Nirav Modi faces fresh FIR for using six Indian passports


New Delhi, Jun 18 (PTI): Agencies probing the alleged USD 2-billion PNB fraud have detected that absconding diamond merchant Nirav Modi possessed at least half-a-dozen Indian passports and a fresh FIR is being mulled against him for this offence, officials said on Sunday.

Modi has been traced to Belgium by Indian intelligence agencies and his frequent travels, despite the revocation of his passport, have led the sleuths to unearth that of the six passports he held, two were active for quite some time.

The four other passports were found to be not active, sources said.

Of the two active passports, one had Modi's full name while the other only had his first name with a 40-week UK visa issued against it and that is probably how he kept travelling to various countries, despite the government revoking his first known passport earlier this year, the sources told PTI.

The second passport was also subsequently revoked by the Indian authorities.

The sources said the government, through the ministry of external affairs, has informed the Interpol about the two revoked passports of Modi, but it appears that in the absence of a uniform international mechanism, the legal blocking of the documents in various countries could not be done and the fugitive diamantaire kept using those to travel through airports and possibly seaports too.

The revocation order of the passports has been appended to the application of the probe agencies (CBI and ED), seeking an Interpol arrest warrant or a "red corner notice" against Modi.

"It is a criminal offence to use a revoked passport and also to possess more than one valid passport if a person does not enjoy a special status like that of a diplomatic entity, a government employee or on a few other grounds.

"A fresh criminal FIR may be filed against Nirav Modi and he may face prosecution for the offence after the completion of an internal inquiry," a senior official in the security establishment said.

He added that an inquiry was also being held to ascertain if Modi was using passports issued by other countries to travel.

Recently, the Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED) have again urged the Interpol to issue an arrest warrant against the fugitive diamantaire on the basis of their respective chargesheets against him and others, containing corruption and money-laundering charges.

Once the Interpol issued the notice and Modi's latest location was ascertained, the government would move for his extradition, the sources said.

The ED will also move a special court in Mumbai to seek an official declaration to categorise Modi as a "fugitive" on the basis of the prosecution complaint (chargesheet) filed last month and for immediate confiscation of assets worth over Rs 8,000 crore, owned by him, his family and associated firms.

Modi, his uncle Nirav Choksi and others are being probed by the agencies after the fraud came to light, following a complaint from the Punjab National Bank (PNB) that they allegedly cheated the bank to the tune of over Rs 13,000 crore with the purported involvement of a few employees of the bank.

The CBI and the ED have registered two FIRs each in connection with the case. Both Modi and Choksi are said to have left the country before the criminal cases were lodged against them.

    The Gujarat Development model takes many forms. Possessing half a dozen Indian passports is one of them.

    Many major crooks have been found in the past to be carrying multiple Indian passports.

    But, with all the technology available, there is no serious attempt by the Government to limit a single passport to a person.

    What is the use of Aadhar with its biometrics if not to prevent mega-frauds?

    But then again, we have very low educated people as our National leaders. Was it Joseph de Maistre who said "Peoploe get the Government they deserve"?

    One can buy the citizenship of some small countries just by paying $100,000. For example: Dominica Island in West Indies offer citizenship and passport for $100.000. Thailand offers 5 year residency for $15,000.
    Most of these countries do not have extradition treaties with India. It is very important that the banks should take extra precaution while lending money in large amount. Banks should always assume that the borrower is a flight risk and secured the loan accordingly.

    Passport is not a proof of Citizenship. Indian Government documents can’t be trusted. Indian passport can be purchased like Modi's College Degree or University certificate. Passport is just a travel document or a booklet to record the arrival and departure of a particular person. In developed countries as long as you have enough money to travel and spend no one care about passport from 3rd world country like India. Unless India develop better relationship with developed and wealthy countries no country will cooperate with India in tracing/locating/holding or returning Indian Citizens. Money which gone is gone, forget it and never believe India gets anything back from Swiss Bank or any other foreign country. India should Control it National Banks and people while they are in India.

    We are told that both Mr. Nirav Modi and Mr. Choksi left the country before the criminal cases were lodged against them. Don't fool us. They won't leave unless there are other uncles who have facilitated their exit. What is Chawkidar saying all about his efficiency? Black money has not come in, instead chota escaped duping 13 thousand crores. Will it be brought in as well so that we could get 15 lakhs each before the term gets over?
