as similar reports have been published every year since BJP took over at the center.

    The minority rights are deprived by Modi. BJP wants a Hindutva India wherein Dalits,Adivasis & Minorities are rendered 2nd class citizens and do the bidding of the upper caste. This has become a reality wherein Minorities are lynched at will and the police registers a case against the victims instead of perpetrators. This tactic is deliberately done to induce fear and submission in Minorities.

    The BJP has made a mockery of the fundamental rights guaranteed in the Indian Constitution. BJP leaders have incited violence against minorities with inflammatory speeches. BJP has not responded to most of the charges in the report. These are the charges against the BJP party and BJP governments in the report.

    "India’s “history of religious freedom has come under attack in recent years with the growth of exclusionary extremist narratives — including, at times, the government’s allowance and encouragement of mob violence against religious minorities — that have facilitated an egregious and ongoing campaign of violence, intimidation, and harassment against non-Hindu and lower-caste Hindu minorities. Both public and private actors have engaged in this campaign”, it said.

    “In 2018, approximately one-third of state governments increasingly enforced anti-conversion and/or anti-cow slaughter laws discriminatorily against non-Hindus and Dalits alike. Further, cow protection mobs engaged in violence, predominantly targeting Muslims and Dalits, some of whom have been legally involved in the dairy, leather or beef trades for generations.”

    It said “mob violence was also carried out against Christians under accusations of forced or induced religious conversion”."
