Chandigarh: Bata fined Rs 9,000 for charging Rs 3 to customer for bag

Chandigarh, Apr 15: A Consumer Forum here has directed Bata India Ltd, manufacturer of well-known branded footwear, to pay fine of Rs 9,000 towards deficiency of service committed in serving a customer, duly holding that it had committed wrong by charging three rupees for a bag it provided to him.

India Today has reported that Dinesh Prasad Raturi, a resident of the city, complained to the Consumer Forum that after buying a pair of shoes from Bata store at sector 22 D here on February 5, he was billed three rupees for the cloth bag provided to him along with the shoes. The customer pointed out that the Bata had advertisement of its products printed on its bag. Therefore he argued that the store was wrong in charging him for the bag.

Raturi not only demanded the refund of three rupees he paid for the bag, but also compensation for deficiency in service. Bata India representatives stood their ground, dismissing the notion that they had committed deficiency of service. The forum however, after hearing both the sides, concluded that the firm was wrong in charging cost of the bag to the customer, and considered it as deficiency of service. It observed that the store is obliged to provide a free bag to customers who buy its products.

The forum asked Bata India to provide paper bags to its customers free of cost. It also observed that if the companies are genuinely worried about environment conservation, they need to provide environment friendly bags to customer without charging anything. Bata also was ordered to refund three rupees along with litigation charges of Rs 1,000 to the said customer. The company was asked to pay Rs 3,000 as compensation for the mental agony caused due to its deficiency in service. It directed the company to deposit Rs 5,000 in the legal aid account of the State Consumer Grievances Redressal Commission.

The order has come as a rude shock to stores which have made it a practice to charge for bags provided to customers, and asking customers to bring their own bags if they want to save this cost.

    Here I find in allmost all comments,noone is ready to pay for a bag demanding shop must give them free because they bought so money thousands Rupee costed.But everyone who had gone to bazar forgot to take bags even though knowing they are going to buy xyz.Why is this attitude?Not talking of some rupees.Why are we not aware of our surroundings?What we do with our plastic abgs after we carry them home.?Is not our surroundings already filled with plastic and flying around.?we do argue with people sell things.?They only follow rules from their Boss.these plastic bags to produce ,they say a lot of rawoil is needed.and again it stuffs our water gutters after fish is bieng emptied.Ocean is full of plastic.wales or other big fishes are swallowing them thinking it is food and end later out of hunger.so let us be aware of these things.Either carry bags or pay money.

    This is what happens when u act too smart...Bata thought they could make money as well as market their product with their logo...good decision by the court...most importantly kudos to the customer for making the time and the patience to chase the issue...

    It is heartening to know about the step taken by the consumer forum in the incident refered in Chandigarh. Very many times shops like Big Bazar, Pantalooms, lifestyle, charge an extra price for a jute bag with the name of the brand or the outlet they are marketing. The most shocking part is price of the bag is between Rs 5/ to Rs 7/- .The quality is very cheap meant only for few days. Many times large stores dealing with household appliances dupe the customers by not providing a carry bag even though the purchase was above 20000/-Rs It is very apt move by the consumer forum to provide a fair and equal distribution between customer and proprietor.
    A welcome move.

    This is a disgusting practice all over the world. When one buys expensive items on which the store makes a huge profit they are stingy in demanding a few rupees to defray what? cost of bag? or is the store making a profit on it by bulk purchase and retail sale to customers? In some countries, such as Canada, the practice of charging for plastic bags is allowed so long as the proceeds go to environmental NGOs (a direct benefit to them on which many thrive). Plastic bags should be banned because they ruin the environment, especially the oceans where ocean life is suffocated. Some jurisdictions have banned the packaging in plastics, but the practice still continues. How will any one sell fish, for example, without first putting it in a bag (plastic? paper? or what else? - you can't carry it in your pant pocket!!!
    To be reasonable, government should insist provision of bags free of cost and these should be environmentally friendly. Stores used to put groceries at the counter in paper bags; very few, usually the small ones, do it now, The big supermarkets have dispensed with paper bags and only use plastic bags for which they charge more than what it cost them to buy, unless customer brings own bags. Customers like me do.

    Just couple of years back, I purchased shoes / belts etc worth Rs 14,000 from Reliance Foot ware in Bejai, Mangalore. The cashier asked me to give Rs five for the plastic bag, since I did not carry one . I politely asked the cashier, you are selling Rs 14,000 product and cannot give one carry bag. He did not agree. I just walked out of the showroom without buying the products.

    It is a common practice in India, to charge for carry bags at Shopping Malls and other shops like Big Bazar, etc. its the small roadside vendors who give "Free" carry bags.
    The consumer forum should check and fine these big establishments for the additional charges levied on the customers.

    Many shops, bakeries, sweet stalls hotels, supermarkets , departmental stores etc are charging Rs 3-5 for carry bags in Mangalore City. Citizens of Mangalore city are soft natured people so they are charged for the carry bags which is not justified. Also salesmen in bakeries, sweet shops and waiters in reastaurants in Mangalore dont wear hand gouses which is very unhigeinic, Health deapartment of Mangalore city corporation is not bothered as long as they get their usual gifts!

    Similar things are happening here in Bangalore also..Generally I take my own bag now a days just avoid shop is owners advt at our cost ....which is not at all acceptable.
    Good that Bata India might have learnt a lesson by above case.

    Remember Good Old Days,
    When we were going to Ration stores,we were carrying bags for rice and wheat and plastic locate for Sugar,Cans for kerosin,
    We were buying 25 Paise basket type bag weaved by coconut leaves for Fish at market itself.
    Last not least we were carrying our own bottles while visiting doctors for medicine, syrup.

    Last week i visited Lifestyle, city center Mangalore and did shopping worth 10,500 rupees..At the counter the cashier asked me if i needed a bag, i replied ofcourse i cant carry the clothes in my bear hands.he told it will be charged 7 rupees, i told them i have shopped for 10,500 rupees and still you are charging me for the bag, they told company policy.. i told them that its not right to charge the customer for the bag and you should be embarrassed to do that .. i paid and i left because i had to travel that night if not i could have argued with them. And yes their branding was in that bag...

    No sir, I am not agreeing with this. In all shops they tell that for carry bags they charge extra according to the size. No rules are there to give free carry bags. It is customers duty to take bages while going for shopping. Like vegetable markets and all. I carry 3 cotton bags while going for shopping .

    This is a lesson to all supermarkets in Mangalore.

    It’s disgusting to hear at the billing counter of a mall at the end of ur transaction worth Rs 10000 or more asking extra 7 rupees for a bag
    Hats off to the person who had guts to complain & got justice
    It’s humble request to the mall owners to stop charging for a small amount of bag when they get huge business

    similar to this many store chains like D mart, hyper etc are charging exorbitant rates. the consumer court take note of this and fine them. because of these bags, the stores are making lakhs of rupees
