Supreme Court orders Karnataka floor test on May 19, both BJP, Cong confident of winning

New Delhi/Bengaluru, May 18: In a huge setback for the BJP and its newly-appointed Karnataka chief minister B S Yeddyurappa, the Supreme Court on Friday May 18 refused to give any more time to the BJP and ordered a floor test in the assembly on Saturday May 19 at 4 pm.

The governor of Karnataka had earlier given the BJP 15 days to prove majority in the court. The SC cut short the time and asked the BJP to prove its majority on the floor in just over another 24 hours.

Former AG Mukul Rohtagi who represented the BJP in the SC sought more time, but the SC refused. Justice Sikri told the lawyer in clear terms that no more time could be given.

The court also junked Attorney General K K Venugopal's suggestion that the floor test be conducted through secret ballot.

Congress' lawyer Abhishek Singhvi and JD(S) lawyer Kapil Sibal agreed to the floor test.

The court said, "At the end of the day, whether post-poll alliance or a single largest party, it has to be tested on the floor of the assembly."

The SC also directed chief minister Yeddyurappa not to take any policy decisions till the floor test is over.

The court also directed the Karnataka governor not to nominate any Anglo-Indian community member as MLA till floor test is over.

Speaking to reporters later, Abhishek Sighvi termed the order as a 'landmark ruling' by the SC. He also said that the Supreme Court has given 10 weeks for a larger case on the issue of the role of the governor and guidelines to form government.

Meanwhile, the BJP said it is confident of wining the floor test. "BJP is ready and confident of winning trust vote In #Karnataka . We will prove our majority on the floor of the House," tweeted union minister Prakash Javadekar.


The Congress too expressed confidence of winning the floor test with the support of JD(S) MLAs.

"We welcome the judgement of the Supreme Court which has upheld democratic principles. Congress and JD(S) have a comfortable majority in the assembly and it will be proven in the floor test tomorrow," the Karnataka Congress tweeted on its official Twitter handle.


Congress communications in-charge Randeep Singh Surjewala said it was a victory for the Constitution. "Constitution wins, Democracy restored! #BSYeddyurappa does remain a 1 day CM - Constitution rejects an illegitimate CM as also the unconstitutional decision of Governor of Karnataka," he tweeted.


Presently, Congress and JD(S) MLAs are huddled in a hotel in Hyderabad, where they were rushed late on Thursday night in buses after DGCA denied permission for chartered flights to Kochi.

The BJP has 104 MLAs while the Congess-JD(S) post-poll alliance has the support of 115 MLAs.

    BJP allready has the numbers, Floor test is a formality. The understanding with some north Karnataka MLAs was before the results were out. So Congress will face defeat. However if for some reason this understanding does not work, there will be mid term elections and BJP will sail smoothly.

    I personally felt Congress will be the largest party. But Siddu conspired against MLAs and ministers like Kagodu Koliwada etc. it’s now revealed that Congress expected to become largest party so they drafted SC petition in advance if Governor invites BJP+JDs like happened in GOA. It’s a political hypocrisy every party do. But if Yeddi passes test it will be HDK loss since Congress already a looser hatched plan against HDK.

    There’s is reason for his confidence. Should know that CM Siddu lost Chamundeswari. In Badami just sailed with 1600 more votes. Half of the minister lost. here was chance for Yeddi son in Varuna but BJP didn’t field him. Around 14 seats BJP lost with just 1-2 thsnd votes. Yeddi would hav crossed 120. But as he said he took oath on 17th. Let’s see tomorrow what he does.

    Loss is loss! even if its one vote!!! If you argue that way, then I would like to remind you that Congress got 38 % of vote share but BJP got only 36%(that means 64% dont like BJP!)!!! but still BJP got more seats!!!. This means more people still support congress!!!. Same thing with Modiji! they got a mere 31% vote share in the whole country but they got highest seats!!! What you say now!?. There are many BJP MP's and MLA's who have won in few hundreds or couple of thousands margin!!!. Just google and find out!!!

    its so stupid to have the MLAs arrested in resort... now they need to release them .. to come to assembly for floor test .... this is the turning point which BJP is referring to.... how long Kumaraswamy and siddu can hold these MLAs... already few are lost and now few more will..... unless there is a confidence of getting the majority... BJP wouldn't have gone to Governor... remember that...

So to say, on 18th, that they want to join BJP is nothing but cruel mockery of their conscience and morals!!!.     whether it is setback for bjp or congress or victory for any political party but one thing is very sure that it will be the victory for common people of this country in future. We have saw all these dirty game from last 70 years. so many opposition party state govts were sacked by declaring president rule. the same congress party was used this dirty game for remaining in power. even they introduced EMEGENCY rule in democratic country for their power hungry. but unfortunately the same party now talking about democracy. anyway the judgement given by the supreme court will prevent this kind of incidents in furutre.

    We can see majority when MLAs take oath n figure out expected result. If all Congress JDS MLAs takes oath then it’s difficult for Yeddi to sail. BJP has to convince some opposition MLAs not take oath to bring down required majority mark. Also If Congress JDS gets speaker post we can see another high drama court battle also. But atleast we can hope this whole political game will end this weekend only. It’s very difficult to watch Ranganna Arnab and NDTV shouting.

    Don’t see a set back. Congress wanted to stay oath it didn’t happened, Congress talked about alliance strength but SC said prepoll and post poll alliances are different. Congress wants first to enter arena but didn’t happened. While BJP wants more time it didn’t happened. BJP wants appoint Anglo Indian MLA it didn’t happened. Fair game. But Yeddys wish of oath taking on 17 th fulfilled already.
