Supreme Court condemns mob lynching, recommends Parliament enact law


New Delhi, Jul 17 (IANS): The Supreme Court on Tuesday condemned mob lynching incidents across the country and urged Parliament to enact a law to deal with the crime that threatens rule of law and the country's social fabric.

"It is the duty of the State to maintain law and order, social and pluralistic fabric of the society and the rule of law," bench of Chief Justice Dipak Misra, Justice A.M. Khanwilkqar and Justice D.Y. Chandrachud said.

Pronouncing the judgment, Chief Justice Misra said that no one can take the law into their own hands or become a law unto himself.

Issuing a slew of directions including preventive, remedial and punitive steps to deal with the crime, the court said that mobocracy will not be allowed.

Asking the Centre to file a compliance report on its directions, the court adjourned the matter to August 20.

Th judgment came on a petition seeking the apex court's intervention to curb the incidents of violence by the vigilante groups across the country.

    The draft of Maanav Suraksha Kanoon (MASUKA), a new law to address the menace of mob lynching was unveiled at the Constitution Club in New Delhi on 7 July.

    According to the draft, lynching is defined as:

    Any act or series of acts of violence, whether spontaneous or planned, committed to inflict extra judicial punishment, or as an act of protest and caused by the desire of a mob to enforce upon a person or group of persons any perceived legal, societal & cultural norms/ prejudices.

    What MASUKA propsoes
    1.Investigation to be conducted by Senior police officers.
    2. Designated Judges for trial and appeal at High Court.
    3. Special rights for victims, witness.
    4. Mandatory state government compensation within 30 days of incident.

    There are specific provision into the existing law, ie, to amend the existing Article 21 of the Constitution to address crimes related to mob violence. This includes mob lynching, rumour mongering, hate, etc.

    Mob Lynching which originated in United States can get rid and countries like Kenya enact law why India can't have the one which citizens of India has drafted for the first time?

    1. How many more headcount of Indian citizens need to sacrifice for this bill to be tabled in Parliament?
    2. Is constitutional freedom of Indian citizens can be granted by Supreme Court of India?
    3. Why PM Modi who wanted to speak can't speak this subject in 'Mann ki baat'?
    4. Why BJP is not taking action against their MLA, MP's openly garland and give monetary assistance and Jobs for the accused in public sector company?
