After Karnataka mess, ex-poll panel chief suggests solutions for future


Hyderabad, May 22 (PTI): Imposition of President's Rule would have been the right thing to do in Karnataka, where assembly elections resulted in a hung verdict with no party getting absolute majority to form the government, former Chief Election Commissioner TS Krishnamurthy said. He also suggested other options that India can explore to ensure a simpler, cleaner and more transparent election process.

"If the government cannot be formed because of the situation in Karnataka, then the right thing would have been to impose President's Rule," he said.

Noting that all three parties, BJP, Congress and JD(S) -- have not secured the majority, Krishnamurthy said that Governor Vajubhai Vala should have imposed President's Rule for three months and, if no government is formed within this time-frame, then recommend dissolution of the House and conduct fresh elections.

"I am not saying President's Rule is the solution, but it could have avoided all this wastage of time, money, alleged horse trading, and bargaining for portfolios and things like that," he said.

Solution for future elections

On the first-past-the-post election system, where a candidate winning the highest number of votes is declared a winner, Krishnamurthy said it should be done away with.

"First-past-the-post system should go, that has resulted in very undesirable consequences...people with 20-25 per cent votes get elected. Otherwise (if this system is not done away with) there will be loyalty to particular sectional interest like caste, creed or language whatever," he said.

"The best thing is to either introduce proportional system, where political parties get seats based on the percentage of votes they get, or insist on 33.33 per cent vote to be polled by the winner in which case smaller sections will play a less role and there will be more loyalty towards the constituency," he suggested.

If no candidate gets at least 33.33 per cent votes, then there should be reelection in that constituency.

"In many countries, 50 per cent-plus-one-vote is insisted upon for winning. As a first step, (we need to insist on getting) 33.33 per cent (votes for winning)...may be for the next five to 10 years, and thereafter make it 50 per cent (votes to be declared winner) so that political parties will not represent sectional interest," Krishnamurthy explained.

According to him, there should also be a separate law regulating the functioning of political parties. "And that law should also provide that once you are elected, you cannot be changing the party for the formation of the government".

The former chief election commissioner also called for a separate election fund and said corporates and individuals contributing to this fund should get 100 per cent tax exemption.

"That money will be used for elections so that there is no nexus between corporates and political parties," Krishnamurthy added.

B S Yeddyurappa had on May 19 stepped down as the Karnataka chief minister without facing the floor test in the state assembly as the BJP fell marginally short of numbers, following which JD(S) leader HD Kumaraswamy met Governor Vajubhai Vala, and said he had been invited to form the government.

The May 12 Karnataka assembly polls threw up a hung assembly, with the BJP emerging as the single largest party with 104 seats. The majority mark was 112.

    Why our Governments scared of linking Adhaar to voting? They want us to link our Adhaar to PHONE VENDORS, BANKS, RATION CARDS etc etc ... why not for voting? .... Then they can not do de-monetisation (CAN NOT CONVERT BLACK MONEY INTO WHITE for electioneering. People should raise their voices now and not just before 2019. We all needed a change in 2014; it is time again to seek a change for good.     Why not make the ant defection bill stronger by amending the same. If a member belonging to a party wins the election and then decides to defy the party whip, he or she should be immediately disqualified and neither he or she or any member of the family allowed to contest elections for at least 10 years. This will put an immediate end to horse trading and party jumping. Why is no political party thinking on these lines? The biggest curse in India is party hopping and nobody cares for the will of the constituents, policies, ideologies.

    Yes, Best option to get transparent result in india is to go for Ballet pater voting. In the entire world; only 3 or 4 countries are voting on EVM, rest all are on Baollot papers.
    if we so keen in electronic voting; then adopt digital voting, Means, no voting booths, no centres, no EVM or Ballots. there should be provision for voting online or on mobile app. since the AADHAAR CARD is final documents; evert citizer should enter her/his aadhaar number and one OTP should gernerate and that should be the PIN for voting. One OTP for one Aadhaar only and only 10 minutes should be allowed to vote. once the OTP entered the ballot page should appear with candidate and party logo with a number. person will enter the number and thats it. the voting is over. even disables, sick, over aged , working people, people who are in abroad also can vote and the voting percentage will be over 80 to 85%
    those who failed to vote within 10 minutes ; they can only try after certain time limit; not immediately.
    AND, IT IS BETTER TO HAVE ONLY 3 PARTIES IN THE COUNTRY. TOM DICK AND JERRY CANNOT MAKE A PARTY. ONE CONGRESS & ALLIANCES, SECOND BJP & ALLIANCES AND 3RD ONE WITH ALLIANCES.

    The only solution is to get back to Ballot Papers. If the World's greatest Democracy USA has reverted to Ballot Papers after their mistrust with EVM's, The World's Largest Democracy can also follow suit to doubly ensure that Democracy is not hijacked through EVM Machines.

    Far too many complaints about the EVM's since the general elections in 2014 and so the dire need to revert to Ballot Papers to restore Trust and Confidence in the Democratic Process.

