Accused in Gauri Lankesh murder 'tortured'; Karnataka HC seeks report


Bengaluru, Jun 19 (PTI): The Karnataka High Court has directed two magistrate courts in Bengaluru to submit a report on allegations of custodial torture of four accused in the Gauri Lankesh murder case and non-compliance of judicial procedures.

The allegations are "serious in nature" and the Registry of the High Court has been directed to communicate the order to the magistrates of the first and third additional chief metropolitan magistrate (ACMM) courts, Justice KN Phaneendra said when the matter came up for hearing on Monday.

"They should submit a report on the allegations within 10 days from the date of receipt of this order," he said.

In an affidavit, advocate NP Amrutesh alleged that Amol Kale, one of the accused in the case, was beaten, slapped and punched on his cheek by police officers while in custody.

The magistrates also failed to comply with procedures mandated by the Supreme Court regarding persons in police custody, he claimed.

The advocate is representing Kale, Sujith Kumar, Amit Ramachandra Degvekar and Manohar Edave, arrested in connection with the killing of the veteran journalist.

The counsel for the accused also alleged that the magistrate did not order a medical examination even after being informed on June 14 about the torture meted out to one of the accused by the police.

"Instead, the magistrate only recorded injury marks on his body," he said.

The counsel further said similar complaints regarding custodial torture of the other accused were also made on May 31 before the magistrate of the third ACMM, which was neglected.

Hence, he prayed for a court direction to authorities concerned to conduct a medical examination of the accused and a probe into their illegal detention and torture by the police.

He also sought Rs 25 lakh as compensation for each of the accused, besides a direction to the magistrate to record their statements in in-camera proceedings.

On June 12, the high court had issued notices to the Karnataka government, state police chief and police officials concerned in the matters.

It had also directed the police to ensure that the accused were not ill-treated.

Gauri Lankesh, a Left-leaning journalist and a strong Hindutva critic, was shot-dead from a close range by motorcycle-borne assailants in front of her house on September 5, 2017.

    I think Gauri heart pierced bullets had more heat than these police custody punches..... so its ok for them....

    Unless and until these lawyers who supports the killers are existing in the country these stories will crop up always....

    Police sure cannot bring out the truth from this criminals by giving them to eat banana or chocolate !!!

    Do you think the police in the UK, Australia, NZ or Canada solve their cases by applying physical torture? Rather, our own CBI does not apply torture on people in their custody. Who do you think has a much better rate of success in cracking a case and getting a conviction?

    Prosecution success rates in Western democracies generally range from 80 to 90%; the success rate of CBI is around 60 to 70%; and the success rate of state prosecution is abysmally low ranging from 5% to 25% depending on which state and the year that you look at.

    Further, do you any idea what custodial torture is? I am sure you get the idea from all the Indian movies you have seen where the police use some force here and there and the accused just spits out the truth. The reality my friend, is much more sinister than you think. Didn’t that poor driver in Haryana “confess” to sodomy & murder of a child in Ryan school? If CBI hadn’t taken over that case, he surely would be facing the death penalty.

    In any Indian movie, if a good guy has confessed to any crime owing to police torture, there is always a good lawyer that would save him. However, in real life, Sunny Deol from Damini does not show up in every courtroom of India. Hence torture cannot be accepted in police custody.

    In Baliga murder case no body is beatenup or tortured... this show double stand of the department and concerned ministers of the State Govt... Why ? Simple - If you have money and influence no body dare to touch you even if you are a criminal else these tortures are common for normal people. What happened in Nalpad Case... nothing because he is the son of a MLA with in the Govt....

    Real torture by the department is seen while citizens were arrested during emergency imposed by then Congress Govt. led by Indira Gandi.... Many new inventions were implemented behind the cells of police station and jails. No NGO or Human Rights commission were existing that time and many were killed and murdered without knowing their where abouts.... This is really bad and against the human nature... Let there be a clean investigation and to get truth out sometime dept uses the third degree treatment but it should be properly recorded and medically he should be examined before and after the tortured by a magistrate or a lawyer with govt. doctors... Let law take its own way and dept do everything to get the truth out in lawful manner... not like done during Emergency...

    Do you even understand the fundamentals of criminal justice delivery system in our country?

    The persons who are in judicial custody are ACCUSSED and not CONVICTED yet. Until the trial ends and they are found guilty, every court in India will deem them to be innocent. Innocent until proven guilty is a constitutionally guaranteed fundamental right of every accused and that is the exact course of action the high court has taken.

    Unrelated to this case, what makes you think that the police have a right to torture even a convicted murderer or rapist? Custodial torture is a sad reality on Indian policing system and it is a glaring example of state excesses against its own citizens. How could you even support such barbaric act in the name of justice?

    Just consider this. Lalu Yadav, Jayalilitha, Chautalas, Yedurappa, Amit Shah, Madhu Koda, A Raja, Kanimozi, Kalmadi, Karti Chidambaram, Subrato Sahara, etc. have all been to prison at some point in their life. However, none were subjected to custodial torture. I leave it to the little grey cells of your brain to decipher as to why the police only seem to take their liking on poor and marginalised people of our country and not on those who are politically / economically well off.

This demand was reiterated in the sixth edition of the convention in June 2017, which was reportedly attended by 132 Hindu outfits. Consequently, several nationalist legal-rights groups that are headed by former RSS members or members of its legal wing, the Akhil Bharatiya Adhivakta Parishad have cropped up.
    This case is classic example, how the lawyers who are RSS legal wing secretly planning to give 'clean chit' to save their cadres. In the past same persons are found in anti national activity by hoisting Pakistani flag in Indian sovereign land near Singadhi, Bijapur.
    First investigation of SIT made this case look act of single handed. Now legal team assisting to get Pakistani agent 'clean chit'.
    This is nothing but double standard of our legal system.

    Does anybody know the political affiliations of this judge? It will be interesting to know and might throw some light on this judgment. I do not recall any judicial enquiry when some common person or alleged thief died in police custody. Why this sudden interest by the judiciary about police brutality?

    A magistrate is legally bound to ask the accused when Police produce him in Court if he was tortured in Police Custody....this is a requirement of the law...in this case, I believe Magistrate recorded injuries on the accused person but did not send the accused to hospital to evaluate his injuries...magistrate is not competent to evaluate injuries on a person and a Physician is...

    I have never seen anybody from a Civilized Country supporting Police torture....unfortunately you are doing it here...Pathetic...

    What books do you read to get this information from?

    As far as I know, Mahatma Gandhi was shot by Godse in his early morning prayer meet which was attended by 100’s of people. And moreover, Godse did not do a runner after the shooting. So, there are witnesses to the shooting, gun & bullet, gun with his fingerprint and a post-mortem report to confirm death by bullet wound. Where is the question of Godse confessing or not confessing to the murder? A murder conviction does not require a confession from the accused in India.
