Bishop Franco Mulakkal arrested in Kerala nun rape case


Kochi, Sep 21 (Agencies): The Kerala Police today arrested bishop Franco Mulakkal for allegedly raping a nun multiple times between 2014 and 2016. With this, he becomes the first Indian Catholic bishop to be arrested in a case of sexual abuse against a nun.

The arrest was made on Friday afternoon in Kochi. He was being interrogated by the police for the past three days.

Franco Mulakkal is posted at the Jalandhar Diocese and he allegedly raped the nun during official visits to Kerala. He has been relieved of his duties at the Jalandhar Diocese.

Before arresting the bishop, the police recorded a fresh statement of the nun who has accused him of rape. They also sought clarifications on some evidences.

Mulakkal's arrest comes after three days of questioning during which the bishop made a few inconsistent statements.

    It is high time to think about the relevance of cast and religion. Of course, only very negligible priests only gone wrong, in any religion. But, without recognising the basic human needs, there is no religion at all. Allow them to marry.
    In this case, there is an element of unaccounted money also. Power corrupts. Unaccounted money corrupts more. God, whatever may be the name we like to call, does not require money. All Gods propagated love and affection. Support it. No blind faith.

    Nobody forced to go to priesthood. If at all somebody forced and if you can not control your thing come back and live a married life. But in any religion either our Swami, Mulla or Padri, Bishop or priest are preaching you should not do that that is a sin right? When you can preach others how you can do yourself is the MEGA question Mark. don't tell allow them to marry. Instead let them come back if they lost control is better.     Let the law take its course. Inconsistent statements need to be admitted and accepted in a court of law. Hope Police have not yielded to political and public pressure. If found guilty beyond reasonable doubt then the Bishop should be punished. An accusation of Rape cannot be condoned.

    Amen is just 178 pages but what hits you is the frankness and sincerity of narration. At times, the reader may get tired of one detailed episode after another, but finally comes a realisation that each episode is a bead in a chain of events that finally prompted her to step out of the grey habit.

    She accuses the Congregation of rampant corruption, “the huge chunk of money raised during admissions hardly goes though any accounting.” The infighting and viciousness of sisters come into the open. The victim has no succour.

    Homosexuality seems to be a bane many young girls have to silently endure at the nunnery. Sister Jesme suffered it too. Yet another taboo she talks about is how a few church fathers force themselves sexually on nuns. She plucks out an episode from her life as an example......

    A Superior should not have sexual contact withbthe subordinates or thise under their mercy. A doctor , a teacher and a priest should avoid sexual contact with the patient, with the student amd with people under them respectively.

    Typical Indian fashion to arrest a person on friday so that he has no avenue to seek bail being weekend. We cry from roof tops that an accused is innocent until proved gulity. What we have witnessed was a trial by the media and the pressure exerted by the protesting Nuns in full glare of the media.Logically none of the thirteen alleged cases of rape can be proved in a court of law given the extra ordinary time lapse between two to four years. Evidence perforce will be circumstantial in nature of one mans testimony versus a Nuns allegations abetted by a show of solidarity by her peers in the convent. A lie detector Test of both the Bishop and all the Nuns involved in the convent will get the Truth and nothing but the Truth. Prima Facie it appears to be a case of miscarriage of justice.

    There have been various rulings in the past by the Supreme Court and the High Court on the issue. Some of these rulings clearly stated that when two adults enter into a physical relationship on the pretext of marriage, the sexual act cannot be termed as rape.

    Recently, the Bombay High Court observed that when two consenting adults “consciously enter into a physical relationship, they are fully aware of the consequences and must bear the same”.

    When nuns have no backup, youll find them n streets, fighting for justice.

    Typical Indian way to arrest a person on friday so that he does not have any avenue to seek bail. An accused is innocent until he is proved guilty. How can the police prove rape charges that took place from two years to four years ago.

    The journey then will be very peaceful.... if you really want to seek.
    It is unfortunate that we help install 'mere human beings' in high pedestals and that too in the name of religion. For eg .here...The Bishop 's job is not that of a professional. It's of a very different dimension. A mere mortal without any knowledge, of pre requisites etc required to conduct himself in such a stature is bound to falter.
    The community as such then is left to suffer.
    The Law taking it's own course for years together after all harm is done is another matter altogether.

    The trial by the media and the pressure exerted by the nuns by protesting in full media glare has resulted in the Bishop's arrest. Justice will be met only when both the Bishop and the Nun agree to a lie detector test so that the Truth and nothing but the Truth is revealed to the public.

    The Bishops arrest is more on circumstantial evidence based on allegations of a Nun and mob mentality of the other nuns in a show of misplaced solidarity.

    The case will reveal the truth to a certain extent as it progresses.
