Puttur: Online transfer to different accounts with same name, court intervenes

Puttur, Aug 6: The name of both ladies in question is the same. Rs three lac that was to be deposited to the account of a person's wife has been credited to some to other lady's account by oversight. Now the lucky beneficiary is saying that the money belongs to her. The court has directed the bank of the stranger lady not to release the funds to her.

This is a net banking transaction that went awry. Puttur chief civil court has ordered the branch of a bank in Haryana not to release the amount, which was deposited by mistake in the account of one of their lady customer.

Dr Prithvinarayan P had transferred an amount of Rs three lac to his wife's account via net banking. However, due to oversight, this amount got deposited to some other account, which had the same name as that of the wife of Dr Prithvinarayan, at Bhiwani branch of Punjab & Sindh Bank in Haryana. Dr Prithvinarayan came to know about
this mishap after three days of the transaction and he made a request to the said branch not to release the amount to the stranger. In the meantime, the lady, who is a customer of the Bhiwani branch of Punjab & Sindh bank also sent an application to the bank saying that the money belongs to her.

A case was filed in this regard in the Puttur court. The court which conducted an inquiry passed an interim injunction to the manager of the Bhiwani branch of Punjab & Sindh Bank and asked him to hold the amount of Rs three lac. Lawyer Girish Mali had argued the case for Dr Prithvinarayan.

Error due to the similarity in names

Dr Prithvinarayan P, a resident of Barimar near Mani, is an assistant professor in Palakkad IIT. He had opened an NRI account in Karnataka Bank of Puttur when he was in Israel. He had transferred an amount of Rs three lac through this account to his wife Kusum's account in the Sonepat branch of Karoor Vaishya Bank in Haryana on July 27.

Kusum, who did not receive the money even after three days informed the matter to her husband. When Dr Prithvinarayan checked, the money had been credited to the account of a certain Kusum, who had an account in the Bhiwani branch of Punjab & Sindh bank.

Immediately, Dr Prithvinarayan informed the same to the branch manager of Bhiwani branch of Punjab & Sindh bank. However, Kusum, the stranger got the smell of money and also claimed with the branch manager that the amount belongs to her. So a case was registered in this regard on July 31 in the court of Puttur. The court which went through the documents gave an interim injunction in this regard.

    Before transferring any funds via net one has to register the beneficiary with IFSE code and full account details once it is confirmed by SMS and email : dear customer you have added XYZ account as payee,if not done by you please call customer care-funds transfer >>>>>> finds can be transferred only after 24HRS before that you need enter a URN number to confirm the same.
    This is the normal procedure in all standard bank.

    ** one can transfer funds through to only Added/Regfistered payee only.

    *** chances are there that previously he had transferred funds to *that account now just to pacify his wife he is changing the topic.

    This is only a half story. The full story needs to be dug out if people need to feel that net banking or digital services are to be trusted as safe in India.

    If you make a payment via net banking then the payment will go to the account number mentioned. If there is a mismatch then the receiving bank needs to automatically return the funds to the sender. Something seems to have gone wrong and there appears to be manual intervention at the receiving bank's side who must have gone and credited the proceeds on their own.

    A google search reveals that Karur Vysya Bank (wife's bank) and Punjab & Sind Bank have different IFSC codes - so how the money ended up with Punjab & Sind Bank is a mystery. Also most banks have the beneficiary maintenance feature on net banking where all the details of the beneficiary are pre-stored (someone with net banking account with Karnataka Bank will be able to confirm if this is available there).

    It is not possible that any bank credit or debit the account only by name. The name be same but account number will not be same. Being the accounts in different banks and different places it is impossible that money can be credited to another account. 3 lakhs transfer is not possible by IMPS. We need to add beneficiary details then only we can transfer the amount. So here this professor might have transferred the money to correct account but later wanted it back from her. Something phishy..

    Yours seems most sensible point view.

    The solution can be (1) The bank reverts the money to the depositor because at-least there is no second claimant - Ha Ha !

    (2) If the wrong beneficiary claims the money belongs to her, she should explain how ! Why the money should come to her and from the specific depositor. Doodh-ka Doodh, Paani-ka Paani !

    Funny . banks go by account number and not by name.with so many checks and balances error can easily be rectified by banks why go to court. Bank should first release the funds to the rightful owner and then fight the case with its own funds. Why hassle customer if he is right

    There is something fishy in this post. If the person had put wrong IFSC code then the money would surely get credited to someone else's account in other bank. RBI's server only requires the A/C No. & IFSC Code, Name does not matter at all. You can register any name in the net banking. If anyone has transferred in wrong account then banks are not responsible for that, He has to contact the other person directly, if he is not willing to return the money, then he the person has to lodge an FIR and take the legal action. After all it's his money he will get it back.

    Don't blame digital India it was the failure of person who used net banking without proper knowledge. If the intention was to transfer to Karnataka Bank branch how it transferred to Punjab and Sind bank? What about account number? Looks something fishy in the transaction? Name may be same but account number and name of bank?

    When u paying or involved in net banking kindly double ensure all details r correct and accurate. if not do not go for net banking. Sometimes due to oversightness anything can happen and eventually bear the financial loss.
