Kundapur, Jan 17: Additional district and sessions court justice Prakash Khanderi sentenced Ampar Moodubage resident Vigneshwara (32) to ten years imprisonment and levied Rs 25,000 fine for allegedly taking advantage of a woman by making false promises of marriage.

The victim in her complaint to the police had stated that the accused, Vighneshwara, an auto-rickshaw driver, had come to her on June 2, 2011 saying that his parents wanted to see her. He had then taken her to his house at Moodubage, Ampar. He had physical relationship with her against her wish. He had also taken her to see Jog Falls on November 15 that year and raped her at a lodge at Sagar saying that he will marry her. But he later denied the allegations and refused to marry, stated the girl in her complaint.

The then Kundapur circle inspector Diwaker P M had submitted a charge sheet to the court. Twelve witnesses had testified in the court.

Additional district sessions court justice declared that the crime against the accused is proved and sentenced him under IPC 417 and IPC 376.

District government prosecutor Prakashandra Shetty Beloor argued for the prosecution.

    SC: "There may be a case where the prosecutrix agrees to have sexual intercourse on account of her love and passion for the accused and not solely on account of the misconception created by accused, or where an accused, on account of circumstances which he could not have foreseen or which were beyond his control, was unable to marry her despite having every intention to do."

    Since the victim was a.major and with normal mental faculties, this boy has been falsely implicated for sure!

    was the girl unconscious or drunk while going with him to jog falls.. It does not look like forced relationship.... yes he should not have cheated her.. but rape as mentioned by the girl is false story.. is she a kid to go with him alone to his house.... and after that to jog falls to roam.... stupid people around

    Exploiting trusting innocent girl is a CRIME - Money or Physical punishment to the perpetrator will heal the broken heart or mental anguish much less the disappointment. The fellow used the poor
    trusting girl and spit her out of his life disgusting! Lock him up for good! He deserves it.