    Yes - I agree to this policy. There should be a clause to be signed in electoral process... Every party should say that they will not join hands later after loosing the election. That will be illegal and that winning candidate should resign immediately. Now we could see even a small party with 1 to 5 seats in Assembly election make money in crores by declaring the support to a party to get a miniser post... Is this a business by begging votes from citizens... and this is a easy money making process for some stupids....
    If no party get majority - they should be barred to join later to form govt... then only this HORSE / DONKEY Trading business will stop.... Give respect to what result is appeared and sit in opposition.... OR impose Presidents rule immeditely and don't call anybody to form govt... then these Duffers will learn a lesson...

    50% of lawmakers support required for forming the government but law maker does not require 50% of people support .What a logic in our system. If more candidates are contesting then people should be given a second preference candidate voting. With this there is possibility of candidate getting 50% of votes .

    That is what I call selective tampering. BJP knew both Bava and Lobo are sure winners so, they played with the results. India will never change because corruption, looting and cheating is in their blood. I just read in the international news that 2 North Indians involved in cheating in Ontario pre-election and were asked to get out of the party immediately. Both are from North India. This what we are good in - CHEATING whether we are in North America, Europe, Moon or Mars.

    He is a fit case to be referred to NIMHANS. Mentally unsound. Imagine a ex-constitutional authority suggesting Presidents rule for three months to promote horse trading. The courts should award him life time imprisonment for such suggestions which promote corruption and murder democracy. this man must be Amit Shah's door mat.
    Would have appreciated if he had suggested re-election to all the constituencies instead giving people the power to decide even if it cost additional expenditure. The Will of the People should be upheld not the Will of VALA.

    If there is no majority, no coalition should be allowed, just impose Presidents Rule for five years or the remaining period of the 5 year term. It means we know election only once in five years. Lot of expenses saved.

    Former Chief Election Commissioner TS Krishnamurthy seems to be talking the language of BJP. If President rule is imposed it means reelections.

    Consider sme of the loopholes in the existing laws, all of which are used to the hilt by political parties to fill up their coffers.

    > Law only requires donations above Rs 20,000 to be made public. Parties show multiple amounts of less than that amount.

    > Barter deals like providing local transport are rarely accounted for in full.

    > Money spent on self-promotion before filing nomination papers is not counted.

    > No cap on how much political parties can spend on campaigning.

    > There is no standardised format for parties to declare incomes.
    > When the real cost of fighting elections is so high, politicians sometimes raise money through corruption.

    > Money is illegally earned by giving undue favours while in office.

    > Lack of close scrutiny of funding leads to questionable sources of funds.

    If we have to curb the power of money in our polls the first step is to make the party system and its funding much more transparent.

    Taking 2014 as the base, the cost of holding one election work out to Rs 10 crores per assembly constituency. Then Election Commision set Rs 28 Lakh for campaigning for each candidate per constituency. If one multiple the amount, It can feed its citizen free for several years without paying taxes.

    2. Why are votes cast in defiance party whips still valid?
    3. Can the court set the agenda of the house?
    4. Weaker Anti defection laws.
    5. People Representative Act not being fully implemented.

    Frequent election and reelection is only empty coffers of India. The economy is already taking sever beating and banks are already straine Ex-poll panel thoughts are without substance and don't have logic.

    First and foremost go back to paper ballot like most of the developed countries with sensible citizens until quantum computing takes over electoral process. Secondly if the governors continue to take their orders from PM, need some constitutional amendments - such as curtailment of powers/jurisdiction of governor, to put an end to it.

    When in power?
    There shouldn't be separate rule for each party when they have less than majority like in Goa,Minipur,Bihar--- that is not 10 years old story.
    Using full center machinery against the opposition should not be allowed for anybody.
    This time President of Central GOVT,Prime minister, Yogi and more than 40 central ministers campaigning still they failed to get 30% of vote sharing,
    If they would have been allowed they too would have brought inn Foreign underworld mafia as well.

    Sir thank you for your good suggestion .We all Mangaloreans know the game behind Yeddyurapa getting 104 seats. It’s not the actual people’s mandate .Its the electronic magic . India will go one sided if the EVM s are not replaced to ballot papers or A small suggestion to modify the evm . just see that when you click the button on evm machine you get a printed slip of the selected candidate and the voter has to personally drop the printed receipt slip in the ballot box for Incase to check finally if both the numbers tally

    How many crores? We know that BJP is itching to impose President's rule of a katputhli president. Not only here but Emergency in India.
    The informal visits to China and Russia, both communist dictatorships, raise doubts. Ploy would be to go to war with Pakistan with the at least tacit support of Russia and China and impose a state of emergency. Modi and Amit Shah are obvious megalomaniacs.
    Moreover there is the possibility now that after all that has happened over the past 5 years if the opposition comes to power it will pursue the cases against both these fellows on a war footing. So they would want to cover their backs.
