Congress opposes Bopaiah's appointment, to challenge decision in SC

New Delhi, May 18 (IANS): The Congress on Friday opposed the appointment of BJP legislator K.G. Bopaiah as Karnataka Assembly's Pro-Tem Speaker and said that the party will challenge Governor Vajubhai Vala's decision in the Supreme Court.

The party claimed that Bopaiah's appointment was made "with the sole intent of manufacturing a majority out of minority for B.S. Yeddyurappa".

"The option of going back to the (apex) court is open. We will positively bring this matter before the court," Congress Spokesperson Randeep Singh Surjewala told reporters here.

He said that Bopaiah appointment was the "third encounter of the Constitution".

"This is the encounter of the Constitution by the Governor at the instance of Prime Minister Narendra Modi and BJP President Amit Shah," he said adding that the trio of Modi, Shah, and Vala -- "in order to help the Yeddy, Reddy gang -- will not be permitted to subjugate democracy".

"He (Bopaiah) violates every single constitutional norm. The truth remains that the appointment of Bopaiah as a Pro-Term Speaker voilates every settled constitutional tradition and every settled parliamentary practice," Surjewala said.

Attacking the Governor, he said: "Vala cannot murder democracy in broad daylight, nor can he trample upon the Constitution."

He said the appointment of three time MLA as a pro-term speaker discarding the traditional claim of the senior most legislator itself reflects that the Bharatiya Janata Party doesn't have a majority in the new Karnataka Assembly.

"Just that they are trying to manufacture the majority by fraud," Surjewala said.

"The people of Karnataka are determined to foil and defeat these evil and nefarious designs of Vajubhai Vala, Narendra Modi, Amit Shah," he said.

Surjewala said that the BJP can't appoint a Pro-Tem Speaker of its own comfort. "They have to adhere to constitutional norms," he said.

Bopaiah, 62, is a three-time legislator from Virajpet in Kodagu region, 260 km from Bengaluru. He was Speaker during the BJP rule in the state from 2008-13.

    Tomorrow if supreme court bench does not give verdicts which are not favorable to Congress, they will go against SC too complaining that they are BJP supporters.... ridiculous Congress.... frustration due to loss of power throughout India is clearly seen

    Bopaiah, an old RSS hand, was administered the oath as pro tem speaker by Vala. He was the speaker of the Assembly between 2009 and 2013, was rapped by the Supreme Court for being partisan during the vote of confidence in 2010.

    KG Bopaiah, who has been appointed as the pro tem speaker ahead of the crucial vote of confidence in the Karnataka Assembly, was rapped by the Supreme Court for being partisan during the vote of confidence in 2010.

    “Drastic and partisan step taken in hot haste and great hurry with extraneous considerations,” were the words use by Supreme Court while striking down Bopaiah’s decision in 2010, disqualifying 16 MLAs to ensure that the then chief minister BS Yeddyurappa won the trust vote.

    On October 2010, a vote of confidence was called after several BJP MLAs had objected to the government under the leadership of Yeddyurappa. In a controversial move, the then Speaker Bopaiah had disqualified 11 BJP MLAs and 5 Independents.

    The appointment goes against the convention of the most senior MLA being appointed to the post.
    The “Magic Number” is 111 seats. H D Kumaraswamy won two seats but can only vote for one. Pro tem speaker will vote in case of tie.

    Manohar Parrikar chief minister of goa is very serious,suffering from cancer of pancreas.Those who do evil for others very soon evil will turn towards them.We have no right to hurt another human being.we need to respect law especially constitutions.let us not try to amend constituions according to our likes and dislike.let us be clean before the Almighty.After all none of us are permanent here.As long as we are here let us live in love and doing good and build a beautiful India.I love my India.

    Its shocking that a Constitutional authority like Mr Vajubhai Vala Governor of Karnataka is determined to subvert the constitution and create chaos by his actions just to appease his bosses in Delhi. The Stricture passed against Mr Bopaiah by the SC in 2011 "The Speaker's action did not meet the twin tests of natural justice and fair play. He was ignoring the constitutional norms. Extraneous considerations are writ large on the face of the order of the Speaker". Inspite of such a strong condemnation by the SC it is surprising that the Governor of Karnataka has chosen to nominate him as the Protem Speaker when the situation is so fluid and under the scanner of the SC. This is arrogance on the part of the Vala from Gujarat. We hope and pray that the SC will intervene and pass strictures against the Governor of Karnataka and ensure that the voting is done under the supervision of the SC.

    Did not had that courage to knock SC in getting Water for Gadag/Hubli and North Karnataka from Goa... When farmers commit sucide this fellow least bothered about the incident, But to grab power to run the Commission Business these people dont hesitate to do all types of gimics on road.... PEOPLE are Watching...
